The garage will be maintained by the Dublin Ranch Villas Owners Association DESCRIPTION: Toll-Dublin, LLC, recently completed on-site grading improvements associated with Tract 7524, Neighborhood H-2 (Phase 2), Dublin Ranch Area G. Tract 7524 is located east of Tassajara Road, north of Dublin Boulevard, west of Keegan Street, and south of Maguire Way within the southeast comer of Area G of the Dublin Ranch Development. The work consisted of two levels of subterranean parking underlying 4-story buildings which are currently under construction. The work was governed by an Improvement Agreement executed on September 7, 2004 via City Council Resohition No. 172-04. The developer has completed the work governed by this agreement. Since the on-site grading improvements have been constructed pursuant to the Improvement Agreement and to the satisfaction of the Public Works Director, it is appropriate for the improvements to now be accepted by the City for permanent maintenance by the Dublin Ranch Villas Owners Association. At the time the City and Toll-Dublin, LLC, executed the Improvement Agreement, the developer provided Performance and Labor and Materials Bonds, each in the amount of $367,950.00 for site grading COPY TO: Jon Paynter, Toll-Dublin, LLC Page 1 of2 ITEM NO. tf" G:\DEVELOPMENT, PRIVATE\Dublin Ranch\Area'G\H2 - Tract 7524\Agstacpt~ading.doc improvements to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in ~66499.7 of the Government Code. Staff recommends that the City Council adopt the Resolution accepting the improvements for Tract 7524, Neighborhood H-2 (Phase 2), Dublin Ranch Area G. Page 2 of2 1~2> RESOLUTION NO. - 07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF GRADING IMPROVEMENTS FOR TRACT 7524 (NEIGHBORHOOD H-2, PHASE 2, DUBLIN RANCH AREA G,) WHEREAS, the subdivider of Tract 7524, filed on November 5, 2004, in Book 277 of Maps at Pages 95 - 97, previously entered into an Improvement Agreement with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: Toll-Dublin, LLC, a California Limited Partnership West of Keegan Street, south of Maguire Way and north of Dublin Boulevard 2 Lots, 626 Multi-Family Units No. 172-04, City of Dublin City Council None a) Subdivider: b) Tract Location: WHEREAS, the onsite Grading Improvements associated with Tract 7524 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the original improvement Performance Bonds and Labor and Materials Bonds that guaranteed the Street Improvements can be released, in accordance with the authority contained in ~66499.7 of the Government Code ofthe State of California; NOW, THEREFORE, BE IT RESOLVED that: 1. The grading improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by Safeco Insurance Company of America (Bond No. 6249457) in the amount of $367,950.00 for grading improvements be released; and 3. The original Labor and Materials Bond issued by Safeco Insurance Company of America (Bond No. 6249457) in the amount of $367,950.00 for grading improvements be released; and PASSED, APPROVED AND ADOPTED this 7th day of August, 2007.
