Braddock & Logan will be repaid by other Eastern Dublin Property Owners through the proposed Specific Plan Amendment process. No costs will be incurred by the City for the preparation of the Resource Management Plan. DESCRIPTION: This Request for Proposals will begin the process of soliciting and selecting a consultant to prepare a Resource Management Plan (RMP) for the 1,120-acre Eastern Dublin Properties area. As part of approving the annexation and prezoning of the project area, the City Council certified a Supplemental Environmental Impact Report (SEIR) on April 2, 2002 that contained several mitigation measures relating to future environmental and resource analysis to be done. The project area annexation received final approval by the Alameda County Local Agency Formation Commission (LAFCo) on July 11, 2002 and steps to implement the approved mitigation measures have begun. Specifically, the SEIR contains Mitigation Measure no. SM-BIO-1 that requires the preparation of a Resource Management Plan for the entire 1,120-acre property prior to submittal of any development proposal. The purpose of the Resource Management Plan is to address development impacts on biological and other resources across the entire project area (as opposed to addressing such impacts on a parcel-by- parcel basis). The preparation of the RMP addresses the City's responsibilities to analyze and mitigate environmental impacts in the Eastern Dublin Properties area pursuant to the California Environmental Quality Act (CEQA). The scope of work for the preparation of the Resource Management Plan includes the following key elements: G:\RMP for EDPO\R&'P\CC Staff Report RFP distribution. DOC COPIES TO: Property Owners In-House Distribution ITEM NO. ~~, Review and ensure the adequacy of existing maps, studies, plans, policies, and other resources of the City of Dublin and the landowners for the project area; Prepare additional maps, conduct additional studies, and gather additional resources as needed for the adequate preparation of the RMP; Prepare comprehensive physical and biological resource maps; Prepare constraints and opportunities maps that will guide the preparation of a more detailed land use plan for the area; Work collaboratively with the City and the landowners throughout the preparation of the Resource Management Plan; Coordinate with State and Federal permitting agencies; and Prepare draft and final versions of the Resource Management Plan. It is anticipated that the consultant work on the Resource Management Plan will begin in January 2003 and will conclude in January 2004. PROCESS: The Request for Proposals (RFP) has been prepared to solicit proposals from consultants that are highly skilled in the preparation of complex environmental documents. The RFP will be circulated on October 16, 2002 to consulting firms and proposals will be due to the City of Dublin on November 15, 2002. Once the consultants are ranked according to the responses and references checked, Staff will return to the City Council for the award of the contract. It is anticipated that the award of the contract will be at the January 7, 2003 City Council meeting. RECOMMENDATION: Staff recommends that the City Council authorize the distribution of the Request for Proposals (Attachment 1). The RMP is required pursuant to a mitigation measure adopted in the Supplemental Environmental Impact Report that was prepared in connection with the annexation and prezoning of this aggregation of 13 parcels. Backqround Dublin is an established community of approximately 33,250 people located at the intersection of Highways I~580 and 1-680 in eastern Alameda County. In 1993 the City approved the Eastern Dublin General Plan Amendment and Specific Plan (and an accompanying Environmental Impact Report), a comprehensive planning effort that established land use designations, densities and development patterns for Dublin's Eastern Extended Planning Area. In so doing, the City approved a development area and a rural residential area located outside of the then-existing City limit but within the City's Sphere of :Influence. This approval anticipated future annexation and prezoning of properties located within these areas. The Eastern Dublin Properties, consisting of 11 different ownerships of 13 contiguous parcels totaling 1,120 acres, subsequently requested annexation, prezoning and related approvals. Figure 1 shows the location of the property and Table I shows the parcel sizes and property owners. The City certified a Supplemental Environmental Impact Report (SE[R) and approved the annexation, prezoning and related approvals on April 2, 2002 and the annexation received final approval by the Alameda County Local Agency Formation Commission (LAFCo) on July 11, 2002. ' ~": : . :. ,~..