FINANCIAL STATEMENT:
Adopt the Resolution accepting the Fallon Road Offsite Backbone
Utilities for Tract 7586, Fallon Village (Braddock and Logan).
Braddock and Logan has provided a warranty bond (Bond No. 220
97 73M) issued by Insurance Company of the West in the amount
of $298,750 to guarantee the improvements associated with this
work for one year. The City will incur ongoing maintenance costs
for these improvements.
DESCRIPTION: Dublin RE Investors, LLC (Braddock and Logan), entered into an
improvement agreement with the City of Dublin on June 5, 2007, for the construction of storm drain and
sewer improvements located in Fallon Road between 1-580 and Positano Parkway. These improvements
are needed to serve the Positano development within Fallon Village, Tract 7586.
Dublin RE Investors, LLC, provided a performance bond and a labor and materials bond, each in the
amount of $1,195,000 (Insurance Company of the West, Bond No. 220 97 73), to guarantee construction
of the improvements. The improvements are now complete and the bonds may be released. Dublin RE
Investors, LLC, has provided a warranty bond in the amount of 25% of the original bond ($298,750) by
Insurance Company of the West (Bond No. 22097 73M).
Staff recommends that the City Council adopt the resolution accepting the Fallon Road offsite backbone
utilities for Tract 7586, Fallon Village (Braddock and Logan).

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTANCE OF FALLON ROAD OFFSITE BACKBONE UTILITIES FOR TRACT 7586
(BRADDOCK AND LOGAN)
WHEREAS, Dublin RE Investors, LLC, the developer of Tract 7586, previously entered into an
Improvement Agreement dated June 5, 2007, Resolution No. 76-07, with the City of Dublin, to complete
Fallon Road Offsite Backbone Utilities in accordance with plans on file with the City Engineer; and
WHEREAS, the developer provided a performance bond and a labor and materials bond, each in
the amount of$1,195,000, to guarantee the installation of these improvements; and
WHEREAS, the improvements are complete in accordance with said plans, and any approved
modifications thereto, to the satisfaction ofthe City Engineer, and
WHEREAS, the performance bond and labor and materials bond can be released, in accordance
with the authority contained in Section 66499.7 of the Government Code of the State of California, and
replaced with a warranty bond to guarantee the completed work for a one-year period; and
WHEREAS, Dublin RE Investors, LLC, has provided a warranty bond to guarantee the
improvements for a one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The Fallon Road Offsite Backbone Utilities for Tract 7586 are hereby approved and
accepted subject to a one-year guarantee period.
2. The original Performance Bond issued by Insurance Company of the West (Bond No. 220
9773) in the amount of$1,195,000 be released.
3. The original Labor and Material Bond issued by Insurance Company of the West (Bond
No. 2209773) in the amount of$1,195,000 be released.
