SUBJECT: Appointing Standby Officers for the City Council

FINANCIAL STATEMENT: None
DESCRIPTION: On January 6, 2004, the City Council adopted a Comprehensive Emergency
Management Plan, which address the City's responsibilities as they relate to natural and man-made
emergencies, During the meeting, the City Council requested that Staff return with a recommendation to
appoint Standby Officers for the City Council in the event that the Mayor or Council Members are unable
to assume their roles on the City Council during an emergency.
Section 8639, Article 15, Chapter 7, Division 1, Title 2 of the California Government Code permits the
governing body to appoint up to three standby officers for each member of the governing body. The
standby officers shall have the same authority and powers as the regular officers.
On February 27, 1996, the City Council approved a revision to the City's Multi-Hazard Functional Plan
that appointed members of the Planning Commission as primary Standby Officers of the City Council and
members of the Parks and Community Services Commission as secondary Standby Officers. Due to the
adoption of the.new Comprehensive Emergency Management Plan, it is appropriate for the City Council
to reaffirm its previous appointment of Standby Officers by adopting the attached Resolution (Attachment
1) or discuss and appoint alternative Standby Officers.
It is important to note that should the Mayor and Vice-Mayor be unable to assume their roles on the
Council, the Mayor Pro Tem would be appointed by majority vote of the reconstituted City Council.
Attachment 2 indicates the change that will be made to the recently adopted Comprehensive Emergency
Management Plan upon adoption of the Resolution.
RECOMMENDATION:
Staffrecommends that the City Council adopt the Resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN
APPOINTING STANDBY OFFICERS FOR CITY COUNCIL OF THE CITY OF DUBLIN
WHEREAS, the City of Dublin is aware of the hazards in and around the City of Dublin, and alert
to the possibilities of a major disaster; and
WHEREAS, a ComprehenSive Emergency Management Plan which addresses the City's
responsibilities as they relate to natural disasters, human-caused emergencies and technological incidents,
was adopted by the City Council on January 6, 2004; and
WHEREAS, the City Council desires to appoint Standby Officers to ensure the continuity of
government in the event of a major disaster as provided for in Section 8639 Article 15, Chapter 7,
Division 1, Title 2 of the California Government Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby
appoint the members of the Planning Commission of the City of Dublin as primary Standby Officers of
the City Council of the City of Dublin; and
BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby appoint
the members of the Parks and Community Service Commission of the City of Dublin as secondary
Standby Officers of the City Council of the City of Dublin.

ANNEX G ' Continuity of Government
Standby Officers
Section 8639, Article 15, Chapter 7, Division 1, Title 2 of the California Government Code
permits the governing body to appoint up to three standby officers for each member of the
governing body and up to three standby officers for the political subdivision's chief
executive. The standby officers shall have the same authority and powers as the regular
officers.
Reconstituting the Goveming Body with Temporary Officers
Section 8644, Article 15, Chapter 7, Division 1, Title 2 of the California Government Code
established a method for reconstituting the governing body. It authorizes that, should all
members of the governing body, including all standby members, be unavailable,
temporary officers shall be appointed by the chairman of the board of the County or, if
unavailable by the chairman of the board of any county within 150 miles of the political
subdivision beginning with the nearest and most populated county, or if unavailable, by the
Mayor of any city within 150 miles beginning with the nearest and most populated city.
Meeting of Govemment Body During an Emergency
Section 8642, Article 15, Chapter 7, Division 1, Title 2 of the California Government Code
directs local governing bodies to convene as soon as possible whenever a state of
emergency or local emergency exists and at a place not necessarily within the political
subdivision.
Duties of Goveming Body During an Emergency
Section 8643, Article 15, Chapter 7, Division 1, Title 2 of the California Government Code
provides that the duties of the governing body during emergencies shall include
ascertaining the damage to the political subdivision and its personnel and property,
reconstituting itself and the political subdivision, and performing functions in preserving law
and order and furnishing local services.
