FINANCIAL STATEMENT:
Adopt the Resolution accepting the Quarry Lane School Offsite
Tassajara Road Improvements and Approving Regulatory Traffic
Control Devices.
Vila Construction, which constructed the improvements for Quarry
Lane School, has provided a Warranty Bond in the amount of
$275,000.00 (Bond No. 103321322M) to replace the Performance
and Labor and Materials Bonds that guaranteed the improvements.
The Warranty Bond will guarantee against defects for one year.
Once these improvements have been accepted, the City will incur
maintenance and street sweeping costs.
DESCRIPTION: Quarry Lane School recently completed offsite improvements to
Tassajara Road along the school frontage. Improvements included pavement reconstruction and widening,
curb and gutter, sidewalk, landscaping, undergrounding of overhead utility lines, and installation of a
traffic signal at the school driveway. The work was governed by an Improvement Agreement executed on
September 20, 2005 via City Council Resolution No. 183-05.
The school has completed the work governed by the agreement. Since the improvements have been
constructed pursuant to the Improvement Agreement and to the satisfaction of
the Public Works Director, it is appropriate for the improvements to now be accepted by the City for
permanent maintenance.

At the time the City and Quarry Lane School executed the Improvement Agreement, the developer
provided a Performance Bond and a Labor and Materials Bond, each in the amount of $1, I 00,000.00 for
the improvements. Now that the work is complete, the bonds may be released in accordance with the
authority contained in 966499.7 of the Government Code, and replaced with a Warranty Bond in an
amount necessary to guarantee the work for a one-year period following acceptance. The school has
provided a Warranty Bond of $275,000.00, which is 25% of the original Performance Bond, and which is
sufficient to guarantee the improvements for a one-year period after acceptance.
Staffrecommends that the City Council adopt the Resolution accepting the Quarry Lane Offsite Tassajara
Road Improvements and Approving Regulatory Traffic Control Devices.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTANCE OF THE QUARRY LANE SCHOOL
OFFSITE TASSAJARA ROAD IMPROVEMENTS AND
APPROVAL OF REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the developer, Dr. Sabri Arac and Vila Construction, previously entered into an
Improvement Agreement with the City of Dublin to install roadway frontage improvements on Tassajara
Road at the Quarry Lane School, including a traffic signal, in accordance with improvement plans and
specifications on file with the Public Works Director, and
WHEREAS, the Improvements are complete in accordance with said plans and specifications, and
any approved modifications thereto, to the satisfaction of the Public Works Director; and
WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the
Improvements can be released, in accordance with the authority contained in 966499.7 of the Government
Code of the State of California, and will be replaced with a Warranty Bond to guarantee the completed
work for a one-year period following acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. The Quarry Lane School Off site Tassajara Road Improvements are hereby approved and
accepted subject to a one-year guarantee period; and
2. The original Performance Bond issued by St. Paul Fire and Marine Insurance Company III
the amount of$I,IOO,OOO (Bond No. 103321322) be released; and
3. The original Labor and Materials Bond issued by St. Paul Fire and Marine Insurance
Company in the amount of$1,100,000 (Bond No. 103321322) be released; and
4. The submitted Warranty Bond cash security issued by Travelers Casualty and Surety
Company of America in the amount of $275,000.00 (Bond No. 103321322M) be accepted
as security for the aforesaid one-year maintenance period, said period to commence on this
date and terminate on the 4th day of March, 2009.
5. The regulatory traffic control devices installed as part of the Quarry Lane School Off site
Tassajara Road Improvements are herby included in the City of Dublin Traffic Code, said
regulatory devices to include the following:
a) Traffic signal control at the intersection of Tassajara Road and the Quarry Lane
School Driveway.
