No financial impact is anticipated at this time. Tassajara Road and
Fallon Road are included as Segments 22 and 26 in the Eastern
Dublin Traffic Impact Fees (EDTIF) Program. Frontage
improvements for each of the fronting properties are not included in
EDTIF and will instead be the sole responsibility of the property
owners who develop their properties pursuant to the Eastern Dublin
Specific Plan. The City is also currently collecting Dublin Contra
Costa (DCC) fees for future arterial street widening pursuant to a
Joint Exercise of Powers Agreement between the City and Contra
Costa County to mitigate traffic impacts from development in
Dougherty Valley. Said DCC fees are intended to fund the
construction of two of the six ultimate lanes on Tassajara Road.
DESCRIPTION: This is the second reading of a proposed ordinance that was
introduced at the City Council meeting on July 20, 2004.

The Eastern Dublin Specific Plan adopted in 1994 identified a need to reserve sufficient right-of-way
along Tassajara Road for future widening to accommodate cumulative development along this roadway
corridor. The City previously adopted right-of-way lines for the southern segment of Tassajara Road
between 1-580 and the northern boundary of Dublin Ranch Phase 1 as Ordinance No. 20-99, thus allowing
portions of the roadway to be constructed to an ultimate width of 128 feet. Presently, the segment of
Tassajara Road north of Dublin Ranch remains a two-lane road with gravel shoulders and a right-of-way
width of 66 feet. The City annexed portions of this northern segment into the City as part of the Silveria
Ranch project by Pinn Brothers, while the balance remains within Alameda County.
The proposed Ultimate Right-of-Way Lines for northern Tassajara Road and Fallon Road will establish a
right-of-way alignment for the future widening of Tassajara Road to six lanes, and the future extension of
Fallon Road to four lanes using a design speed of 45 MPH. These future roads will include sidewalks,
bicycle lanes, right and left turn pockets, traffic signals, and raised landscape medians. For Tassajara
Road, the alignment will extend from the northern boundary of Dublin Ranch Phase 1 near Shadow Hills
Drive to the Alameda County/Contra Costa County line, generally following the existing road. The right-
of-way width for this segment varies between 122 feet and 128 feet. For Fallon Road, the alignment will
extend from a planned intersection at Tassajara Road to a point approximately 1,500 feet south-east ofthe
intersection for connection with the portion of Fallon Road to be constructed as part of Dublin Ranch
Area A. The right-of-way width for this road is 110 feet.
These alignments are intended to satisfy Mitigation Measure 3.3/14.0 of the Eastern Dublin General Plan
Amendment and Eastern Dublin Specific Plan that requires the City to reserve sufficient right-of-way for
future road construction. Adoption of the right-of-way lines will not result in immediate acquisition of
any property. Rather, the establishment of right-of-way lines, will simply preclude property owners from
constructing buildings or other structures within the future right-of-way area.
Establishment of Right-of-Way Lines:
The procedure for adopting a new roadway' alignment is governed by Chapter 7.68 of the Dublin
Municipal Code. In addition, Government Code §65402 states, in part that, if a General Plan has been
adopted, no real property shall be acquired by dedication or otherwise for street purposes, until the
location, purpose, and extent of such acquisition have been submitted to and reported upon by the
Planning Agency (Planning Commission) as to conformity with adopted General Plan. Upon receiving a
report and recommendation from the Planning Commission, the City Council can then adopt a Resolution
of Intention designating the establishment of the right-of-way, thus notifying interested parties. A public
hearing can then be conducted so the City Council can hear testimony related to the proposed right-of-
way lines. Finally, the City Council can adopt an Ordinance establishing the right-of-way line described
in the Resolution, if appropriate, and have the Ordinance recorded with the County Recorder.
Planning Commission:
As required by Government Code §65402, the Planning Commission reviewed the proposed ultimate
right-of-way lines for Tassajara Road and Fallon Road at it's meeting on May 11,2004. After considering
all testimony, the Planning Commission adopted Resolution No. 04-38, affirming that the proposed
alignments are in confonnance with the City of Dublin General Plan. The Commission also adopted
Resolution No. 04-37 recommending that the City Council adopt the Initial Study/Mitigated Negative
Declaration and Mitigation Monitoring and Reporting Program for the project, and Resolution No. 04-39
recommending that the City Council adopt a Resolution of Intention to Establish the Ultimate Right-of-
Way Lines for Tassajara Road and Fallon Road.

