COPIES TO: John Croswhite, Zahn Group ITEM NO. _~~ g:~miseproj~mediation~agst accept DESCRIPTION: In March of 2004, the City Council received a report regarding water intrusion in the Civic Center and the need to perform environmental remediation work. The City Council declared a state of emergency in order to waive the competitive bid procedure for the remediation work and subsequent investigation and repair of the building. The City subsequently received proposals from contractors and contracted with Munters Corporation as the most responsive. The state of emergency had been extended since that time and reports made to the City Council on each agenda. The work on both the remediation/restoration project and correction of the water intrusion is now complete. The building has received clearance from the Certified Industrial HYgienist who has monitored the remediation portion of the work. In addition to the restoration of materials removed during remediation, the following steps have been taken with respect to water intrusion: sealing of windows, removal of vines and sealing of concrete block, installation of a concrete mowband and subdrain system at the perimeter of the building, modification to the irrigation system, and interim roof repairs. There is a Capital Improvement Project scheduled for 2004-05 to provide permanent repairs to the first floor roof areas that were found to be leaking. The Zahn Group will be generating a final report on the causes of the water intrusion for insurance purposes. At this time, the State of Emergency may cease and the work on the project may be accepted. Staff recommends that the City Council (1) adopt the resolution terminating the emergency and accepting the final project report, and (2) accept the work com~)leted under Capital Improvement Project 93912 and authorize final payment to the contractors. Page 2 RESOLUTION NO. --04 A RESOLUTION OF ~ CITY COUNCIL OF THE CITY OF DUBLIN TERMINATING STATE OF EMERGENCY AND ACCEPTING FIN~ REPORT CIVIC CENTER REMEDIATION WORK WHF. REAS, on March 16, 2004, the City Council adopted Resolution 51-04 approving a finding of emergency and waiver of the competitive bid process relating to water intrusion and remediation work within the Civic Center; and WHEREAS, at each successive City Council meeting thereafter, the City Council received progress reports and adopted resolutions continuing the emergency; and WHEREAS, work on the repair and remediation work has now been completed and found to be acceptable; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin terminates the emergency and accepts the final project report.
