The City will incur maintenance costs for these improvements. Sorrento at Dublin Ranch I, LP, has provided bonds in the amount of $643,000 to complete the Tract 7641 improvements and in the amount of $293,000 to complete the Grafton Street improvements. G:\DEVELOPMENT, PRIV ATE\Dublin Ranch\Sorrento\Tract 7641-Sorrento West\agst accept Central & Brannigan imps.doc ~ DESCRIPTION: Sorrento at Dublin Ranch I, LP, a California Limited Partnership owned by wholly-owned subsidiaries of Toll Brothers, Inc., entered into a Tract Improvement Agreement with the City of Dublin to construct improvements required by Tract 7641, Sorrento at Dublin Ranch (West). Tract 7641 is the master subdivision for the western portion of Toll Brothers' Sorrento at Dublin Ranch, bounded by Brannigan Street, Gleason Drive, Grafton Street and Central Parkway. Tract 7641 improvements include roadway improvements for Brannigan Street and Central Parkway, which are now complete. In order to improve access to Fallon School for the residents south of Central Parkway, the City proposes to accept the Brannigan Street and Central Parkway improvements prior to the acceptance of the full Tract 7641 improvements. Sorrento at Dublin 'Ranch I, LP, provided a Performance Bond, and a Labor and Materials Bond issued by Fidelity and Deposit Company of Maryland in the amount of $580,000 for the Central Parkway improvements. These bonds may now be released in accordance with the authority contained in 966499.7 of the Government Code. Sorrento at Dublin Ranch I, LP, has provided a Warranty Bond issued by Fidelity and Deposit Company of Maryland in the amount of $145,000 for the Central Parkway improvements. Sorrento at Dublin Ranch I, LP, provided a Performance Bond, and a Labor and Materials Bond issued by Arch Insurance Company in the amount of $2,874,000 for Tract 7641 improvements. This bond includes $303,000 for the Brannigan Street improvements and $2,571,000 for the remainder of the Tract 7641 improvements. Sorrento at Dublin Ranch I, LP, has provided a Warranty Bond issued by Arch Insurance Company in the amount of $76,000 for the Brannigan Street improvements. The remaining improvements for Tract 7641 are more than 80% complete. In accordance with authority contained in 966499.7 of the Government Code, these bonds may be reduced to an amount of $643,000. Sorrento at Dublin Ranch I, LP, will provide a Warranty Bond in the amount $643,000 at the time the City accepts the remaining Tract 7641 improvements. The Lin Family and the City of Dublin entered into an Improvement Agreement dated June 1, 2004, to construct roadway improvements for Grafton Street from Central Parkway to Gleason Drive. The Lin Family assigned to Sorrento at Dublin Ranch I, LP, all rights and obligations to said Agreement as of April 1, 2005. Sorrento at Dublin Ranch I, LP, provided a Performance Bond and a Labor and Materials Bond issued by Safeco Insurance Company of America in the amount of$1,171,000 for the Grafton Street improvements. These improvements are more than 80% complete. In accordance with the authority contained in 966499.7 of the Government Code, these bonds may be reduced to the amount of $293,000. Sorrento at Dublin Ranch I, LP, will provide a Warranty Bond in the amount $293,000 at the time the City accepts the Grafton Street improvements. Staff recommends that the City Council 1) adopt the resolution Accepting Improvements and Approving Regulatory Traffic Control Devices for Central Parkway and Brannigan Street, and Approving Partial Release of Security for Tract 7641, Sorrento at Dublin Ranch (West), and 2) adopt the resolution Approving Partial Release of Security for Grafton Street, Central Parkway to Gleason Drive. Page 2 of2 RESOLUTION NO. - 07 l1Jt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTING IMPROVEMENTS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES FOR CENTRAL P ARKW A Y AND BRANNIGAN STREET, AND PARTIAL RELEASE OF SECURITY FOR TRACT 7641, SORRENTO AT DUBLIN RANCH (WEST) WHEREAS, the subdivider of Tract 7641, Sorrento at Dublin Ranch I, LP, a California Limited Parmership, filed on May 30, 2006, in Book 291 of Maps at Pages 26-26, previously entered into a Tract Improvement Agreement with the City of Dublin dated April 4, 2006, Resolution 35-06, to improve said Tract in accordance with plans on file with the City Engineer; and WHEREAS, the roadway improvements, excluding landscaping, associated with Central Parkway northern frontage between Brannigan Street and Lockhart Street, and Brannigan Street between Central Parkway and Gleason Drive, including the traffic signal modifications at the Central ParkwayIBrannigan Street intersection, are complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, certain