Report Prepared by: Melissa Morton, Public Works Director ! 1 '1/ I .. 1) 2) Resolution Vicinity Map Adopt the Resolution accepting the street improvements for Tract 7138, Dublin Ranch Area A, Neighborhood A-3, and approving the regulatory traffic control devices. Toll CA II, L.P. (Toll Brothers, Inc.), has provided a Maintenance Bond in the amount of $149,022.50 (Bond No. 104564078) to replace the Performance and Labor and Materials Bonds that guaranteed the improvements. The Maintenance Bond will guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs for the City-maintained street improvements. Street light maintenance costs will be paid by the Street Lighting Maintenance Assessment District 99-1. DESCRIPTION: Toll CA II, L.P., recently completed on-site street improvements associated with Tract 7138, Dublin Ranch Area A, Neighborhood A-3, a subdivision located in the Eastern Dublin Specific Plan area west of Signal Hill Drive, south of Tract 713 7, and east of the Dublin Ranch Golf Course. This work was governed by two separate Tract Improvement Agreements: 1) for street improvements executed on February 3, 2004, via City Council Resolution No. 16-04, and 2) landscaping for Tracts 7137, 7138, 7139 and 7140, Neighborhoods A-2, A-3, A-4 and A5, executed on May 6,2003, via City Council Resolution No. 75-03. ------------------------------------------------------------------------------------------------------------- COPY TO: Jon Paynter, Toll CA II, L. Since the street improvements have been constructed pursuant to the Tract Improvement Agreement and to the satisfaction of the Public Works Director, it is appropriate for these improvements to now be accepted by the City for permanent maintenance. The remaining work governed by the landscape agreement is being accepted under a separate item on this agenda. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Stop control devices have been installed on the easterly approach of Innisbrook Way at Signal Hill Drive, on the easterly approach of West Sugar Hill Terrace at Signal Hill Drive, on the southerly approach of Blairmore Place at West Sugar Hill Terrace, on the southerly approach of Hazeltine Lane at West Sugar Hill Terrace, and on the westerly approach of Hazeltine Lane at Eaglebrook Terrace (Traffic Code Section 6.16.020). At the time the City and Toll CA II, L.P. executed the Tract Improvement Agreement for the street, grading and utility improvements, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of $506,090.00, for street improvements, and a Performance Bond and a Labor and Materials Bond, each in the amount of $90,000.00, for off-site storm drain improvements, for a total amount of $596,090.00 to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in S66499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $149,022.50 for improvements, which is 25% ofthe original Performance Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the street improvements for Tract 7138, Dublin Ranch Area A, Neighborhood A - 3, and approving the regulatory traffic control devices. Page 2 of2 1&1..3 RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS FOR TRACT 7138 (DUBLIN RANCH AREA A, NEIGHBORHOOD A-3) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 7138, filed on March 1, 2004, in Book 275 of Maps at Pages 4 - 8, previously entered into two Tract Improvement Agreements with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: a) Subdivider: b) Tract Location: Toll CA II, L.P., A California Limited Partnership West of Signal Hill Drive, south of Tract 7137, and east of Dublin Ranch Golf Course 83 Single-Family Lots No. 16-04, City of Dublin City Council Blairmore Place, Eaglebrook Terrace, Hazeltine Lane, Innisbrook Way, and West Sugar Hill Terrace c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: WHEREAS, the Street Improvements associated with Tract 7138 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the Landscaping Improvements governed by the remaining Tract Improvement Agreement are also complete and will be accepted separately; and WHEREAS, the developer has installed certain regulatory traffic control devices as a part of the Tract improvements; and WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that guaranteed the Street Improvements can be released, in accordance with the authority contained in S66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103938731) in the amount of$506,090.00 be released; and 4. The original Labor and Material Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103938731) in the amount of $506,090.00 be released; and 5. The original Performance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103964606) in the amount of $90,000.00 be released; and 6. The original Labor and Material Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103964606) in the amount of $90,000.00 be released; and 7. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of America in the amount of$149,022.50 (Bond No. 104564078) be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 19th day of September, 2007.
