f'JiAdOPt the Resolution accepting the improvements associated with
Tract 7597
Braddock and Logan Group III, L. P., has provided a Maintenance
Bond in the amount of $93,000.00 (Bond No. 2171474M) to replace
the Performance and Labor and Materials Bonds that guaranteed
the improvements. The Maintenance Bond will guarantee against
defects for one year. The Starward homeowners will maintain the
interior private streets and landscaping. Once these improvements
have been accepted, the City will incur street light maintenance costs
on Starward Drive.
DESCRIPTION: Braddock and Logan Group III, L. P., recently completed site
improvements associated with Tract 7597, Starward Row. Tract 7597 is a residential development of
10 single-family detached homes located on Starward Drive just north Amador Valley Boulevard. The
improvements consist of sidewalk, street lights and landscaping along Starward Drive. The work
is governed by an improvement agreement executed on May 16, 2006 via City Council Resolution No.
59-06.
The developer and the contractor have now completed the work governed by the agreement. Since the
improvements have been constructed pursuant to the improvement agreement and to the satisfaction of the
Public Works Director, it is appropriate for the public improvements to now be accepted by the City for
permanent maintenance.

At the time the City and the Braddock and Logan Group III, L. P., executed the improvement agreement
for site improvements, the developer provided a Performance Bond and a Labor and Materials Bond, each
in the amount of $372,000.00, for improvements to guarantee performance of the work. Now that the
work is complete, the bonds may be released in accordance with the authority contained in ~66499.7 of
the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the
work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the
amount of $93,000.00, which is 25% of the original Performance Bond, and which is sufficient to
guarantee the improvements for a one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the improvements for Parcel Map
7597.

ACCEPTANCE OF IMPROVEMENTS ASSOCIATED WITH TRACT 7597
(BRADDOCK AND LOGAN GROUP III, L. P.)
WHEREAS, the developer of Tract 7597, filed June 27, 2006, in Book 291 for Parcel Maps at
Pages 45-46, previously entered into an Improvement Agreement with the City of Dublin to improve said
Parcel in accordance with plans and specifications on file with the Public Works Director, said Parcel
identified as follows:

WHEREAS, the Street Improvements associated with Tract 7597 are complete in accordance with
said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public
Works Director; and
WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that
guaranteed the Improvements can be released, in accordance with the authority contained in ~66499.7 of
the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the
completed work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed within said Tract are hereby approved and accepted subject
to a one-year guarantee period; and
2. The original Performance Bond issued by Insurance Company of the West (Bond No.
2171474) for improvements in the amount of by $372,000.00 be released; and
3. The original Labor and Materials Bond issued by Insurance Company of the West (Bond
No. 2171474) for improvements in the amount of by $372,000.00 be released; and
4. The submitted Maintenance Bond issued by Insurance Company of the West in the amount
of $93,000.00 (Bond No. 2171474M) be accepted as security for the aforesaid one-year
maintenance period, said period to commence on this date and terminate on the 17th day of
July, 2008.
