Vacation for Public Utility and Emergency Vehicle Access Easements. Adopt resolution accepting replacement Grant of Easement for Public Utilities together with a Grant of Easement for Emergency Vehicle Access FINANCIAL STATEMENT: No financial impact to the City will result from the recommended action. DESCRIPTION: The Public Utility and Emergency Vehicle Access Easements to be vacated and replaced were originally dedicated on Tract Map 6308 across Lots 152 and C as part of the Hansen Hill subdivision. The easements provided a utility corridor and emergency vehicle access route through the side yard of Lot 152 and across the open space parcel (Lot C) to connect the cul-de-sac bulb on Bloomfield Terrace to Inspiration Circle. In October of 1999, the Hansen Hill developer, Warmington Homes, processed Lot Line Adjustment L-99-06 to adjust the lot lines of Lots 152, 153 and C. Although the lot lines were adjusted by this lot line adjustment, the easement boundaries that coincided with the original lot lines were not adjusted. As a result, the easements now inappropriately encumber triangular slivers of land COPIES TO: Guiseppe & Janice Simone (Lot 152) Gugen & Vibhuti Chadha (Lot 153) Hansen Ranch Owners Assoc. (Lot C) Warmington Homes ITEM NO. G:\DEVELOP\Hansen HillXagst lots 152-153 easement abandon.doe 4.4 across the from comer of Lot 152 and across the rear comer of Lot 153. In addition, the'easements no longer precisely follow the utility alignments and access route location across Lot C. The Summary Vacation of the Public Utility and Emergency Vehicle Access Easements will extinguish the original easements in their entirety, thus eliminating the inappropriate encumbrances across Lots 152 and 153. A replacement Grant of Easement. for Public Utilities, together with a Grant of Easement for Emergency Vehicle Access, will then be filed to replace the extinguished easement. The boundaries of the replacement easement will coincide with the new lot lines for Lots 152, 153, and Lot C, thus encumbering only the open space parcel controlled by the Hansen Ranch Owners Association. Staff recommends that the City Council adopt the ResolutiOn approving the Summary Vacation of Public Utility and Emergency Vehicle Access Easements, and authorize the Mayor to sign each of the three Easement Quitclaim Deeds. Staff further recommends that the City Council adopt the Resolution accepting the replacement Grant of Easement for Public Utilities, together with a Grant of Easement for Emergency Vehicle Access, and authorize the Mayor to sign the Certificate of Acceptance. Page 2 RESOLUTION NO. - O1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN SUMMARILY VACATING A PUBLIC UTILITY EASEMENT AND EMERGENCY VEHICLE ACCESS EASEMENT ORIGINALLY DEDICATED ON TRACT MAP 6308 (HANSEN HILL) AFFECTING LOTS 152, 153, AND LOT C (STREETS AND HIGHWAYS CODE CHAPTER 4) WHEREAS, a Public Utility Easement and an EmergenCy Vehicle Access Easement were dedicated to the City on Tract Map 6308, recorded with the Alameda County Recorder on June 27, 1997, in Book 233 of Maps pages 32-39 (Series No. 97-160582), which encumbered an area across Lots 152 and C; and WHEREAS, this Public Utility Easement and Emergency Vehicle Access Easement, which are proposed to be vacated as described on the three separate Easement Quitclaim Deeds attached hereto, have been determined to be no longer necessary; and WHEREAS, a replacement Grant of Easement for Public Utilities together with a Grant of Easement for Emergency Vehicle Access will be granted by the Hansen Ranch Owners Association across Lot C; and WHEREAS} after considering the City's General Plan, the City Council finds that the General Plan does not apply to these easements and therefore these easements are not inconsistent therewith; and WHEREAS, it is to the benefit of the City to vacate said Public Utility Easement and Emergency Vehicle Access Easement as provided in Chapter 4 of the Streets and Highways Code. NOW, THEREFORE, BE IT RESOLVED that the existing Public Utility Easement and Emergency Vehicle Access Easement, as more particularly described on the three separate Easement Quitclaim Deeds attached hereto, are no longer necessary, and are hereby vacated. BE IT FURTHER RESOLVED that the City Council hereby directs and authorizes the Mayor to execute' each of the three separate Easement Quitclaim Deeds. BE IT FURTHER RESOLVED that the City Clerk is directed to forward the executed Quitclaim Deeds along with a certified copy of this Resolution to the County Recorder for recording. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk g:develop\hansen hillXreso lots 152-153 easement abandon RESOLUTION NO. - 01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING A GRANT OF PUBLIC UTILITY EASEMENT, TOGETHER WITH A GRANT OF EMERGENCY VEHICLE ACCESS EASEMENT GRANTED BY THE HANSEN RANCH OWNERS ASSOCIATION ACROSS LOT C OF TRACT 6308, SUBSEQUENTLY DESCRIBED AS PARCEL A OF LOT LINE ADJUSTMENT L'-99-06 WHERAS, a Public Utility Easement and an Emergency Vehicle Access Easement were dedicated to the City on Tract Map 6308, recorded with the Alameda County Recorder on June 27, 1997, in Book 233 of Maps pages 32-39 (Series No. 97-160582), which encumbered an area across Lots 152 and C; and WHERAS, the City Council has, by separate resolution, quitclaimed these original easements in their entirety; and WHEREAS, the Hansen Ranch Owners Association, a California non-profit mutual benefit corporation, has granted the City of Dublin a replacement Grant of Public Utility Easement together with a Grant of Emergency Vehicle Access Easement across Lot C, subsequently described as Parcel A on Lot Line Adjustment L-99-06 recorded with the Alameda County Recorder on October 6, 1999, as Series No. 99-378485; and WHEREAS, Section 27281 of the California Government Code (CGC) requires that deeds or grants conveying any interest in or easement upon real estate to a governmental agency for public purposes must meet specific requirements; and WHEREAS, the requirements include evidence of a Certificate of Acceptance attached to the deed or grant prior to recordation. NOW, THEREFORE, BE IT RESOLVED that the Grant of Public Utility Easement togeiher with a Grant of Emergency Vehicle Access Easement, and accompanying legal description and plat attached hereto, is hereby accepted. BE IT FURTHER RESOLVED that the City Council hereby directs and authorizes the Mayor to execute the Certificate of Acceptance.