~: : Eastern Dublin Properties Resource Management Plan Request for Proposals Page 5 of 11 October 15, 2002 The Supplemental Environmental :Impact Report contains Mitigation Measure no. SM-BIO-1 that requires the preparation of a Resource Management Plan (RMP) for the entire 1,120-acre property. The text of this Mitigation Measure is included as Attachment 1. The purpose of the RMP is to address impacts that were newly analyzed in the Supplemental EIR (SETR) to biological and other resources, and to address development impacts on biological and other resources across the entire 1,120 acre Project Area (as opposed to addressing such impacts on a parcel-by-parcel basis). The RMP must address the special status species and habitats identified in the Mitigation Measure, and must follow the format and meet the standards specified in the Mitigation Measure. The RMP must also apply and comply with all biological resource mitigation measures contained in the SE:IR and in the 1993 Eastern Dublin General Plan Amendment and Specific Plan ETR (copies of these measures are included as Attachments 2 and 3). The preparation of the RMP pursuant to the SETR further implements the City's responsibilities to analyze and mitigate environmental impacts in the Eastern Dublin Properties area pursuant to the California Environmental Quality Act (CEQA). Development of individual properties within the 1,120 acre Project Area will also likely trigger the need for a variety of permits from state and federal resource agencies, such as the California Department of Fish and Game (DFG), the Regional Water Quality Control Board (RWQCB), the U.S. Fish and Wildlife Service (FVVS), and the U.S. Army Corps of Engineers (USACOE). The City, in conjunction with the selected consultant, intends to work closely with these agencies during the preparation of the RMP, so that the RMP can ultimately facilitate these permitting processes. The landowners and their consultants will also participate in the planning and permitting process and in consultations with the agencies in order to ensure that the overall RMP process is effective, cohesive, and collaborative. Purpose and Role of the Resource Management Plan The purpose of the Resource Management Plan is to reduce the impacts of development in the Eastern Dublin Properties area to a less-than-significant level and to provide a long-term planning and resource stewardship framework for the Project Area as a whole. The RMP process is designed to provide detailed information on several items, including but not limited to, Project Area topography, hydrology, geology, and sensitive habitat, to develop a comprehensive plan for managing those resources, and to identify areas where development could be allowed as well as areas where development should be avoided. The Resource Management Plan is intended to provide an operational framework for resource enhancement and stewardship to mitigate impacts of future development on biological and related resources across the entire 1,120 acre Project Area, consistent with applicable regulatory requirements, and with the impact avoidance and minimization, mitigation and resource stewardship principles established in Mitigation Measure SM-BTO-1. The RMP will provide planning and operational guidance consistent with SM-B[O-1 for implementation through subsequent individual development projects in the Project Area. The RMP is not intended to establish any mandatory development restrictions or conditions. ]Instead, the RMP will identify a suite of flexible tools integrating resource protection with site planning and design. :It will be one tool, among many, to be used by City decision makers to evaluate future development in the Project Area. [t will also be a living, iterative document that can evolve over time to reflect new scientific information and new developments in biological resource management. Eastern Dublin Properties Resource IVlanagement Plan Request for Proposals Page 6 of 11 October 15, 2002 Scope of Work Requirements The City of Dublin desires to retain the services of a firm with experience and expertise in the areas of biological and physical resource analysis and permitting. Services required by the City include: Participate in a half-day orientation site tour conducted by the City and the landowners' consultants, who have performed extensive biological studies in the Project Area. Review the base maps and ortho-rectified aerial photographs for the entire Project Area that will be provided by the City. Extensive biological surveys have already been prepared by consultants contracted by the landowners. The name and status of all the studies are listed in Attachments 4 and 5. At this point the City is presuming that the existing studies are adequate for the purpose of providing necessary data regarding the occurrence of special status species and habitats. However, the selected consultant will peer review the reports resulting from the surveys done to date to ensure that proper protocol has been followed and that the study results and information can be used to prepare the Resource Management Plan. The consultant will be responsible for performing those biological resource studies which have not yet been done but which are required for the preparation of the RMP. The consultant will also need to perform any studies needed to replace any existing studies found during the peer review process described above to be inadequate for purposes of the RMP. The consultant will be responsible for integrating the results of the existing and newly performed biological resource studies described above by developing the following comprehensive maps: A. Vegetation and Specs'al-Status P/ant Mapping Using the vegetation and special-status plant surveys already completed and additional surveys to be performed by the consultant, the consultant will need to integrate the data and complete a map depicting the vegetation communities and special-status plant species present across the Project Area. B Specs'al-Status Wildlife Mapping Using the special-status