Environmental Review:
An Initial Study has been prepared for this proposed project in confonnance with the California
Environmental Quality Act (CEQA) and CEQA Guidelines. The Initial Study analyzed a full range of
potential environmental issues, relying to a significant degree on the Eastern Dublin EIR. By
implementing the Mitigation Measures included in the Mitigated Negative Declaration and in the
Mitigation Monitoring and Reporting Program, the proposed project will not have a significant impact on
the environment.
The Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for
Tassajara Road/Fallon Road Ultimate Right-of-Way Alignment was adopted via City Council Resolution
No. 145-04 on July 20,2004.
Resolution of Intention:
A Resolution of Intention was adopted via City Council Resolution No. 133-04 on July 6, 2004, that set
July 20, 2004, as the date for the first of two protest hearings. Said resolution was also published and
posted along the street where the right-of-way lines are proposed as required by the Municipal Code to
give interested parties notice of the first reading of the proposed Ordinance.
ANALYSIS:
Tassajara Road and Fallon Road are identified in the Eastern Dublin Specific Plan as major north-south
arterials between 1-580 and the Alameda County/Contra Costa County line to the north. To develop a safe
and appropriate roadway alignment, Staff considered geometric and access issues, topographic
constraints, and jurisdictional restrictions. A Map showing the proposed horizontal and vertical alignment
of Tassajara Road and Fallon Road are on file in the Public Works Department. This Map illustrates how
the road was woven between existing homes, driveways, and parking lots, while respecting significant
topographic features such as Tassajara Creek and it's tributaries, and the surrounding knolls and hillsides.
The result is a plan that confonns to the design criteria for major arterials with a design speed of 45 MPH,
while minimizing adverse impacts to the surrounding topography and riparian areas.
The plat maps and legal descriptions (Exhibits A & B of Attachment 2) illustrate the fourteen properties
that will be directly impacted by the proposed right-of-way lines. The areas to be reserved for future road
widening or construction are shaded and fully dimensioned along with a total square footage and acreage
estimate of land to be reserved. The shaded areas are shown in relationship to the existing road right-of-
way, property lines, and other important topographic features for each property.
Public Comment Requirements:
The establishment of right-of-way lines is regulated by Chapter 7.68 of the Municipal Code. The Code
allows any person with an interest in land affected by the proposed right-of-way alignment to file with the
City Clerk a written objection, provided said objection is received prior to the Council's consideration of
the alignment. The City Council shall hear all protests or objections filed, and then choose to sustain the
objections and abandon the proceedings, deny the objections and by Ordinance establish said right-of-way
lines, or offer changes and modifications as it shall detennine proper. If adopted, the City Clerk shall
record the Ordinance with the County Recorder.
Draft Ordinance:
The draft ordinance was introduced to the City Council at the first of two public hearings on July 20,2004.
No written objections were received by the City Clerk.

ORDINANCE TO ESTABLISH ULTIMATE RIGHT~OF-WAY LINES FOR
TASSAJARA ROAD AND FALLON ROAD
The City Council of the City of Dublin does ordain as follows:
WHEREAS, the City Council adopted Resolution No. 133-04 on July 6, 2004, calling for a public
hearing pursuant to the provisions of Sections 7.68.080 through 7.68.100 of the Dublin Municipal Code
on July 20,2004, at 7:00 pm, in the City Council Chambers, 100 Civic Plaza, Dublin, California, to hear
protests and objections to the establishment of ultimate right-of-way lines for Tassajara Road from
Shadow Hill Drive to the Alameda County-Contra Costa County Line, and Fallon Road from a future
planned intersection at Tassajara Road to a point approximately 1,500 feet southeast of the intersection;
and
WHEREAS, notice of said public hearing was duly given; and
WHEREAS, no written objections were received by the City Clerk prior to the hearing on July 20,
2004; and
WHEREAS, an Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and
Reporting Program for the Tassajara Road/Fallon Road Ultimate Right-of-Way Alignment was adopted
via City Council Resolution No. 145-04 on July 20,2004.
NOW, THEREFORE, the City Council of the City of Dublin finds and does ordain as follows:
SECTION 1.
Pursuant to Dublin Municipal Code Chapter 7.68, the ultimate right-of-way lines are hereby
established for Tassajara Road from Shadow Hill Drive to the Alameda County-Contra Costa County
Line, and Fallon Road from a future planned intersection at Tassajara Road to a point approximately
1,500 feet southeast of the intersection, according to the Legal Description, attached hereto as Exhibit A,
and according to the Plat to Accompany Legal Description for Tassajara Road Precise Plan Alignment,
attached hereto as Exhibit B, said Exhibits herein incorporated.
SECTION 2.
Section 7.68.150 (Previously established right-of-way lines) shall be amended to read:
Tassajara Road, from Shadow Hills Drive to the Alameda County-Contra Costa
County line.
Fallon Road, from a future planned intersection at Tassajara Road to a point
approximately 1,500 feet southeast of the intersection.

SECTION 3.
The effect of said right-of-way lines shall be governed by the provisions of Dublin Ordinance No.
44-87, as amended.
SECTION 4.
This Ordinance shall become effective thirty (30) days from and after its final passage and
adoption by the City Council. The City Clerk of City of Dublin shall cause this Ordinance to be posted in
at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government
Code of the State of California.
SECTION 5.
The City Clerk shall have a certified copy of this Ordinance recorded with the County Recorder's
Office.
