FINANCIAL STATEMENT: Toll CA II, L.P. (Toll Brothers, Inc.), has provided a Maintenance Bond in the amount of $131,056.75 (Bond No. 104564077) to replace the Performance and Labor and Materials Bonds that guaranteed the improvements. The Maintenance Bond will guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs for City-maintained street improvements. Street light maintenance costs will be paid by the Street Lighting Maintenance Assessment District 99-1. DESCRIPTION: Toll CA II, L.P., recently completed street improvements associated with Tract 7140, Dublin Ranch Area A, Neighborhood A-5, a subdivision located in the Eastern Dublin Specific Plan area east of Signal Hill Drive, south of Tract 7139, and west of the Dublin Ranch Golf Course. This work was governed by two separate Tract Improvement Agreements: 1) for street improvements executed on May 6, 2003, via City Council Resolution No. 73-03, and 2) landscaping for Tracts 7137, 7138, 7139 and 7140, Neighborhoods A-2, A-3, A-4 and A5, executed on May 6,2003, via City Council Resolution No. 75-03. The developer has completed the work governed by both of these agreements. Since the street improvements have been constructed pursuant to the Tract Improvement Agreement and to the COPY TO: Jon Paynter, Toll CA II, L. P. The remaining work covered by the landscape agreement is being accepted under a separate item on this agenda. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Stop control devices have been installed on the westerly approach of East Castle Pines Terrace at Signal Hill Drive, on the southerly approach of Sable Oaks Way at Signal Hill Drive, and on the northerly approach of Sable Oaks Way at East Castle Pines Terrace (Traffic Code Section 6.16.020). At the time the City and Toll CA II, L.P., executed the Tract Improvement Agreement for the street, grading and utility improvements, the developer provided Performance and Labor and Materials Bonds, each in the amount of $524,227.00, to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in 966499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $131,050.75, which is 25% of the original Performance Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the street improvements for Tract 7140, Dublin Ranch Area A, Neighborhood A-5, and approving the regulatory traffic control devices. Page 2 of2 / of 3 RESOLUTION NO. - 06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS FOR TRACT 7140 (DUBLIN RANCH AREA A, NEIGHBORHOOD A-5) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 7140, filed on July 11, 2003, in Book 271 of Maps at Pages 40 - 43, previously entered into two Tract Improvement Agreements with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: a) Subdivider: b) Tract Location: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: Toll CA II, L.P., A California Limited Partnership East of Signal Hill Drive, south of Tract 7139, and west of Dublin Ranch Golf Course 62 Single-Family Lots No. 73-03, City of Dublin City Council East Castle Pines Terrace, Sable Oaks Way and East Sugar Hill Terrace WHEREAS, the Street Improvements associated with Tract 7140 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the Landscaping Improvements governed by the remaining Tract Improvement Agreement are also complete and will be accepted separately; and WHEREAS, the developer has installed certain regulatory traffic control devices as part of the Tract improvements; and WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that guaranteed the Street Improvements can be released, in accordance with the authority contained in 966499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Labor and Material Bond issued by Travelers Casualty and Surety Company of America (Bond No. 103938730) in the amount of $524,227.00 be released; and 5. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of America in the amount of$131,056.75 (Bond No. 104564077) be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 19th day of September, 2007.
