RECOMMENDATION: ~ 1) Adopt Resolution Opposing Proposition 28, Repeal Initiative of Proposition 10 Tobacco Surtax FINANCIAL STATEMENT: DESCRIPTION: At the February 1, 2000 Council Meeting, the City Council voted to publicly oppose Proposition 28- Repeal Initiative of Proposition 10 Tobacco Surtax, a ballot measure that will appear on the March 7, 2000 California Primary Election Ballot. Proposition 28 would do the following: · Repeal a surtax of $.50/pack of cigarettes and the equivalent of $1.00/pack for other tobacco products, including cigars, pipe tobacco and smokeless tobacco. · Provide for the elimination of funding for Proposition 10 early childhood development and smoking prevention programs. · Prohibit the imposition of additional surtaxes on the distribution of cigarettes or tobacco products unless enacted by the state legislature. The attached Resolution affirms the Council's opposition to Proposition 28. RECOMMENDATION: Staff recommends that the Council adopt the Resolution opposing Proposition 28, Repeal Initiative of Proposition 10 Tobacco Surtax. H/cc-forms/agdastmt. doc COPIES TO: ITEM NO. RESOLUTION NO. - 2000 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN Opposing Proposition 28, Repeal Initiative of Proposition 10 Tobacco Surtax WHEREAS, each year tobacco use is responsible for the death of 430,000 people nationally and more than 42,000 in California; and WHEREAS, Environmental Tobacco Smoke (ETS), or secondhand smoke, has been categorized as a cancer causing substance by the U.S. Environmental Protection Agency, and ETS is responsible for the death of more than 50,000 Americans; and WHEREAS, according to the Centers for'Disease Control and Prevention, tobacco taxes are one of the most effective tools to reduce smoking and tobacco use, especially among children; and WHEREAS, California voters in November 1998 approved Proposition 10, which increased the state tobacco tax by $.50/pack of cigarettes and the equivalent of $1.00/pack for other tobacco products, including cigars, pipe tobacco and smokeless tobacco; and WHEREAS, there has been a 30 percent reduction in cigarette sales in California in the six months since the tax was implemented; and WHEREAS, majbr tobacco interests are sponsoring Proposition 28 in order to repeal the tobacco taxes approved by the people as contained in Proposition 10 of 1998; and WHEREAS, Proposition 28 would eliminate $680 million annually for comprehensive programs and services to promote early childhood development, including: parenting education and family support services; public education via multi-media campaign; assistance to pregnant women and parents of young children who want to quit smoking; prenatal and postnatal infant nutrition services; immunizations; tobacco use and substance abuse prevention; domestic violence prevention; educational efforts to reduce exposure of secondhand smoke to young children and many other services and programs in local communities throughout California; and WHEREAS, Proposition 28 would also prohibit the people from increasing the state tobacco tax through the initiative process, for any purpose, including tobacco use prevention, health care and medical services for those without health insurance; ATTACHMENT 1 NOW, THEREFORE, BE IT RESOLVED that the City of Dublin opposes Proposition 28 on the March 7, 2000 ballot.
