FINANCIAL STATEMENT: The Fiscal Year 2004-2005 Budget includes $62,500 for technical
support for the "Computers For Our Schools Project." Budget Fund:

DESCRIPTION: The Dublin Unified School District has requested that the City allocate up to
$62,500 for computer technical support under the "Computers For Our Schools Project." The $62,500
funding was proposed, based on the number of computers that the Dublin Unified School District has
received over the past Fiscal Years under the Project. This year the School District has agreed to fund
one-half of the technical support monies required. As presented by the Superintendent's letter
(Attachment 1), the technical support funds will be used to insure uninterrupted access to students that
benefited from the computer matching grant program.
Because the funding of computer technical support is an operational expense a separate Agreement
between the City and the Dublin Unified School District is required(Attachment 2).
RECOMMENDATION: Consistent with the adopted Budget, Staff recommends that the City Council
authorize the City Manager to execute the Agreement with the Dublin Unified School District for funding
computer technical support under the"Computers For Our Schools Project"for Fiscal Year 2004-2005.

Dear Rich:
As you are aware, the City Council has generously supported the "Computer for our
Schools" project over a five-year period. Four years ago, the Council supported the
maintenance of the student computers that were added to the school district's network
by providing $100,000 in additional funds. These funds were used to hire PC
technicians to insure that all of the computers purchased with project funds were
operational for student use. Three years ago, the council generously increased the
allocation to $125,000 as we phased out the computer matching grant program.
Respectfully I am requesting that the City continue to provide support for maintaining
the computers purchased with the matching grant program in the coming 2004/05 fiscal
year in the amount of $62,500, one half of the amount we have received the past two
years. The PC technicians were proposed for funding from the parcel tax measure that
failed in the past week. As you are aware, K-12 public education took a significant
reduction in funding these past two years, and is slated to once again face reductions in
the upcoming fiscal year.
I recognize that city governments will also be affected by the state budget crisis. As the
City Council considers its budget for next year, I hope that the council can consider our
request for next year. We very much want to insure that students who are benefiting
tremendously from the computers purchased by the matching grant program continue
to have uninterrupted access.
The council's consideration of our request is deeply appreciated at a time when funding
from the State of California for next fiscal year will be significantly reduced. Please
express the appreciation of the Board of Trustees to the Council for their continued
support of public education in Dublin.

REGARDING FUNDING FOR COMPUTER TECHNICAL SUPPORT
THIS AGREEMENT is entered into this 20th day of July, 2004 by and between the City

of Dublin ( C f ), a municipal corporation, and the Dublin Unified School District ("DiStrict").
RECITALS
A. The education of the City's children benefits all residents of the City.
B. Although the District is responsible for the education of the children living within
the City, the City is authorized to take actions, which promote the general health, welfare, and
safety of the community at large.
C. Knowledge of, and ability to use, computers and related technology are fast
becoming necessary to function effectively in the workforce and in society in general.'
D. It is in the best interest of the community that children residing within the City
receive education and training in the many uses of computers and related technology, in that
well-trained and educated young people will become productive members of the community.
E. To provide the best possible education in the many uses of computers and related
technology, District needs to acquire computers and related technological devices and equipment
and to maintain that equipment to keep it in working order and extend its useful life.
F. To encourage the participation of the community at large to help the District
provide the best possible computer/technology education to its students, City authorized has over
the past years expended matching donations fi.om individuals, community groups/organizations,
and businesses to the District of computers or monetary contributions to be used for the purchase
of computers.
G. City has further authorized up to Sixty-Two Thousand Five Hundred Dollars
($62,500) for District to hire or contract with individuals to provide technical support and
maintenance of its computers and related equipment for Fiscal Year 2004-2005.
H. The purpose of this agreement is to assure that District students Will be able to
obtain the computer/technological education intended by the acquisition of the computers
discussed herein and by the careful maintenance of those computers and related equipment.
Now, therefore, the parties agree as follows:

Section 1. Funding for Technical Support by City
Upon receipt of invoice from District, City will contribute up to Sixty-Two Thousand
Five Hundred Dollars ($62,500) to District for technical support of the District's computers that
have been acquired through the "Computers For Our Schools Project." Payment shall be based
upon District's actual cost to maintain computers as described in Section 2 below.
Section 2. Use of Technical Support Funding by District
District will use the funds described in Section 1 to hire staffor independent contractors
who will provide technical support for computers and equipment acquired through the
"Computers For Our Schools Project."
District agrees to hire or contract with only competent individuals capable of providing
high-quality technical support services. District further agrees to manage the work of such
individuals to assure the quality of their services.
Section 3. Status of Technical Support Staff
Individuals receiving payment from District for technical support services shall be
employees or independent contractors of District. Such individuals shall not be employees or
independent contractors of City. City shall have no responsibility for any direct payment to such
technical support staff, including wages, benefits, workers' compensation, and any other
compensation.
Section 4. Miscellaneous
At the end of Fiscal Year 2004-2005, District shall provide City with an accounting of all
funding received from City under this Agreement.
District shall make available to City all records related to the receipt and expenditure of
funds provided by City pursuant to the Agreement.

The parties agree to cooperate in the execution of any additional documents,
may be required to carry out the terms of this agreement.

Effective Date of Agreement.
This Agreement shall become effective on July 20, 2004.
D. Term.
This Agreement shall be effective on the effective date and shall continue in effect
until through Fiscal Year 2004-2005.
E_ Law Governing.
This Agreement is made under the Constitution and laws of the State of
California.
F. Amendments.
All amendments to this Agreement must be in writing, and must be approved by
the parties prior to becoming effective.
G; Severabilit¥.
In the event any provision of this Agreement is determined to be illegal orinvalid
for any reason, all other provisions and articles of this Agreement shall remain in
full force and effect unless and until otherwise determined. The illegality of any
provision of this Agreement shall in no way affect the legality and enforceability
of any other provisions of this Agreement.
H. Successors.
This Agreement shall be binding upon and all inure to the benefit of the
successors of the City and District. Neither City nor District may assign any right
or obligation hereunder without written consent of the other.
