FINANCIAL STATEMENT: Sorrento at Dublin Ranch I, LP, has provided a warranty bond in the amount of $60,000 (Bond No. 6515583 by Safeco Insurance Company of America) to guarantee for one year against any defects in the traffic signal improvements at Grafton Street and Central Parkway. A warranty bond in the amount of $60,000 (Bond No. 08840690M by Fidelity and Deposit Company of Maryland) has been provided to guarantee for one year against any defects in the COPY TO: Steve Herndon, Toll Bros. The City will incur maintenance costs for the traffic signal improvements at these two intersections. In addition, the Performance Bond and Labor and Materials Bond for the Grafton Street Improvements (Bond No. 6321873 by Safeco Insurance Company of America) will be reduced to $260,000. The Performance Bond and Labor and Materials Bond (Bond No. 08840690 by Fidelity and Deposit Company of Maryland) for the Tract 6644 improvements will be reduced to $116,000. DESCRIPTION: On June 1,2004 (Resolution 86-04), the Lin Family and Sierra Land Development Corporation entered into an Improvement Agreement for construction of the Grafton Street improvements from Central Parkway to Gleason Drive. The Lin Family and Sierra Land Development Corporation assigned all rights and obligations for this Agreement to Sorrento at Dublin Ranch I, LP, a California Limited Partnership, as of April 1, 2005. The Grafton Street improvements include the Grafton Street and Central Parkway traffic signal, which is now complete. The remaining street improvements are more than 80% complete, and it is estimated that it will take approximately one year for completion of this project. The City will accept Grafton Street and Central Parkway traffic signal improvements prior to accepting the full improvements for Grafton Street from Central Parkway to Gleason Drive. Sorrento at Dublin Ranch I, LP, provided a Performance Bond, and a Labor and Materials Bond issued by Safeco Insurance Company of America in the amount of $1,171,000 for Grafton Street improvements (Bond No. 6321873). These bonds may now be reduced to $260,000 in accordance with the authority contained in 966499.7 of the Government Code. Sorrento at Dublin Ranch I, LP, has provided a one-year Warranty Bond issued by Safeco Insurance Company of America in the amount of $60,000 for the Grafton Street and Central Parkway traffic signal improvements (Bond No. 6515583). Sorrento at Dublin Ranch I, LP, will provide a Warranty Bond in the amount $260,000 at the time the City accepts the remaining improvements for Grafton Street from Central Parkway to Gleason Drive. Sorrento at Dublin Ranch I, LP, entered into a Tract Improvement Agreement with the City of Dublin to construct improvements required for Tract 7644 - Sorrento at Dublin Ranch, Neighborhood 3. The Tract 7644 improvements include the Montalcino Street and Central Parkway traffic signal, which is now complete. The remaining Tract 7644 improvements are more than 80% complete, and it is estimated that it will take approximately one year for completion of this project. The City will accept the Montalcino Street and Central Parkway traffic signal improvements prior to accepting the full Tract 7644 improvements. Sorrento at Dublin Ranch I, LP, provided a Performance Bond, and a Labor and Materials Bond issued by Fidelity and Deposit Company of Maryland in the amount of $794,000 for the Tract 7644 improvements (Bond No. 08840690). These bonds may now be reduced to $116,000 in accordance with the authority contained in 966499.7 of the Government Code. Sorrento at Dublin Ranch I, LP, has provided a one-year Warranty Bond issued by Fidelity and Deposit Company of Maryland in the amount of $60,000 for the Montalcino Street and Central Parkway traffic signal improvements (Bond No. 08840690M). Sorrento at Dublin Ranch I, LP, will provide a Warranty Bond in the amount $116,000 at the time the City accepts the remaining Tract 7644 improvements. Page 2 of3 Staff recommends that the City Council 1) Adopt the resolution Accepting Improvements and Approving the Regulatory Traffic Control Device for the Grafton Street and Central Parkway Traffic Signal; and 2) Adopt the resolution Accepting Improvements and Approving the Regulatory Traffic Control Device for the Montalcino Street and Central Parkway Traffic Signal, and Approving Partial Release of Security for Tract 