RECOMMENDATION: ~" " Adopt the resolution authorizing the filing of an application for

projects, and stating the assurance of the City to complete these
projects.
FINANCIAL STATEMENT:
The City of Dublin's grant application has been approved in the
amount of $3,000,000 for two capital projects, namely the East and
West Dublin BART Station Corridor Enhancement projects. The
City is required to provide an 11.47% local match ($388,682) to
construct the two projects. Although local match funds are shown in
the 5 year CIP, they will still need to be allocated in future fiscal
years.
DESCRIPTION: In 1998, the Metropolitan Transportation Commission (MTC)
initiated the Transportation for Livable Communities program. Since then, the MTC has awarded over
$80 million dollars to local projects that support multimodal travel and more livable neighborhoods. The
program was later expanded in 2001 to include a Housing Incentive Program (HIP) which rewards federal
funds to local governments that build high density housing near transit hubs/stations, based on project
density, project size, and the number of affordable units.

In response to the MTC' s 2005 call for proj ects, the City of Dublin applied for the Dublin Transit Center
project, which includes the development of up to 1,500 high-density housing units adjacent to the East
Dublin BART Station. The City's eligibility for HIP funds was approved by the MTC for up to $3.0
million dollars, provided the housing project building permits are issued by June 2007. Building permits
for the EAR, Elan at Dublin Station, and Avalon Bay housing developments have since been issued by the
City, with the last ones issued in August 2006. Based on the housing density and number of affordable
units permitted, the City was able to qualify for $3.0 million, the maximum amount the MTC could award
to a local jurisdiction.
Recipients of the $3.0 million grant are two proj ects included in the City's 2006-2011 Five-Year Capital
Improvement Program. These are the East Dublin BART Station Corridor Enhancement Project (CIP No.
96012) and the West Dublin BART Station Corridor Enhancement Project (CIP No. 96011). These
projects will improve a variety of transportation modes, including pedestrian, transit and bicycle facilities
primarily on Dublin Boulevard leading to the East and West Dublin BART Stations. Additionally, Dublin
Boulevard will be enhanced with City entrance signs, mediar1lbridge railing treatments, and identity
markers from Hansen Drive to Tassajara Road, consistent with the City of Dublin Streetscape Master Plan
(see Attachment 2).
As part of the MTC's requirements, a City Council resolution is required authorizing the filing of an
application for federal funding for the two projects, committing the necessary non-federal (local) match
for the projects, and stating the assurance of the City to complete the projects. The City will be required
to provide an 11.47% local match for a total of $388,682 for the two projects. If the City accepts the
grant, the City will need to allocate funding of a local nature in future fiscal years.
Staff recommends that the City Council adopt the Resolution authorizing the filing of an application for
federal funding, committing the necessary non-federal (local) match for the East and West Dublin BART
Station Corridor Enhancement projects, and stating the assurance of the City to complete these projects.

