on Scarlett Court in front of Dublin Auto Center (requires
4/5 vote to adopt).
FINANCIAL STATEMENT:
Sufficient funds are budgeted in the Street Maintenance Operating
Budget to cover the cost of curb painting and/or posting signs.
DESCRIPTION: Two-hour parking currently exists on the north side of Scarlett Court
in front of the Dublin Auto Center dealership (Dodge, Nissan, Volkswagen and Hyundai). On the south
side of Scarlett Court, on-street parking is prohibited. Dealership customers and others use the two-hour
parking space on a daily basis to park their vehicles. The dealership property does not have sufficient
on-site space for unloading transport trucks, which forces these trucks to double-park on the north side
of Scarlett Court and block the travel lane in the westbound direction. These double-parked trucks create
a traffic safety concern on Scarlett Court.
It is proposed to repeal 120 feet of two-hour parking zone between two driveways in front of the Dublin
Auto Center (see attached Location Map) and replace it with a "loading zone" for unloading the transports
without obstructing travel lanes on Scarlett Court. It is also proposed to equip this loading zone with
signs that allow for unlimited parking on Saturdays, Sundays, and Holidays, as transport deliveries are
usually made on regular business days. Staffhas met with Mr. Michael Loux of the Dublin Auto Center

and received verbal concurrence with the establishmentofthis flexible loading zone that will allow
transport trucks to unload vehicles safely during the week while also providing on-street parking for
customers on weekends. The other car dealerships in Dublin either have an on-street loading zone or
have sufficient on-site space for unloading the transports.
Under the Dublin Municipal Code, a loading zone is to be established by ordinance. Staff recommends
that this loading zone be established by urgency ordinance under Government Code Section 36937(b) on
the basis that the loading zone is needed to alleviate a safety hazard. A 4/5 vote is required for adoption
of an urgency ordinance on the basis of health and safety issues under this Code section.
Staff recommends that the City Council conduct a public hearing, waive the reading, and adopt the
urgency ordinance repealing 120 feet of two-hour parking zone and establishing a loading zone on the
north side of Scarlett Court in front of the Dublin Auto Center.

AN URGENCY ORDINANCE OF THE CITY OF DUBLIN

REPEALING LIMITED PARKING ZONE (TWO HOURS) AND
ESTABLISHING LOADING ZONE.ON NORTH SIDE OF SCARLETT COURT
The City Council of the City of Dublin does ordain as follows:
Section 1: The two-hour parking zone located on the north side of Scarlett Court, from a point 380
feet east of the easterly curbline of Scarlett Drive, east a distance of 120 feet, is hereby repealed.
Section 2: Said two-hour parking zone shall be deleted from Section 6.32.050 of the City of Dublin
Traffic Code.
Section 3: Pursuant to Section 6.04.290(B) ofthe Dublin Municipal Code and in the interest of public
safety, a loading zone, except on Saturdays, Sundays and Holidays, shall be established at the following
location:
Scarlett Court, on the north side, from a point 380 feet east of the easterly curb line of Scarlett Drive, east
a distance of 120 feet.
Section 4:
The loading zone shall be added to Section 6.36.010 ofthe City of Dublin Traffic Code.
Section 5: This ordinance shall become effective immediately pursuant to Government Code Section
36937(b) in that it relates to the immediate preservation of the City's health and safety. Establishment of
the loading zone will alleviate the need for delivery vehicles to park in.a traffic lane for loading or
unloading purposes.
The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3) public
places in the City of Dublin in accordance with Section 36933 ofthe Government Code of the State of
California.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Dublin this 5th day of
December, 2000 by the following vote:
