DESCRIPTION: On May 1, 2007 the City Council awarded a contract to M.A.K.
Associates, Inc. to complete the renovation of two play areas at Alamo Creek Park. Staff along with
representatives from M.A.K. Associates, Inc. completed a walkthrough on August 3, 2007. All elements
ofthe project were complete.
Upon City Council acceptance of the project and completion of punch list items, Staffwill file a notice of
completion with Alameda County Clerk. The City will release the 10% retention thirty-five days
subsequent to recording the notice of completion with Alameda County.
RECOMMENDATION: It is the recommendation of Staff that the City Council take the
following action:
1) Accept the final facility improvements; and
2) Adopt Resolution accepting the completed facility improvements

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTING IMPROVEMENTS TO ALAMO CREEK PARK
CONTRACT NUMBER 07-04
WHEREAS, M.A.K Associates, Incorporated entered into a contract with the City of Dublin to
complete the renovation of the Alamo Creek Park Play Area in accordance with plans and specifications
on file with the City Engineer; and
WHEREAS, said improvements have been completed in accordance with said plans and
specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the
City of Dublin; and
WHEREAS, as a condition of said contract, M.A.K. Associates, Incorporated is required to
warranty the improvements for a period of one year following acceptance of the work by the said City of
Dublin.
NOW, THEREFORE BE IT RESOLVED that:
1. The improvements completed within the said Facility, are hereby approved and accepted
subject to the aforesaid one-year warranty; and
2. The said original performance bond posted in connection with the work involved in the
construction of said Facility be hereby released upon acceptance of said warranty.
PASSED, APPROVED AND ADOPTED this 21st day of August 2007.