OF THE CITY OF DUBLIN

AUTHORIZING THE FILING OF AN APPLICATION FOR FEDERAL SURFACE
TRANSPORTATION PROGRAM AND/OR CONGESTION MITIGATION AND AIR QUALITY
IMPROVEMENT FUNDING AND COMMITTING THE NECESSARY NON-FEDERAL MATCH
AND STATING THE ASSURANCE TO COMPLETE THE PROJECT
WHEREAS, the City of Dublin (herein referred as APPLICANT) is submitting an application
to the Metropolitan Transportation Commission (MTC) for $1,743,000 and $1,257,000 in funding from
the federal Surface Transportation Program (STP) and/or Congestion Mitigation and Air Quality
Improvement (CMAQ) program for the East Dublin BART Station Corridor Enhancements and West
Dublin BART Station Corridor Enhancements projects respectively (herein referred as PROJECTS)
for the MTC Housing Incentive Program (Resolution 3710) (herein referred as PROGRAM); and
WHEREAS, the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for
Users (SAFETEA) (Public Law 109-59, August 10,2005) continues the Surface Transportation Program
(23 U.S.C. S 133) and the Congestion Mitigation and Air Quality Improvement Program (23 U.S.C. S
149); and
WHEREAS, pursuant to SAFETEA, and the regulations promulgated thereunder, eligible project
sponsors wishing to receive federal STP and/or CMAQ funds for a project shall submit an application first
with the appropriate Metropolitan Planning Organization (MPO), for review and inclusion in the MPO's
Transportation Improvement Program (TIP); and
WHEREAS, the MTC is the MPO for the nine counties of the San Francisco Bay region; and
WHEREAS, the MTC has adopted a Regional Project Funding Delivery Policy (MTC Resolution
No. 3606, revised) that sets out procedures governing the application and use of STP/CMAQ funds; and
WHEREAS, APPLICANT is an eligible project sponsor for STP/CMAQ funds; and
WHEREAS, as part of the application for STP/CMAQ funding, MTC requires a resolution
adopted by the responsible implementing agency stating the following:
1) the commitment of necessary local matching funds of at least 11.47%; and
2) that the sponsor understands that the STP/CMAQ funding is fixed at the programmed amount, and
therefore any cost increase cannot be expected to be funded with additional STP/CMAQ funds;
and
3) that the project will comply with the procedures specified in Regional Project Funding Delivery
Policy (MTC Resolution No. 3606, revised); and
4) the assurance of the sponsor to complete the project as described in the application, and if
approved, as included in MTC's TIP; and
5) that the project will comply with all the project-specific requirements as set forth in the Housing
Incentive Program.

NOW, THEREFORE, BE IT RESOLVED that the City of Dublin (APPLICANT) is authorized
to execute and file an application for funding under the STP and CMAQ of SAFETEA for the East Dublin
BART Station Corridor Enhancements and West Dublin BART Station Corridor Enhancements projects
(PROJECTS).
BE IT FURTHER RESOLVED that the APPLICANT by adopting this resolution does hereby
state that:
1. APPLICANT will provide $225,824 and $162,858 for the East Dublin BART Station Corridor
Enhancements and West Dublin BART Station Corridor Enhancements projects respectively in
non-federal matching funds; and
2. APPLICANT understands that the STP/CMAQ funding for the PROJECTS is fixed at the
MTC approved programmed amount, and that any cost increases must be funded by the
APPLICANT from other funds, and that APPLICANT does not expect any cost increases to be
funded with additional STP/CMAQ funding; and
3. APPLICANT understands the funding deadlines associated with these funds and will comply
with the provisions and requirements ofthe Regional Project Funding Delivery Policy (MTC
Resolution No. 3606, as revised); and
4. PROJECTS will be implemented as described in the complete application and in this
resolution and, if approved, for the amounts programmed in the MTC federal TIP; and
5. APPLICANT and the PROJECTS will comply with the requirements as set forth in the
Housing Incentive Program; and
BE IT FURTHER RESOLVED that APPLICANT is an eligible sponsor of STP/CMAQ funded
projects.
BE IT FURTHER RESOLVED that APPLICANT is authorized to submit an application for
STP/CMAQ funds for the PROJECTS.
BE IT FURTHER RESOLVED that there is no legal impediment to APPLICANT making
applications for the funds.
BE IT FURTHER RESOLVED that there is no pending or threatened litigation that might in any
way adversely affect the proposed PROJECTS, or the ability of APPLICANT to deliver such PROJECTS.
BE IT FURTHER RESOLVED that APPLICANT authorizes its City Manager, or designee to
execute and file an application with the MTC for STP/CMAQ funding for the PROJECTS as referenced
in this resolution.
BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the MTC in
conjunction with the filing of the application.
BE IT FURTHER RESOLVED that the MTC is requested to support the application for the
PROJECTS described in the resolution and to include the PROJECTS, if approved, in the MTC's TIP.
