HomeMy WebLinkAboutItem 4.04 TraffifSignal Tr7252 CITY CLERK AGENDA STATEMENT CITY COUNCIL MEETING DATE: January 20, 2004 SUBJECT: Acceptance of Traffic Signal Improvements at Fallon Road/Kingsmill Terrace/Signal Hill Drive and Fallon Road/Tumberry Drive associated with Tract 7252, Dublin Ranch, Area A (Toll CA II, LP) Report Prepared by: Melissa Morton, Acting Public Works Director ATTACHMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION: Adopt Resolution accepting traffic signal improvements at the intersections ofFallon Road/Kingsmill Terrace/Signal Hill Drive  - ~ ~"~- and Fallon Road/Tumberry Drive associated with Tract 7252, Dublin Ranch, Area A FINANCIAL STATEMENT: Toll CA II, LP, has provided a Maintenance Bond in the amount of $79,750 to replace the Performance Bond and Labor and Materials Bond that guaranteed the traffic signal improvements. This Maintenance Bond will warranty the work for one year following acceptance. The City's maintenance obligation for the signals will begin immediately upon acceptance. DESCRIPTION: On December 4, 2001, the City Council authorized the Mayor via Resolution No. 206-01 to execute three (3) separate Tract Developer Agreements with Toll CA II, LP, for improvements associated with.Dublin Ranch, Area A (Tract 7252), to govern the following: 1) Street improvements for the extension of Fallon Road north of Antone Way, and Signal Hill Drive along the frontage of the Dublin Ranch Golf Course Clubhouse and Recreation Facility 2) Traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and Tumberry Drive 3) Fallon Road Landscaping These three Tract Developer Agreements were previously amended via City Council Resolution No. 225-02, extending the completion date until December 3, 2003. Of these three Agreements, the developer has now completed work governed by one: Traffic Signals on Fallon Road at the intersections of Fallon Road/Kingsmill Terrace/Signal Hill Drive and Fallon Road/Turnberry Drive. The work governed by the remaining two agreements is currently underway and nearing completion. COPIES TO: H. Jon Paynter, Toll Brothers 1% ~ ITEM NO. ~ G:~DEVELOP\Dublin Ranch~Area A\Tract 7252~Agstacpt_TS fallon tumb~xy signal hill.doc The two traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and at Turnberry Drive have been constructed pursuant to the applicable Tract Developer Agreement and to the satisfaction of the City Engineer, and should now be accepted by the City for permanent maintenance. The remaining work associated with Tract 7252 will continue to be governed by the two Tract Developer Agreements until said work is deemed complete and accepted. At the time the City and Toll CA II, LP, executed the Tract Developer Agreement governing the two traffic signals on Fallon Road, the developer provided a Performance Bond in the amount of $319,000 and a Labor and Materials Bond in the amount of $319,000 to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code. The developer has provided a Maintenance Bond in the amount of $79,750, which is sufficient to warranty the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the traffic signal improvements at the intersections of Fallon Road/Kingsmill Terrace/Signal Hill Drive and Fallon Road/Turnberry Drive associated with Tract 7252, Dublin Ranch, Area A. Page 2 RESOLUTION NO. - 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF TRAFFIC SIGNAL IMPROVEMENTS AT THE INTERSECTIONS OF FALLON ROAD/KINGSMILL TERRACE/SIGNAL HILL DRIVE AND FALLON ROAD/TURNBERRY DRIVE FOR TRACT 7252 (DUBLIN RANCH, AREA A) WHEREAS, the developer of Tract 7252, filed on March 22, 2002, in Book 263 of Maps at Pages 63 - 68, previously entered into three (3) Tract Developer Agreements with the City of Dublin to improve said TraCt in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: a) Developer:' Toll CA II, LP b) Tract Location: Fallon Road north of Antone Way c) Tract Size: 10 bulk parcels for subsequent subdivision as Dublin Ranch, Neighborhoods A-1 through A-5 plus various golf course parcels d) Resolution Approving Agreement: No. 206-01 as amended by No. 225-02, Dublin City Council e) City Streets Affected: Fallon Road, Signal Hill Drive WHEREAS, the three agreements govern the folloWing improvements: 1) Street improvements for the extension of Fallon Road north of Antone Way, and Signal Hill Drive along the frontage of the Dublin Ranch Golf Course Clubhouse and Recreation Facility; 2) Traffic signals on Fallon Road at Kingsmill Terrace/Signal Hill Drive and Tumberry Drive; 3) Fallon Road Landscaping; and WHEREAS, the traffic signals at the intersections of Fallon Road/Kingsmill Terrace/Signal Hill Drive and Fallon Road/Turnberry Drive, governed by one of the three Tract Developer Agreements for Tract 7252, are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the work governed bY the remaining two Tract Developer Agreements is currently underway and nearing completion; and WHEREAS, the original Performance Bond and Labor and Materials Bond associated with the two completed traffic signals on Fallon Road can be released in accordance with the authority contained in §66499.7 of the Government Code of the State of California; NOW, THEREFORE, BE IT RESOLVED that: 1. The traffic signals at the intersections of Fallon Road/Kingsmill Terrace/Signal Hill Drive and Fallon Road/Tumberry Drive completed within said Tract are hereby approved and accepted; and 2. The original Performance Bond issued by The Continental Insurance Company (Bond No. 929208180) in the amount of $319,000.00 be released; and 3. The original Labor and Materials Bond issued by The Continental Insurance Company (Bond No. 929208180) in the amount of $319,000.00 be released; and 4. The submitted Maintenance Bond issued by National Fire Insurance Company of Hartford in the amount of $79,750 (Bond No. 929309385) be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 20th day of January, 2005. PASSED, APPROVED AND ADOPTED this 20th day of January, 2004.
