RECOMMENDATION: Staff recommends that the City Council adopt the attached Resolution

FINANCIAL
STATEMENT:
The salaries set forth in the Resolution for the City Manager and City
Attorney reflect the compensation set forth in the respective agreements
between the City and the City Manager and City Attorney's law firm.
DESCRIPTION: Included in the City's personnel system are resolutions that address salary ranges
for part-time and full-time personnel. The attached Resolution is a proposed amendment to the City
Salary Plan (Attachment 1) for management personnel. The Resolution also identifies positions that are
exempt from the Federal Labor Standards Act (FLSA) overtime provision and those that are not. The
Salary Plan Resolution (Attachment 2) would establish a monthly salary range for the position of City
Manager as $16,388.33, effective February 7,2006.
The Salary Plan Resolution (Attachment 2) would also establish a monthly salary range for the positions
of City Attorney. The City Attorney's law firm is retained pursuant to a contract, which provides for an
hourly rate for all legal services performed. Section 5 of that contract acknowledges that the City
Attorney is eligible for and has elected membership in the Public Employee's Retirement System. Section
5 also provides that the City will make its employer contributions to PERS based on compensation of a
specified amount. That amount was $4,120 per month as of July 1, 1998 and, with annual adjustments to
such amount, as provided in Section 5, based on annual changes in the Consumer Price Index (Urban
Wage Earners for San Francisco-Oakland-San Jose), the amount is $5,078 per month, effective July 1,
2005. The Salary Plan Resolution (Attachment 2) would thus establish a monthly salary range for the
positions of City Attorney as $5,078, effective July 1, 2005, to be adjusted each July 1 by the change in
the Consumer Price Index (Urban Wage Earners for San Francisco-Oakland-San Jose), using the month of
February to determine the change.

ESTABLISHING A SALARY PLAN FOR MANAGEMENT POSITIONS
EXEMPT FROM COMPETITIVE SERVICE
WHEREAS, the City Council has adopted a Salary & Benefit Plan pursuant to the Personnel System
Rules; and
WHEREAS, the City Council adopted Resolution No. 86-01 and subsequent lIIIlendments which
establish a Salary Plan for full-time management positions exempt from competitive service in accordance
with the City's Personnel System Rules; and
NOW, THEREFORE, BE IT RESOLVED that the following salary provisions shall be established in
accordance with City's Personnel System Rules.
BE IT FURTHER RESOLVED that any previous enacted salary provisions contained in Resolution
No. 86-01 and subsequent amendments shall be superseded by this Resolution.
ARTICLE 1: SALARY PROVISIONS
REGULAR EMPLOYEES EXEMPT FROM FAIR LABOR STANDARDS ACT (FLSA) OVERTIME
PROVISIONS
Employees covered under this Section shall be paid a monthly salary within the following ranges with the
exclusion of any perfonnance Pay Adjustment granted in accordance with the Personnel System Rules. In the
event that it is deemed by the City Manager to be in the best interest of the City, temporary appointments of
no more than 6 months, where the work assignments are such that they can be completed with Jess than a 40
hour work week, may be approved based upon the hourly rates. The total salary paid for such work shall not
be less than the "salary test" required for an exemption under the FLSA.

AMENDING THE SALARY PLAN
WHEREAS, in accordance with the City's Personnel System Rules, the City Council adopted
Resolution No. 64-97 and subsequent Resolutions which comprise the Salary Plan.
NOW, THEREFORE, BE IT RESOLVED that the positions of City Manager and City Attorney
shall be covered under Article I, respectively, to be added to the Salary Plan, to read as follows:
City Manager:
$16,388.33 (flat rate)
As long as the City Attorney is a member of the Public Employee's Retirement System (PERS),
the monthly compensation ofthe City Attorney for purposes of the City's employer contribution to PERS
shall be as follows:
City Attorney:
$5,078.00 (flat rate)
BE IT FURTHER RESOLVED that this document shall become a part ofthe official Salary Plan
for the City of Dublin; and that the changes contained herein shall be effective as noted.
