Once these improvements have been accepted, the City will incur no maintenance. DESCRIPTION: The Enea Properties Company recently completed improvements associated with Parcel Map 8407 (Enea-Village Parkway), a commercial-retail project located at 7197 Village Parkway. The work was governed by an Improvement Agreement executed on February 1,2005, via City Council Resolution No. 13-05. The improvements have been constructed pursuant to the Improvement Agreement and to the satisfaction of the Public Works Director, and it is now appropriate for the improvements to be accepted by the City. Permanent maintenance will be provided by the owner. At the time that the City and the Enea Properties Company executed the Improvement Agreement, the developer provided a Performance Bond and a Labor and Materials Bond each in the amount of $187,800.00 to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in 966499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $46,950.00 (Bond No. 0396556), which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements associated with Parcel Map 8407. COpy TO: Robert S. Enea, Enea Properties Company, LLC ITEM NO. 4-:l Page 1 of 1 G:\DEVELOPIENEA- Village Parkwaylagstacpt_ 8407 .doc ;~ 0-+' 3 RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS FOR PARCEL MAP 8407 (ENEA PROPERTIES COMPANY, LLC) WHEREAS, the subdivider of Parcel Map 8407, filed on March 16,2005, in Book 280 of Parcel Maps at Pages 59 - 60, previously entered into an Improvement Agreement with the City of Dublin to improve said Parcel in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: a) Developer: b) Parcel Location: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: Enea Properties Company, LLC 7197 Village Parkway Parcels A and B No. 13-05, City of Dublin City Council Amador Valley Boulevard, and Village Parkway WHEREAS, the Improvements associated with Parcel Map 8407 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the Improvements can be released, in accordance with the authority contained in 966499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Parcel are hereby approved and accepted subject to a one-year guarantee period. 2. The original Performance Bond issued by International Fidelity Insurance Company (Bond No. 0396556) in the amount of$187,800.00 be released; and 3. The original Labor and Material Bond issued by International Fidelity Insurance Company (Bond No. 0396557) in the amount of$187,800.00 be released; and 4. The submitted Maintenance Bond issued by International Fidelity Insurance Company (Bond No. 0396556) in the amount of $46,950.00 be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 17th day of January, 2007. 1 ATTACHMENT 1 If. z.
