DESCRIPTION: In 1994, the City acquired right-of-way for Dublin Boulevard, east of the Southern Pacific Railroad right-of-way, via a Quitclaim Deed from the United States Army. This original alignment of Dublin Boulevard followed the present southern boundary of the Parks RFTA property, terminating at Arnold Road near the current intersection with Central Parkway. The City subsequently adopted the Eastern Dublin Specific Plan, which necessitated the adoption of a new Precise Plan Line for Dublin Boulevard from Iron Horse Parkway to Hacienda Drive, in an east-west alignment, to better accommodate development of the Santa Rita property. Said alignment was formally adopted by Ordinance in 1995, thus making the segment of Dublin Boulevard immediately west of Arnold Road obsolete. Opus West Construction, working on behalf of the Surplus Property Authority of Alameda County, has since constructed the roadway improvements along the new alignment, and removed the roadway along the former alignment. To formalize this shift in alignment to the new Precise Plan Line, the Surplus Property Authority of Alameda County agreed to grant the City right-of-way for the new alignment in exchange for the City's abandonment of the original alignment. This transaction was to occur when all roadway improvements along the new alignment were complete. The abandoned right-of-way could then be merged with the County's triangular-shaped parcel bounded by the former alignment, the new alignment, and Arnold Road. To effectuate this change, the County processed Tentative Parcel Map 7395 that described the former alignrnent as Parcel C and the new alignment as Parcel D. Said Parcel Map was subsequently processed and recorded in 2000. COPIES TO: Pat Cashman, ACSPA OPUS West Construction ITEM NO. ~ G:~DEVELOP~DBX-BART\agst intent street abandon.doc As part of the abandonment of Parcel C, the City will reserve a 75-foot-wide storm drain easement over the existing open channel that extends along the Parks RFTA boundary. The City will also reserve the existing 1 O-foot-wide Public Service Easement (PSE) and Sidewalk Easement (SWE) granted across the southern property line where the parcel abuts Dublin Boulevard, and the existing 12-foot-wide PSE and SWE across the eastern property line where the parcel abuts Arnold Road. According to Streets and Highways Code §8310 et seq., the process for abandonment is as follows: Pursuant to Government Code §65402, the planning agency having jurisdiction must first report that the proposed abandonment conforms to the adopted General Plan. The abandonment of this segment of Dublin Boulevard was presented to the Dublin Planning Commission on March 11, 2003, and said Commission adopted a resolution finding that the proposed abandonment conforms to the General Plan. A Resolution of Intent to Vacate must be adopted by the City Council. This resolution sets a date for a public hearing and for adoption of a Resolution for vacation of right-of-way, which is subject to any easements required by the City or public utilities. After adoption, the Resolution of Intent is forwarded to all affected utility providers for input. The resolution is also published and posted in the City's established posting places, and three copies are posted in the vicinity of the right-of-way to be vacated. A public hearing must then be held no sooner than 14 days following adoption of the Resolution of Intent to Vacate. Staff is recommending a public hearing date of April 15, 2003, in order to allow utility providers ample time to respond. After hearing testimony and deliberating, the City Council can then consider adopting a Resolution of Vacation that states the following: That the Resolution of Vacation is made pursuant to Streets and Highways Code §8310 et seq. · The name of the street, together with a precise description. · The facts under which the vacation is made. · That from and after the date the Resolution of Vacation is recorded, the street no longer constitutes a street. A Grant Deed can then be recorded, together with the Resolution of Vacation, officially transferring the abandoned right-of-way to the Surplus Property Authority of Alameda County for subsequent merger with the adjacent developable property. Staff recommends that the City Council adopt the Resolution of Intent to Vacate excess right-of-way on Dublin Boulevard identified as Parcel C on Parcel Map 7395. Page 2 RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN RESOLUTION OF INTENT TO VACATE EXCESS RIGHT OF WAY ON DUBLIN BOULEVARD IDENTIFIED AS PARCEL C ON PARCEL MAP 7395 (STREETS AND HIGHWAYS CODE §8310 et seq.) WHEREAS, the City of Dublin acquired fight-of-way for Dublin Boulevard, east of the Southern Pacific Railroad right-of-way ("Road Extension Property") from the United States of America via a Quit Claim Deed recorded as Series No. 94-312570 on September 22, 1994, Alameda County Records; and WHEREAS, the City subsequently established a new Precise Plan Line for the segment of Dublin Boulevard from the eastern BART access drive (now called "Iron Horse Parkway") to Hacienda Drive via Ordinance No. 9-95 adopted on August 22, 1995, to conform to roadway alignments included in the Eastern Dublin Specific Plan; and WHEREAS, the Community Development Director approved Tentative Parcel Map 7395 subject to Condition of Approval # 16, which requires the Surplus Property Authority of the County of Alameda to grant the City the right-of-way for Dublin Boulevard along the Precise Plan Line adopted in 1995, and requires the City to vacate the segment of Dublin Boulevard along the original Road Extension Property, west of Arnold Road; and WHEREAS, the original right-of-way on Dublin Boulevard to be vacated was identified as Parcel C (4.221 acres) of Parcel Map 7395 (recorded on October 31, 2003, in Book 254, Pages 28-37), and is now considered excess by the City Council as described on the Grant Deed attached as Exhibit "A", said exhibit being attached hereto and made a part hereof; and WHEREAS, the Planning Commission adopted Resolution No. 03-05 on March 11, 2003, which found the proposed right-of-way abandonment of Parcel C to be in conformance with the Dublin General Plan, pursuant to Government Code §65402; and WHEREAS, the City Council intends to vacate said excess right-of-way pursuant to Streets and Highways Code §8310 et seq. by recording a Grant Deed to the Surplus Property Authority of the County of Alameda, reserving therefrom the northwesterly 75 feet for purposes of a storm drainage easement, reserving therefrom the 10-foot Public Services Easement and Sidewalk Easement as shown on Parcel Map 7395 along the southerly line of Parcel C, and reserving therefrom the 12 foot Public Services Easement and Sidewalk Easement as shown on said Parcel Map along the easterly line of Parcel C, and the City Council will concurrently accept a Grant Deed from the Surplus Property Authority which conveys the right-of-way for Dublin Boulevard along the Precise Plan Line adopted in 1995, a parcel described as Parcel "D" on Parcel Map 7395; NOW, THEREFORE, BE IT RESOLVED that on April 15, 2003, at 7:00 p.m., in the City of Dublin City Council Chambers, 100 Civic Plaza, Dublin, California, the City Council will conduct a public hearing to consider vacating excess right-of-way on Dublin Boulevard; any and all persons having /. any objections to the proposed right-of-way vacation may appear before said Council and show cause as to why said proposed vacation should not be ordered. BE IT FURTHER RESOLVED that the City Clerk is directed to publish said Resolution of Intent to Vacate the excess right-of-way on Dublin Boulevard for at least two (2) successive weeks prior to the public hearing in a daily, semiweekly, or weekly newspaper published and circulated in the local agency conducting the proceeding. BE IT FURTHER RESOLVED that the City Clerk is directed to conspicuously post said Resolution of Intent to Vacate excess fight-of-way on Dublin Boulevard in at least three (3) public places along the line of the street proposed to be vacated, with each notice posted not more than 300 feet apart.
