RECOMMENDATION: ~Adopt Resolution FINANCIAL STATEMENT: It is anticipated that the City will contract with the Alameda County Waste Management Authority (ACWMA) to act as lead agency in administering the grant. The City will allocate 95% of the grant to the ACWMA while 5% of the grant will be used to reimburse the City for the Management Assistant's time in providing administrative support to the program. DESCRIPTION: California state law requires local governments to establish a comprehensive management program for the Household Hazardous Waste Element (HHWE) as described in the California Integrated Waste Management Act, AB 939. As part of the HHWE, the City is required to initiate a program to deal with waste oil. In 1993, each jurisdiction in the County decided to satisfy this requirement by participating in the Alameda County Waste Management Authority Household Hazardous Waste Program. The County program consists of three drop-off centers, the nearest being in Livermore. Funding for the program comes from County landfill tipping fees and there is no charge to residents who deliver oil or other household hazardous waste to these facilities. In addition to this program, there are five local automotive businesses licensed to offer used oil disposal services in the City of Dublin. In addition to providing a method of disposal for household hazardous waste, the HHWE requires the City to engage in an active and ongoing public information campaign. As part of this requirement, the City H/cc-forms/agdastmt.doc COPIES TO: ITEM NO. must develop a media strategy to publicize the availability of drop-off facilities and to disseminate information to residents, businesses and schools. The California integrated Waste Management Board (CIWMB) issues annual Block Grants to local jurisdictions for the implementation and maintenance of used oil recycling programs. In 1993 the City of Dublin entered into a countywide agreement that designated the City of Oakland as lead agency in a cooperative project to promote oil recycling. The City's annual grant allocation has been given to the City of Oakland for the past three Fiscal Years (5t~ cycle). The City of Oakland recently informed each County jurisdiction that they do not wish to serve as lead agency for the cooperative used oil recycling program in Fiscal Years 2000-2003 (6t~ cycle). In order to continue the existing program, the ACWMA has agreed to act in a lead capacity for the 6th Cycle Used Oil Recycling Block Grant. The attached Resolution authorizes the City Manager to negotiate and execute an agreement with the ACWMA, subject to the review and approval of the City Attorney's Office. It is anticipated that the cooperative program will continue to Operate as it has during the 5th cycle. The City will continue to be involved as a member of the working group, which determines how the pooled money is to be spent. Past projects have included television advertising, bus and BART billboards, and radio and newspaper advertising. The program will continue to focus on public information and educational efforts, and not on collection services. Staff believes that a collective regional advertising campaign has been and will continue to be the most effective method of encouraging used oil recycling. A regional campaign is able to effectively utilize the mass media in a way that would not be possible, if the City attempted to undertake such a campaign of its own. In addition, participation in the regional campaign satisfies a portion of the City's duties under the HHWE, without any significant demands on staff time and no direct expense to the City. New requirements from the CIWMB, coupled with the potential new regional agreement, require the City to apply separately for the grant. In the past, the City has simply sent a letter to the CIWMB authorizing the allocation of the City's entire grant amount to the City of Oakland. The City is now required to pass a resolution authorizing submittal of the grant proposal and appropriation of grant funds. If the Council authorizes the grant submittal and the application is approved by the CIWMB, the City will receive $9,975 for Fiscal Year 2000-2001. If an agreement can be worked out with the ACWMA, it is anticipated that the City will then disperse 95% of the grant to the ACWMA upon receipt of an invoice. Staff recommends retaining 5% of the grant to cover the additional staff time dedicated to applying for the grant, participating in the regional working group and completing semi-annual program reports to the CIWMB. RECOMMENDATION: Staff recommends that the Council adopt the Resolution authorizing the submission of a grant application to the California Integrated Waste Management Board for the 6th Cycle Used Oil Recycling Block Grant and authorizing the City Manager to negotiate and execute an agreement with the ACWMA, subject to the review and approval of the City Attorney's Office, allocating 95% of the grant to a regional project administered by the ACMWA. RESOLUTION NO. - 2000 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN RESOLUTION AUTHORIZING SUBMITTAL OF A THREE YEAR USED OIL AND OIL FILTER RECYCLING GRANT TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD FOR $29,925 AND APPROPRIATING THE FUNDS WHEREAS, the people of the State of Califomia have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the California Integrated Waste Management Board (CIWMB) has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by cities and counties under the program; and WHEREAS, the City of Dublin (City) will enter into an agreement with the State of California for the development of the projects as specified in the grant application; and WHEREAS, procedures established by the CIWMB require the grant applicant to certify by resolution the approval of said application; and WHEREAS, the City will submit a grant application for the 6th Cycle Used Oil Recycling Block Grant (FY 2000-03) for used motor oil and oil filter collection and recycling services and public education activities by April 6, 2000; and WHEREAS, all jurisdictions in Alameda County are member agencies of the Alameda County Waste Management Authority (ACWMA), a regional Joint Powers Authority (JPA) that was formed for the purpose of, and having expertise in, recycling and solid waste project planning and implementation; and WHEREAS, the ACWMA is empowered to make and enter into contracts with its member agencies, including either to receive or provide services; and WHEREAS, the City, as a member of the JPA, would benefit from a regional effort led by the ACWMA to educate the public about used oil and oil filter recycling; and WHEREAS, the City and other Alameda County jurisdictions have agreed, but not committed, to provide a percentage of 6th Cycle Used Oil Recycling Block Grant funding to the ACWMA to provide regional used oil and oil filter recycling services; and WHEREAS, if the ACWMA and other Alameda County jurisdictions agree to implement regional used oil and oil filter recycling projects, the City agrees to designate and transfer 95% of its 6th Cycle Used Oil Recycling Block Grant funds to the ACWMA for the used oil and oil filter recycling regional projects; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves a grant application to be submitted to the CIWMB for an approximate amount of $29,925 for the 6th Cycle Used Oil Recycling Block Grant for used motor oil and oil filter collection and public education activities; and be it BE IT FURTHER RESOLVED that the City Manager or his/her designee is hereby authorized and empowered to execute in the name of the City all necessary applications, contracts, payments requests, agreements and amendments hereto, subject to the review and approval of the City Attorney's office, for the purpose of securing grant funds and to implement and carry out the purposes specified in the grant application provided that the contracts shall be reviewed and approved by the City Attorney's Office and shall be filed with the City Clerk's Office. Should additional funds be received, the City Manager or his designee is hereby authorized to appropriate same for the purpose described above; and, be it BE IT FURTHER RESOLVED that, should the ACWMA, other Alameda County jurisdictions and the City agree to implement regional used oil and oil filter recycling projects, the City Manager or his/her designee is authorized to negotiate and execute an agreement with the ACWMA, subject to the review and approval of the City Attorney's Office, that provides for 95% of the grant funds received from the CIWMB for the 6th Cycle Used Oil Recycling Block Grant be payable to ACWMA for providing regional used and filter recycling services; and be it BE IT FURTHER RESOLVED that the City Council authorizes the appropriation of grant funds and the increase in the City's estimated revenues upon execution of the agreement with the CIWMB.
