Dublin Ranch, Area "H"

Adopt Resolution Accepting Improvements for Storm Drain Line
"B" in Dublin Ranch, Area "H"
The Lin Family, through the Sierra Land Development Corporation,
has provided a Maintenance Bond in the amount of $121,000 to
guarantee against any defects in the Storm Drain Line "B"
improvements. Once accepted, the City will incur maintenance
costs for City drainage improvements.
DESCRIPTION: On October 7, 2003, the Lin Family entered into an agreement with
the City to construct a 96" storm drain line across Dublin Ranch Area "H" between Dublin Boulevard and
1-580. The storm drain line originates in Area G and extends southerly through Area H to Caltrans' triple
box culvert at 1-580 in order to take storm waters under the freeway to channels in Pleasanton.
All of the drainage improvements have now been constructed pursuant to the Improvement Agreement
and to the satisfaction of the City Engineer. An easement has been granted by the Lin Family to the City
for the storm drain improvements. It is now appropriate for these improvements to be accepted by the
'City for permanent maintenance.
Sierra Land Development Corporation provided a Performance Bond and a Labor and Materials Bond,
each in the amount of $485,700, to guarantee performance of the work. Now that the work is complete,
these bonds may be released in accordance with authority contained in §66499.7 of the Government Code
and replaced with a Maintenance Bond to guarantee the work for a one-year period following acceptance.
The developer has provided a Maintenance Bond in the amount of $121,000, which is sufficient to
guarantee the improvements for a one-year period.
Staff recommends that the City Council adopt the resolution aCcepting the Storm Drain Line "B"
improvements in Dublin Ranch, Area "H".

RESOLUTION NO. - 03
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN'
ACCEPTANCE OF IMPROVEMENTS FOR STORM DRAIN LINE "B"
IN DUBLIN RANCH, AREA "H"
WHEREAS, the Lin Family entered into an Improvement Agreement on October 7, 2003, with
the City of Dublin to construct storm drain improvements in Dublin Ranch, Area "H", in accordance with
the plans entitled, Dublin Ranch Area H-Grading and Storm Drain Improvements, Phase 1, prepared by
MacKay & Somps, approved by the City Engineer on August 12, 2003, and consisting of 7 sheets; and
WHEREAS, the improvements associated with the Area H Storm Drain Line "B" are complete in
accordance with said plans, and any approved modifications thereto, to the satisfaction of the City
Engineer; and
WHEREAS, the Lin Family has executed an Easement Grant Deed to the City of Dublin for
Storm Drain Line" '"

WHEREAS, the Performance Bond and Labor and Materials Bond can be released, in accordance
with the authority contained in §66499.7 of the Government Code of the State of California, and replaced
with .a Maintenance Bond to guarantee the completed work for a one-year period following acceptance;
and
WHEREAS, the Lin Family has provided a Maintenance BOnd to guarantee the completed work
for a one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
'The improvements completed with said project are hereby approved and accepted subject
to a one-year guarantee period; and
The original Performance Bond issued by Insco Insurance Services, Inc., (BOnd No.
553986S) in the amount of $485,700.00 be released; and
o
The original Labor and Materials Bond issued by Insco Insurance Services, Inc., (Bond No.
553986S) in the amount of $485,700.00 be released; and
The submitted Maintenance Bond issued by Insco Insurance Services, Inc., (Bond No.
553986S) in the amount of $121,000.00 be accepted as security for the aforesaid one-year
maintenance period, said period to commence on this date and terminate on the 2nd day of
December, 2004.
PASSED, APPROVED AND ADOPTED this 2nd day of December, 2003.
