HomeMy WebLinkAboutItem 8.1 East Bay Reg Park Distti~ ~ ~1 J ~ ~ ~~ ~ -ih 1 \~V/~ CITY CLERK File#^^b^~^~-~^ AGENDA STATEMENT CITY COUNCIL MEETING DATE: February 17, 2009 SUBJECT: Authorization to Enter into a Master Contract with the East Bay Regional Park District (EBRPD) for Local Grant Funds under Measure WW Park Bond Extension Report by Diane Lowart, Parks & Community Services Director ATTACHMENTS: 1) Resolution authorizing a Master Contract with EBRPD for Measure WW Funds RECOMMENDATION: Adopt Resolution authorizing Staff to enter into a .Master Contract with the East Bay Regional Park District for Local Grant Funds under Measure WW Park Bond Extension l.~ FINANCIAL STATEMENT: $2,145,118 is available to the City of Dublin from the Local Grant Program under the East Bay Regional Park District Measure WW Park Bond Extension DESCRIPTION: In November 2008, the voters of Alameda and Contra Costa Counties approved Measure WW, a $500 million bond initiative of the East Bay Regional Park District (EBRPD). Of this amount, $125 million (25%) of the bond proceeds will fund local park and recreation projects on a per-capita grant program to cities and other local agencies. The balance of the bond proceeds, $375 million (75%), will fund regional park acquisitions, open space preservation, park development, habitat restoration and an emergency reserve. Based on the 2008 Department of Finance population estimate, the City of Dublin is eligible for $2,145,118 in grant funding; there are no matching requirements for the Local Grant program. The first step in the process to obtain grant funding is to enter into a Master Contract with the EBRPD. In order to get a Master Contract, the City must submit a resolution authorized by the City Council. It is not necessary to identify projects in the resolution. Upon approval of the resolution by the EBRPD, the Master Contract will be sent to the City for execution. Once the Master Contract is approved, a Project Application can be submitted. Project Applications will only be accepted February 1St through March 31St each year. COPY TO: Page 1 of 2 ITEM NO. G:\COUNCIL\Agenda Statements\2009\2-17 EBRPD WW-Authorization.doc Eligible Projects Capital Projects that will provide lands and facilities for recreation activities and services and historic preservation are eligible. Projects must be consistent with the City's park and recreation element of the general plan or appropriate parks and recreation planning document. Public art projects are eligible as long as they are in, or adjacent to, a parks and recreation facility. The following types of Capital Projects are eligible for grant funding: • Acquisition (fee title or permanent easement for public access projects) o For land acquisition project applicants must submit a copy of the land agreement and appraisal, if applicable, for District approval prior to acquisition. • Development (including renovation of recreational facilities) At this time, Staff is reviewing the. unfunded projects in the Capital Improvement Program to determine projects that would be eligible for Measure WW funding. A list of potential projects will be brought back to the City Council for consideration at the March 17, 2009 City Council meeting. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution authorizing Staff to enter into a Master Contract with the East Bay Regional Park District for Local Grant Funds under Measure WW Park Bond Extension. XX- 09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AUTHORIZATION TO ENTER INTO A MASTER CONTRACT WITH THE EAST BAY REGIONAL PARK DISTRICT FOR LOCAL GRANT FUNDS UNDER MEASURE WW PARK BOND EXTENSION WHEREAS, the people of the East Bay Regional Park District have enacted the Measure WW Park Bond Extension which provides funds for the acquisition and development of neighborhood, community, regional parks and recreation lands and facilities; and WHEREAS, the East Bay Regional Park District Board of Directors has the responsibility for the administration of the grant program, setting up necessary procedures; and WHEREAS, said procedures require the City Council of the City of Dublin to certify by resolution the approval of the City of Dublin to apply for the Local Grant allocation of funds; and WHEREAS, the City of Dublin will enter into a Contract with the East Bay Regional Park District; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin herby: 1. Approves the execution of a grant contract in the amount of $2,145,118 from the Local Grant Program under the East Bay Regional Park District Measure WW Park Bond Extension; and 2. Certifies that the City of Dublin has or will have sufficient funds to operate and maintain the Project(s); and 3. Certifies that the City of Dublin has reviewed, understands and agrees to the General Provisions contained in the Contract as attached in Exhibit A to the Resolution; and 4. Appoints the Parks and Community Services Director as agent to conduct all negotiations, execute and submit all documents including, but not limited to, applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of Project(s). THESE FUNDS ARE FOR THE ACQUISITION AND DEVELOPMENT OF NEIGHBORHOOD, COMMUNITY, AND REGIONAL PARKS AND RECREATION LANDS AND FACILITIES. The General Provisions, Local Grant Procedural Guide, Forms and individual Project Applications are attached hereto and made a part o f and incorporated into the Contract. The District anticipates that WW Parks Bonds in the amount of $ project.
