FINANCIAL STATEMENT: North Valley Construction, Inc., has provided a warranty bond (Bond No. M908194) in the amount of $40,000.00 to guarantee against any defects in the storm drain line improvements for one- year. DESCRIPTION: North Valley Construction, Inc., contractor for the Lin Family, was issued Grading/Sitework Permit No. 8-24 by the City of Dublin. This Permit covered the construction of storm drain line improvements on the Lin Family property in Dublin Ranch, Area B (Parcels 1 & 2, Parcel Map 8734), in accordance with the plans entitled, Grading and Storm Drain Plan, Area B Drainage Channel, Dublin Ranch, prepared by MacKay & Somps, and approved by the City Engineer on September 9, 2008. The Storm Drain Line Improvements in Dublin Ranch, Area B include an approximately 800-foot-long storm drain line connecting the southern end of the Streambed Corridor to the storm drain line in Dublin Boulevard. The Streambed Corridor is an environmental mitigation measure required by the U.S. Army Corps of Engineers for the Dublin Ranch project. The storm drain line was designed and constructed to City standards to eventually become a public storm drain line. At the time the Grading/Sitework Permit was issued, the timing for the dedication of the storm drain easement and City acceptance of this storm drain line was undetermined; thus, an Improvement Agreement for these improvements was not executed COPY TO: James Tong Page 1 of 2 L ITEM NO. • 3 c.. The Lin Family has recently provided Grant Deeds for the Storm Drain Easements, which will be accepted by the City via separate instrument. Since the storm drain line improvements are complete, including an access road for maintenance, it is now appropriate for the City to accept these improvements. A Performance Bond in the amount of $163,000.00 (Bond No. M906850 issued by Fidelity Pacific Insurance Company) was provided by North Valley Construction, Inc., with the Grading/Sitework Permit for the improvements. The Performance Bond can now be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Warranty Bond to guarantee the completed work for aone-year period following acceptance. North Valley Construction, Inc., has provided a Warranty Bond in the amount of $40,000.00 (Bond No. M908194 issued by Fidelity Pacific Insurance Company) to guarantee the storm drain improvements against defects for one year. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution accepting Storm Drain Line Improvements in Dublin Ranch, Area B. U Q BOULEVARD ~ l~~ ..,~~~, oho _~ i Q O ~~P , o , ~..~ ~P ~ ~~~~ z °¢ U O PROJECT J SITE W ~l rte] ~~J ~~lrJ~~l ~ ~ LOCATION MAP I~u No scare w a~3 RESOLUTION NO. - 09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS FOR STORM DRAIN LINE IN DUBLIN RANCH, AREA B WHEREAS, North Valley Construction, Inc., was issued a Grading/Sitework Permit to construct storm drain improvements on the Lin Family property in Dublin Ranch, Area B (Parcels 1 & 2, Parcel Map 8734), in accordance with plans entitled, Grading and Storm Drain Plan, Area B Drainage Channel, Dublin Ranch, prepared by MacKay & Somps, approved by the City Engineer on September 9, 2008; and WHEREAS, improvements associated with the Area B Drainage Channel included approximately 800 linear feet of public underground storm drain improvements, which are now complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the Lin Family has executed Easement Grant Deeds to the City of Dublin for said public Storm Drain Improvements; and WHEREAS, the Performance Bond can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Warranty Bond to guarantee the completed work for aone-year period following acceptance; and WHEREAS, North Valley Construction, Inc., has provided a Warranty Bond to guarantee the completed work for aone-year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The said storm drain improvements completed with said project are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by Fidelity Pacific Insurance Company, (Bond No. M906850) in the amount of $163,000.00 be released; and 3. The submitted Warranty Bond issued by Fidelity Pacific Insurance Company, (Bond No. M908194) in the amount of $40,000.00 be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 17th day of March, 2010.