wildlife surveys already completed and additional surveys to be performed by the consultant, the consultant will need to integrate the data and complete a map depicting all special-status wildlife species present across the Project Area. C. Wet/and Mapping Using wetland delineation information already completed and additional surveys to be performed by the consultant, the consultant will need to integrate mapping data for all wetlands and other jurisdictional waters across the Project Area to produce a comprehensive aquatic resources map. The City has existing studies and reports that describe the Hydrologic conditions (City of Dublin Master Drainage Study for Dublin Ranch), Geologic conditions (Assessments done on some properties), Engineering conditions (Slope analysis), and Cultural resource conditions (Cultural Resources Chapter from Eastern Dublin General Plan Amendment EIR and Specific Plan Studies) in the Project Area as they relate to potential development. (See Attachments 4 and 5 for a full list of available resources) The consultant will utilize these reports in developing the RMP. For studies required for the evaluation but not yet completed, the consultant will be responsible for conducting the studies. Examples of conditions and issues that will need to be addressed as part of these reports will include: Visual resources, including silhouetting above ridgelines; Locations and descriptions of local soil types and hydrology; Watershed boundaries contained within the properties; Channel/bank erosion constraints on greenway planning and other recreational uses; Identification of dominant physical processes controlling channel form and condition of seasonal creeks (with a focus on bank stability); and Eastern Dublin Properties Resource Management Plan Request for Proposals Page 8 of l! October 15, 2002 Quantifying and documenting on-site water supply/demand (for plant communities) and water budget conditions to evaluate the hydrologic sufficiency of any future ecosystem restoration/enhancement alternatives at the site. The consultant will be responsible for preparing a single report that presents the results of tasks number 3 through 7 as described above, including a narrative describing studies completed and resulting findings for each individual property. The consultant will be responsible for preparing the following: A. Constraints I~laps Utilizing existing data and studies to be conducted as needed by the consultant, the consultant is responsible for preparing four draft "constraint maps" of the Project Area that will address (a) biological resources (including wetland, botanical and wildlife resources), (b) geologic constraints, (c) cultural resources, utilities and easements, and (d) visual and ridgelands constraints. The "constraint maps" will show areas where there are significant constraints associated with sensitive habitats, special status species, geologic features, or other issues, including development limitations. B. Opportunities I~laps Utilizing existing data and future studies as needed, prepare a draft resource management and "opportunities maps". The "opportunities maps" can help to identify how the Stage ! Planned Development Land Use Map for the Project Area should be revised to reflect constraints and preservation/restoration priorities as identified in SM-B!O-1. The results of these maps could indicate environmentally optimal locations for: (1) Open space, greenways and resource protection areas, (2) Development of trails and greenways, (3) Non-structural storm water quality basins and related drainage facilities, and (4) Potential wetland enhancement/restoration. The purpose of the constraints and opportunities maps is to provide a conceptual guide for the future development of the Project Area. The consultant will identify and map mitigation areas for biological resources if necessary. The maps will identify candidate properties using data related to: 1) wetlands and riparian areas; 2) wildlife habitat areas, core and critical habitat for special-status species; 3) species distribution; 4) Assessor's Parcel Numbers; 5) ownership; and 6) acreage. Priority will be given to adjoining parcels with in- kind habitats needed for special status species. The consultant will be responsible for preparing an Administrative Draft RIVlp consistent with the requirements of Mitigation IVleasure SIVI-B:[0-1, The RMP shall include a constraints and opportunities analysis and other information as detailed in the steps listed above, The City, the selected consultant and the landowners will collaborate regarding reviewing the Eastern Dublin Properties Resource Management Plan Request for Proposals Page 9 of :[ :[ October :[5, 2002 conclusions of the studies and the priorities identified in Mitigation Measure SM-BIO-1. After opportunities for onsite avoidance and preservation have been thoroughly evaluated, off- site mitigation could be considered, keeping in mind that the Mitigation Measure specifically states that "to the greatest extent feasible, impacts to sensitive biological resources shall be avoided, and such resources shall be managed and preserved on-site." The Iong-term viability and sustainability of the natural resources on the preserved and mitigated lands, both om and off-site shall be protected and managed in perpetuity. Management efforts shall employ principles of adaptive management. FUnding for preservation, management