7644, Sorrento at Dublin Ranch, Neighborhood 3. Page 3 of3 I t2~ If RESOLUTION NO. - 08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTING IMPROVEMENTS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICE FOR THE GRAFTON STREET AND CENTRAL P ARKW A Y TRAFFIC SIGNAL WHEREAS, The Lin Family and Sierra Land Development Corporation and the City of Dublin, entered into an Improvement Agreement for Grafton Street from Central Parkway to Gleason Drive dated June 1,2004, Resolution 86-04, to construct said roadway improvements in accordance with plans on file with the City Engineer; and WHEREAS, The Lin Family and Sierra Land Development Corporation assigned to Sorrento at Dublin Ranch I LP, a California Limited Partnership, all rights and obligations to said Agreement as of April 1, 2005; and WHEREAS, the roadway improvements associated with Grafton Street from Central Parkway to Gleason Drive are more than 80% complete and the Labor and Materials Bond and the Performance Bond issued by Safeco Insurance Company of America in the amount of$I,171,000 for roadway improvements (Bond No. 6321873) were reduced to an amount of $293,000 on October 2,2007, Resolution 178-07; and WHEREAS, the Grafton Street and Central Parkway traffic signal improvements are complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, Sorrento at Dublin Ranch I, LP, has provided a Warranty Bond to guarantee the Grafton Street and Central Parkway traffic signal improvements for a one-year period; and WHEREAS, the Performance Bond, and the Labor and Materials Bond can be partially released, in accordance with the authority contained in 966499.7 of the Government Code of the State of California, WHEREAS, the Grafton Street and Central Parkway traffic signal is a regulatory traffic control device; NOW, THEREFORE, BE IT RESOLVED that: 1. The Grafton Street and Central Parkway traffic signal improvements are hereby approved and accepted subject to a one-year guarantee period; and The submitted Warranty Bond issued by Safeco Insurance Company of America in the amount of $60,000 (Bond No. 6515583) for the Grafton Street and Central Parkway traffic signal improvements be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 17th day of June, 2009. YES: NOES: ABSENT: ABSTAIN: Janet Lockhart, Mayor ATTEST: City Clerk G:IDEVELOPMENT, PRIV ATEIDublin RanchlSorrentolGrafton StlReso accept signal Grafton-Centra1.doc 2 -;) J. 5' q RESOLUTION NO. - 08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTING IMPROVEMENTS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICE FOR THE MONTALCINO STREET AND CENTRAL P ARKW A Y TRAFFIC SIGNAL, AND PARTIAL RELEASE OF SECURITY FOR TRACT 7644, SORRENTO AT DUBLIN RANCH, NEIGHBORHOOD 3 WHEREAS, the subdivider of Tract 7644, Sorrento at Dublin Ranch I, LP, a California Limited Partnership, filed on August 24, 2006, in Book 291 of Maps at Pages 83-86, previously entered into a Tract Improvement Agreement with the City of Dublin dated August 1, 2006, Resolution 143-06, to improve said Tract in accordance with plans on file with the City Engineer; and WHEREAS, the Montalcino Street and Central Parkway traffic signal improvements, are complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the remammg improvements for Tract 7644 are more than 80% complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, Sorrento at Dublin Ranch I, LP, has provided a Warranty Bond to guarantee the Grafton Street and Central Parkway traffic signal improvements for a one-year period; and WHEREAS, the Performance Bond, and the Labor and Materials Bond can be partially released, in accordance with the authority contained in 966499.7 of the Government Code of the State of California; and WHEREAS, the Montalcino Street and Central Parkway traffic signal is a regulatory traffic control device; NOW, THEREFORE, BE IT RESOLVED that: 1. The Montalcino Street and Central Parkway traffic signal improvements installed as part of the Tract 7644 project are hereby approved and accepted subject to a one-year guarantee period; and 2. The submitted Warranty Bond issued by Fidelity and Deposit Company of Maryland in the amount of $60,000 (Bond No. 08840690M) for the Montalcino Street and Central Parkway traffic signal improvements as part of the Tract 7644 project be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 17th day of June, 2009; and 3.
