RECOMMENDATIO~ Approve the Resolution opposing the Save Agriculture and Open Space Initiative (Attachment 1) and authorize the Mayor to sign the letter to Richard Schneider (Attachment 2). FINANCIAL STATEMENT: Undetermined at this time. DESCRIPTION: At the April 18th City Council meeting, the Council directed Staff to draft a resolution and letter to the major initiative proponents (Sierra Club) in opposition to the countywide "Save Agriculture and Open Space" initiative now collecting signatures for possible placement on an upcoming countywide election. The attached resolution and letter accomplish this direction. Copies would be sent to the Tri-Valley cities and affected parties. RECOMMENDATION: Staff recommends that the City Council adopt the resolution and instruct the Mayor to sign the attached letter. COPIES TO: In HouSe Distribution West Dublin Property Owners RESOLUTION NO. - 00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN OPPOSITION TO THE PROPOSED "SAVE AGRICULTURE AND OPEN SPACE" INITIATIVE WHEREAS, a proposed Initiative entitled "Save Agriculture and Open Space" regarding the establishment of an Alameda County Urban Growth Boundary (UGB) is being circulated for signatures to place the initiative on the Alameda County ballot in the near future; and WHEREAS, this initiative, if passed by the voters of Alameda county may affect the City of Dublin's ability to plan for and annex properties within the present City of Dublin's adopted Sphere of Influence as designated by the Alameda County Local Agency Formation Commission; and WHEREAS, the City of Dublin has an adopted General Plan which clearly identifies areas of urban development potential where orderly and logical growth can occur without major impacts to visually sensitive ridgelands, and open space areas within these sphere of influence areas; and WHEREAS, the City of Dublin has adopted an amendment to the General Plan committing the City to manage growth within the Eastern Extended Planning Area and has identified where development is expected to occur over the next 20 to 25 years; and WHEREAS, the voters of the City of Dublin in 1992, have supported the amendment to the Dublin General Plan for the Eastern Extended Planning area; and WHEREAS, the City supports an Alameda County UGB around the City of Dublin beyond the currently established sphere of influence boundaries for the City; and WHEREAS, the potential implementation of our General Plan designations and policies on some 2,972 acres of our adopted sphere of influence areas may be adversely impacted by the designation of these lands as agriculture or open space by the provisions of this proposed initiative; and WHEREAS, the more logical and reasonable approach to the establishment of UGB for areas around the City of Dublin should be based on the established sphere of influence area for the City; and WHEREAS, the City Council of the City of Dublin is in support of the direction now being completed by the Tri-Valley Vision Project and the efforts of the Tri-Valley Business Council to develop a UGB based on established City spheres of influence boundaries; and WHEREAS, the City Council carefully reviewed this issue at the April 18, 2000 Council meeting NOW, THEREFORE, BE IT RESOLVED THAT the Dublin City Council does hereby find that: 1. The City of Dublin is in Opposition to the proposed Alameda County's "Save Agriculture and Open Space" Initiative now being circulated for signatures. ATTACHMENT 1 Any Alameda County Urban Growth Boundary definitions related to the City of Dublin should be based on areas outside the adopted Sphere of Influence areas for the City. BE IT FURTHER RESOLVED THAT THE Dublin City Council hereby authorizes the Mayor to sign the attached letter to the main proponent of the proposed initiative along with this resolution, and to forward copies to the cities and agencies noted. Dublin California 94568 April 21, 2000 Richard Schneider Bay Area Chapter Conservation Chairperson Sierra Club 6867 Wilton Drive Oakland, CA 94611 Re: Proposed Save Agriculture and Open Space Lands Initiative Dear Mr. Schneider: The City Council of the City of Dublin has carefully reviewed the proposed "Save Agriculture and Open Space Lands" Initiative, which is now collecting signatures county wide for possible placement on the ballot. The attached Resolution passed unanimously at out April 18th meeting confirms the City's opposition to this proposed Initiative. It is imperative that cities in Alameda County plan according to their adopted General Plans, including those-areas which have been designated by the Alameda County Local Agency Formation Commission as within the sphere of influence of the respective city. By election in 1992, the voters of the City of Dublin have supported the General Plan area for Eastern Dublin. As a result, Dublin has consistently included our sphere of influence areas both East and West of our City limits as an integral part of the future development of our community. While the City of Dublin supports the notion of an Urban Growth Boundary (UGB) surrounding the City, a much more logical UGB would be to follow legally established sphere of influence lines that reflect the General Plan policies and physical boundaries that now exist in the Dublin General Plan. This initiative would include some 2,972 acres of our adopted sphere of influence within the UGB as identified by this proposed initiative. The City implementation of future land uses and annexations within this area may be adversely impacted by the designation of these lands as agricultural or open space by the County UGB. The continued viability of some areas within our sphere of influence properties for permanent agriculture and open space is in doubt according to our General Plan. The City Council is in support of the direction now being completed by the Tri- Valley Vision Project and the efforts of the Tri-Valley Business Council. Their UGB proposals based on adopted City sphere of influence boundaries respect the long- range plans of those cities, including Dublin. This is the appropriate direction for this issue. The resolution attached clearly states the position of the City of Dublin in this regard. The City of Dublin will not support this proposed initiative.
