Authorizing the Filing of a Grant Application for Federal Surface
Transportation Program and Congestion Mitigation and Air Quality
Improvement Program Funding for the City's Street Resurfacing
Project

FINANCIAL STATEMENT:
If the City of Dublin' s Federal grant application is approved, the
City will receive $345,000 to fund the City's 2000-2001 Street
Resurfacing project. The City will be required to provide 11.5%
local match ($45,000) to construct the project.
DESCRIPTION: Staff has submitted to the Alameda County Congestion Management
Agency for preliminary funding consideration the City's Street Resurfacing project under the Federal
Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program. The
next step is to submit the grant application to the Metropolitan Transportation Commission wherein a
resolution authorizing the filing of a grant application is required.
The Street Resurfacing project is part of the City's Annual Street Overlay Program that provides the
placement of a 1-½ inch asphalt overlay on streets that show major structural failures. The candidate
streets are based on the priorities set up by the City's Pavement Management System, which rates the
pavement condition of city streets.
If the City receives this grant, funds in the amount of $345,000 will be available in fiscal year 2000-2001,
with the condition that the funds must be obligated by September 30, 2002. Staff intends to construct the
street Overlay project in Spring 2001.
Staff recommends that the City Council adopt the Resolution directing Staff to apply for funding from the
Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL SURFACE
TRANSPORTATION PROGRAM AND CONGESTION MITIGATION AND AIR
QUALITY IMPROVEMENT PROGRAM FUNDING FOR THE CITY'S STREET
RESURFACING PROJECT AND STATING THE ASSURANCE OF THE CITY OF
DUBLIN TO COMPLETE THE PROJECT
WHEREAS, the Transportation Equity Act for the 21 st Century (TEA 21) (Public Law
105-178, June 9, 1998) and the TEA 21 .Restoration Act (Public Law 105-206, July 22, 1998)
continue the Surface Transportation Program (STP) S.C. § 133 and the Congestion Mitigation
and Air Quality Improvement Program (CMAQ) (23 U.S.C. § 149); and
WHEREAS, pursuant to TEA 21, and the regulations promulgated thereunder, eligible
project sponsors wishing to receive STP or CMAQ grants for a project shall submit an
'application first with the appropriate metropolitan transportation planning organization (MPO),
for review and inclusion in the MPO's Transportation Improvement Program (TIP); and
WHEREAS, the Metropolitan Transportation Commission is the MPO for the San
Francisco Bay region; and
WHEREAS, the City of Dublin is an eligible project sponsor for STP or CMAQ
Improvement Program funds; and
WHEREAS, the City of Dublin wishes to submit a grant application to MTC for funds
from the STP or CMAQ Improvement Program in fiscal year 2000-2001 for the following
project:
Resurfacing of Various City Streets with a total project cost of $390,000.
WHEREAS, MTC requires, as part of the application, a resolution stating the following:
1) the commitment of necessary local matching funds of least 11.5%; and
2)
that the sponsor understands that the Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program funding is fixed at
the programmed amount, and therefore any cost increase cannot be expected to be
funded with Surface Transportation Program or Congestion Mitigation and Air
Quality Improvement Program funds; and
3)
the assurance of the sponsor to complete the project as described in the
application, and if approved, as programmed in MTC's TIP.
4)
That the sponsor understands that funds must be obligated by September 30,
2002, or the project may be removed from the program.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Dublin that
the City Manager is authorized to execute and file an application for funding under the Surface
Transportation Program or the Congestion Mitigation and Air Quality Improvement Program of
TEA 21 in the amount of $345,000 for the resurfacing of various City streets; and
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City of Dublin by
adopting this resolution does hereby state that:
1) The City of Dublin will provide $45,000 (11.5 %) in local matching funds; and
2)
The City of Dublin understands that the Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program funding for the
project is fixed at $345,000, and that any cost increases must be funded by the
City of Dublin from local matching funds, and that the City of Dublin does not
expect any cost increases to be funded with Surface Transportation Program or the
Congestion Mitigation and Air Quality Improvement Program funds; and
3)
The City Street ResurfaCing Project will be built as described in this resolution
and, if approved, as programmed in Metropolitan Transportation Commission
(MTC) Transportation Improvement Program (TIP).
4) The program funds are expected to be obligated by September 30, 2002.
NOW, THEREFORE, BE IT FURTHER RESOLVED that a copy of this resolution will
be transmitted to the MTC in conjunction with the filing of the application; and
NOW, THEREFORE, BE IT FURTHER RESOLVED that the MTC is requested to
support the application for the project described in the resolution and to program the project, if
approved, in MTC's TIP.
