I Q~ G IDFYFLOPMENT PR1VATCIlKEAlAgslactp_7714 do, Since the developer and the contractor have completed the work governed by the Improvement Agreement and to the satisfaction of the Public Works Director, it is appropriate for the improvements to now be accepted by the City for permanent maintenance. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. "No Parking Anytime" traffic control devices have been installed on both sides of Arnold Road between Dublin Boulevard and future Altamirano Avenue/I-580 B. "No Parking Anytime" traffic control devices have been installed on both sides of Martinelli Way between Arnold Road and Hacienda Drive At the time the City and IKEA Property, Inc. (IKEA), and Pepper Construction Company executed the Improvement Agreement for the street improvements, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of $4,229,000.00, for improvements to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in S66499. 7 of the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the work for a one-year period following acceptance. The developer and the contractor have provided a Maintenance Bond in the amount of $1,057,250.00, which is 25% of the original Performance Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the street improvements for Parcel Map 7714 off-site improvements for Arnold Road between Dublin Boulevard and future Altamirano Avenue/I-580, and for Martinelli Way between Arnold Road and Hacienda Drive, and approving the regulatory traffic control devices. Page 2 of2 /1J '3 RESOLUTION NO. - 07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS ASSOCIATED WITH PARCEL MAP 7714 OFF-SITE IMPROVEMENTS FOR ARNOLD ROAD AND MARTINELLI WAY AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES (IKEA PROPERTY, INC.) WHEREAS, the developer of Parcel Map 7714, filed August 1,2001, in Book 260 for Parcel Maps at Pages 30-33, previously entered into an Improvement Agreement with the City of Dublin to improve said Parcel in accordance with plans and specifications on file with the Public Works Director, said Parcel identified as follows: a) Subdivider: b) Parcel Location: c) Parcel Size: d) Resolution Approving Agreement: e) City Streets Affected: IKEA Property, Inc., A Delaware Corporation West of Hacienda Drive, north ofl-580 Public Streets No. 142-05, City of Dublin City Council Arnold Road and Martinelli Way WHEREAS, the Street Improvements associated with Parcel Map 7714 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the developer has installed certain regulatory traffic control devices as part of the Parcel Map improvements; and WHEREAS, the original improvement Performance Bond and Labor and Materials Bond that guaranteed the Street Improvements can be released, in accordance with the authority contained in 966499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Parcel Map 7714 are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) "No Parking Anytime" traffic control devices have been installed on both sides of Arnold Road between Dublin Boulevard and future Altamirano Avenue/I-580 b) "No Parking Anytime" traffic control devices have been installed on both sides of Martinelli Way between Arnold Road and Hacienda Drive 5-/5-07 t..j..~ I. 1 ATTAunUT ~1Y 3. The original Performance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 104121601) for improvements in the amount of $4,229,000.00 be released; and 4. The original Labor and Material Bond issued by Travelers Casualty and Surety Company of America (Bond No. 104121601) for improvements in the amount of $4,229,000.00 be released; and 5. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of America in the amount of$I,057,250.00 (Bond No. 104121601M) be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 15th day of May, 2008.