regulatory traffic control devices have been installed as part of the Central Parkway and Brannigan Street improvements; and WHEREAS, the Performance Bond, and the Labor and Materials Bond can be released in accordance with the authority contained in 966499.7 ofthe Government Code ofthe State of California, and replaced with a Warranty Bond to guarantee the completed work for a one-year period following acceptance; and WHEREAS, Sorrento at Dublin Ranch I, LP, has provided Warranty Bonds to guarantee the Central Parkway and Brannigan Street improvements for a one-year period; and WHEREAS, the remaining improvements for Tract 7641 are more than 80% complete; and WHEREAS, the Performance Bond, and the Labor and Materials Bond can be partially released, in accordance with the authority contained in 966499.7 of the Government Code of the State of California, NOW, THEREFORE, BE IT RESOLVED that: 1. The Central Parkway and Brannigan Street improvements completed with said project are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by Fidelity and Deposit Company of Maryland in the amount of $580,000 for the Central Parkway improvements (Bond No. 08824010) be released; and 3. The original Labor and Materials Bond issued by Fidelity and Deposit Company of Maryland in the amount of $580,000 for the Central Parkway improvements (Bond No. 08824010) be released; and 1 /D-2,07 15 ATTACllHDT I. fl1Jt 4. The submitted Warranty Bond issued by Fidelity and Deposit Company of Maryland in the amount of $145,000 for the Central Parkway improvements (Bond No. 08824010M) be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 2nd day of October, 2008. 5. The original Labor and Materials Bond issued by Arch Insurance Company in the amount of $2,874,000 for the tract improvements (Bond No. SU5018923) be reduced to an amount of $643,000; and 6. The original Performance Bond issued by Arch Insurance Company in the amount of $2,874,000 for the tract improvements (Bond No. SU5018923) be reduced to an amount of $643,000; and 7. The submitted Warranty Bond issued by Arch Insurance Company in the amount of $76,000 for the Brannigan Street improvements (Bond No. SU5018923A) be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 2nd day of October, 2008. 8. The regulatory traffic control devices installed as part of the Central Parkway and Brannigan Street improvements are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) Traffic signal control at the intersection of Brannigan Street/Gleason Drive and Brannigan Street/Central Parkway. b) No parking on the west side of Brannigan Street between Central Parkway and Gleason Drive c) No parking on the east side of Brannigan Street for 150 feet north of Central Parkway and for 150 feet south of Gleason Drive d) Traffic signal control at the intersections of Central Parkway/Grafton Street and Central Parkway/Monta1cino Street . e) No parking on the north side of Central Parkway for 300 feet east of Brannigan Street, Monta1cino Street, Grafton Street and Keegan Street. PASSED, APPROVED AND ADOPTED this 2nd day of October, 2007. YES: NOES: ABSENT: ABSTAIN: ATTEST: Janet Lockhart, Mayor City Clerk G:\DEVELOPMENT, PRIV A TE\Dublin Ranch\Sorrento\Tract 7641-Sorrento West\Reso acpt Central & Brannigan imps,doc 2 3t1 RESOLUTION NO. - 07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* APPROVING PARTIAL RELEASE OF SECURITY FOR GRAFTON STREET, CENTRAL PARKWAY TO GLEASON DRIVE WHEREAS, The Lin Family and Sierra Land Development Corporation and the City of Dublin, entered into an Improvement Agreement for Grafton Street from Central Parkway to Gleason Drive dated June 1,2004, Resolution 86-04, to construct said roadway improvements in accordance with plans on file with the City Engineer; and WHEREAS, The Lin Family and Sierra Land Development Corporation assigned to Sorrento at Dublin Ranch I LP, a California Limited Partnership, all rights and obligations to said Agreement as of April 1, 2005; and WHEREAS, the roadway improvements associated Grafton Street from Central Parkway to Gleason Drive are more than 80% complete; and WHEREAS, the Performance Bond, and the Labor and Materials Bond can be partially released, in accordance with the authority contained in 966499.7 of the Government Code of the State of California, NOW, THEREFORE, BE IT RESOLVED that: 1. The Labor and Materials Bond issued by Safeco Insurance Company of America in the amount of $1,171,000 for roadway improvements (Bond No. 6321873) be reduced to an amount of $293,000; and 2. The Performance Bond issued by Safeco Insurance Company of America in the amount of $1,171,000 for the roadway improvements (Bond No. 6321873) be reduced to an amount of$293,000. PASSED, APPROVED AND ADOPTED this 2nd day of October, 2007.