and monitoring work shall be assured. The City and the landowners will review and provide comments on the Administrative Draft RMP. The selected consultant will review and consider such comments, then prepare a Draft RMP. This document will be provided to the City, the landowners, and representatives of the following state and federal resource agencies for review and comment: United States Environmental Protection Agency (USEPA), United States Army Corps of Engineers (USACOE), San Francisco Regional Water Quality Control Board (RWQCB), United States Fish and Wildlife Service (FVVS), California Department of Fish and Game (DFG), City of Dublin Fire Prevention Bureau, Dublin San Ramon Services District (DSRSD), Alameda County Flood Control and Water Conservation District (Zone 7), Alameda County Mosquito Vector Control District, and Other relevant agencies. The selected consultant will review and consider all comments received on the Draft RMP, then prepare a Final RMP. The RMP process will involve close coordination with the City, and with the landowners and their consultants to ensure necessary collaboration and technical accuracy. This will involve approximately two meetings per month between ~lanuary 2003 and January 2004. The selected consultant will share all information it develops with the City and the landowners as such information is available, and will review and consider all comments on such information provided by the City and the landowners. The City intends to involve local, state and federal resource agencies in the development of the RMP. The selected consultant will be expected to attend interagency coordination meetings to be conducted throughout the RMP process. City staff and the landowners will participate in these meetings. Based on the Scope of Services presented above, these meetings will likely be required at several key intervals in order to discuss critical issues. The selected consultant will take the lead in providing materials, including presentation graphics, for these meetings. Eastern Dublin Properties Resource Management Plan Request for Proposals Page 10 of 11 October 15, 2002 The selected consultant will be expected to attend up to three (3) meetings of the Dublin City Council over the course of the project to discuss progress. The last meeting would include a presentation of the Final RMP for adoption by the City Council, which is anticipated to take place in 3anuary 2004. Proposal Submittal Requirements Proposals shall include: 1) Cover letter, to include the name, address, phone number of all firms involved in the proposal. 2) Statement of project understanding and issues. 3) Scope of work, identifying interim and final products to be delivered to the City, methodology anticipated to be used to prepare work products and other information related to carrying out the City's desired program 4) Estimated budget, indicating specific staff anticipated to be assigned to the project, hourly rate and numbers of hours by phase and task. Other direct costs (travel, reproduction, meetings, etc.) should also be included. This could be presented in a spreadsheet format. City reserves the right to negotiate scope of work and budget to meet City requirements. 5) Estimated schedule for completion. 6) Summary of firm or firms presenting the proposal, including a background description of the firm, completion of similar projects (with client reference and phone number provided), listing of the project manager (with client references and phone numbers), and a listing of other staff anticipated to be assigned to the team. Resumes of key individuals should be attached. 7) Copies of work products are encouraged, although these should be submitted separately and a note included if these are to be returned to the firm. 8) An explanation, with detailed examples, of experience in working cooperatively and effectively with state and federal resource agencies on similar projects. .City Resources and Responsibilities The City of Dublin has on-hand and available to the consultant all of the resources, maps, and documents as described in Attachments 4 and 5. Pre-Submittal Meeting and Proposal Due Date To ensure maximum understanding of the City's needs, a pre-submittal bidder's conference will be held on Wednesday October 30, 2002, from 2:00-3:00 p.m. in the City of Dublin's Regional Meeting Room at 100 Civic Plaza in Dublin. Attendance at the meeting is mandatory to be able to submit a proposal. Five copies of the proposal are due at 5:00 p.m. on Friday November 15, 2002, to the following address, FAX or e-mail submittals are not accepted. Failure to submit a proposal by the due date will result in immediate disqualification. The following criteria will be used to judge each of the submittals: Qualifications, background and experience of the proposed project manager Experience of the firm in completing similar projects Demonstrated effectiveness at working with state and federal resource agencies Responsiveness of the proposal to City needs Comprehensiveness of the proposal in responding to the RFP Estimated fees and schedule of completion Based on the number of responses received, the City may either select a team or firm based on submittals, or schedule interviews of firms. The City anticipates conducting interviews during the week of December 2, 2002 and taking the contract(s) to the City Council for approval on January 7, 2003.
