FINANCIAL STATEMENT:
A maintenance bond in the amount of $27,630.00 will be provided
to the City to guarantee against defects for landscaping and other
improvements.
Street lighting maintenance costs for public street lighting on
Hacienda Drive and Central Parkway will be paid by the Citywide
Street Light Maintenance Assessment District. Maintenance of
street-side landscaping along Hacienda Drive and Central Parkway
will be paid by the Landscape Maintenance District.
DESCRIPTION: This project, known as the Jefferson Apartments, is located on the
southeast comer of Hacienda Drive and Summer Glen Drive and consists of 368 apartments plus common
areas. On-site and off-site improvements have been inspected by the City Engineer and determined to be
complete.
At the time the City and the developer executed the contract for the AparUnent improvements, the
developer was required to provide performance and labor and materials bonds to provide the necessary
security for performance of the work. These bonds were in the amount of $1,485,980.00 for on-site
improvements, and $110,520.00 for off-site improvements. As the work is now complete, and in
accordance with the authority contained in Section 66499.7 of the Government Code, the performance
security requirement can be reduced to an amount necessary to guarantee maintenance of the work for a
one-year period following acceptance of the work. The developer will provide a new maintenance bond
in the amount of $27,630.00 for landscaping and other improvements.

When the irrigation was installed for landscaping fronting the development on Hacienda Drive and
Central Parkway, the design did not take into consideration that the street-side landscaping would be
included in the landscaping assessment district. To avoid the costly re-installation of the irrigation with
separate meters, the developer has forwarded a letter (Attachment 3) signed by all of the owners of the
development committing to paying for the water that will be used for this irrigation.
Staff recommends that Council adopt the Resolution accepting the completed improvements, and
authorize Staff to accept a maintenance bond in the amount of $27,630.00 to be submitted by the
developer at a future date.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS FOR JEFFERSON APARTMENTS
WHEREAS, the owner-subdivider of the aforesaid Project previously entered into a contract with the
City of Dublin to improve said Project in accordance with plans and specifications on file with the City
Engineer, said Project identified as follows:

WHEREAS, said improvements have been completed in accordance with said plans and
specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City
of Dublin; and
WHEREAS, as a condition of said project, subdivider is required to guarantee the improvements and
to maintain the completed work for a period of one year following acceptance of the work by the said City of
Dublin;
WHEREAS, as improvements are now completed, the original performance bond security
requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the
Government Code of the State of California, to an amount found necessary to guarantee maintenance of the
completed work for the aforesaid one-year period.
NOW, THEREFORE, BE IT RESOLVED that:
The improvements completed within the said Project be, and they are hereby approved and
accepted subject to the aforesaid one-year guarantee; and
The said original performance bonds in the amounts of $1,485,980 and $110,520 posted in
connection with the work involved in the construction of said Project be released upon
acceptance of said maintenance bond in the amount of $27,630.
PASSED, APPROVED AND ADOPTED this 17th day of April, 2001.

Re: Landscape Maintenance, Emerald Park Apartments '
The undersigned are the owners of the Emerald Park Apartments in undivided interests.
In order to eliminate the cost of revising the constructed irrigation system and installing a
separate water meter from the private site irrigation system, we agree to irrigate the
landscape (public right-of-way) within parkway areas of Hacienda Drive and Central
Parkway as shown on the attached exhibit and to pay for the water in the public right-of-
~vay.
