Acceptance of improvements associated with the Grafton Station,
Phase 1 Commercial Center.

RECOMMENDATION: ~oPt the resolution accepting the improvements for Grafton
~ Station, Phase 1, Dublin Boulevard and Grafton Street.
FINANCIAL STATEMENT: The Whiting-Turner Contracting Company has provided a Warranty
Bond issued by Fidelity and Deposit Company of Maryland (Bond
No. 8894956) in the amount of $137,000 to guarantee against any
defects in the public improvements for a one-year period following
acceptance. The City will incur maintenance costs for these
roadway improvements.
DESCRIPTION: The Stanforth Holding Company, LLC, and the Whiting-Turner
Contracting Company have constructed improvements for Dublin Boulevard and Grafton Street to serve
their Grafton Station commercial center south of Dublin Boulevard opposite Grafton Street. These
improvements were completed in conformance with an Improvement Agreement entered into with the
Stanforth Holding Company, LLC, and the Whiting-Turner Contracting Company on July 17, 2007.
The Whiting-Turner Contracting Company provided a Performance Bond and a Labor and Materials
Bond, each in the amount of $1,119,000 (Bond No. 8894956), to guarantee performance of the work for
both public and private improvements for the Grafton Station, Phase 1 project. Now that the work is
complete, these bonds may be released in accordance with the authority contained in S66499.7 of the
Government Code, and replaced with a Warranty Bond in an amount necessary to guarantee the work for a
one-year period following acceptance.

The Whiting-Turner Contracting Company has provided a Warranty Bond issued by Fidelity and Deposit
Company of Maryland (Bond No. 8894956) in the amount of $137,000, which is sufficient to guarantee
the public improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the resolution accepting the improvements for Grafton
Station, Phase 1, Dublin Boulevard and Grafton Street.

ACCEPTANCE OF IMPROVEMENTS FOR GRAFTON STATION
PHASE 1 - DUBLIN BOULEVARD AND GRAFTON STREET
WHEREAS, the Stanforth Holding Company, LLC, and the Whiting- Turner Contracting
Company entered into an Improvement Agreement with the City of Dublin on July 17, 2007, to construct
certain roadway improvements to serve Phase 1 of the Grafton Station commercial center project, in
accordance with the approved plans; and
WHEREAS, the improvements associated with the Grafton Station, Phase 1 project, are complete
in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City
Engineer; and
WHEREAS, the Performance Bond and the Labor and Materials Bond can be released, in
accordance with the authority contained in 966499.7 of the Government Code of the State of California,
and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following
acceptance; and
WHEREAS, the Whiting-Turner Contracting Company has provided a Warranty Bond to
guarantee the completed public portion of the work for a one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed with said project are hereby approved and those
improvements. within the public right of way are accepted subject to a one-year guarantee
period; and
2. The original Performance Bond issued by Fidelity and Deposit Company of Maryland in
the amount of$I,119,000 (Bond No. 8894956) be released; and
3. The original Labor and Materials Bond issued by Fidelity and Deposit Company of
Maryland in the amount of$I,119,000 (Bond No. 8894956) be released; and
4. The submitted Warranty Bond issued by Fidelity and Deposit Company of Maryland (Bond
No. 8894956) in the amount of $137,000 be accepted as security for those improvements
within the public right of way for the aforesaid one-year warranty period, said period to
commence on this date and terminate on the 5th day of August, 2009.
