Morton, Public Works Director ATTACHMENTS: 1) 2) Resolution Memorandum of Understanding RECOMMENDATION: FINANCIAL STATEMENT: Adopt Resolution Approving the Memorandum of Understanding for the San Francisco Bay Area Interim Center-to-Center Program The Metropolitan Transportation Commission will serve as the Program Manager, with no cost to the City associated with administering the proposed Center-to-Center Program. City Staff will be expected to participate in a technical advisory committee, which will meet at least every six months to discUss Program and corridor-specific issues. DESCRIPTION: The City of Dublin is part of the 1-580 Smart Corridor system, which provides an advanced traffic and incident management system for the Tri-Valley region of Alameda County. The Smart Corridor enables the exchange of.real-time traffic data and real-time video images between participants (i.e. the Cities of Dublin, Livermore and Pleasanton), but provides limited ability for real-time exchange With other Smart Corridors, Caltrans, and other San Francisco Bay Area entities. The Metropolitan Transportation Commission (MTC) has recently proposed an Interim Center-to-Center Program for the purpose of implementing and operating an Interim Center-to-Center System that will enable the exchange of real-time traffic data and video between the Bay Area's Smart Corridors and the Regional Transportation Management Center, where Caltrans, the California Highway Patrol and the Bay Area Traveler Information System (Travlnfo) facilities are combined in one location. The Interim Program and Interim System are. anticipated to continue for several years, but will eventually be replaced by a more comprehensive system with multi-modal and/or statewide capabilities. The MTC has requested certain agencies from the San Francisco Bay Area, which operate Smart Corridor systems, to be Parties to a Memorandum of Understanding (MOU) for the proposed Interim Center-to- Center Program (Attachment 2). The list of Parties includes Caltrans, the Cities of Pleasanton, Dublin, GAI-580 Smart Corridorlagst_mtc c2c mou.doc COPIES TO: JeffGeorgevich, MTC ITEM NO. Livermore, San Jose, Campbell, Santa Clara, Milpitas, Fremont, and Cupertino, County of Santa Clara, Town of Los Gatos, Santa Clara Valley Transportation Authority, and City and County of San Francisco. The purpose of the proposed MOU is to acknowledge the agreement of all Parties to work cooperatively in developing an Interim. Center-to-Center Program and implementing an Interim Center-to-Center System. The Interim System will improve inter-agency coordination, facilitate regional transportation management in the Bay Area, and ensure accuracy and timeliness of travel information to the public. KEY PROVISIONS The following are key provisions in the MOU and Data Exchange Policy: The MOU does not authorize funding or project effort, nor is it a legally binding contract. Commitments providing for the payment of funds or authorizing specific work phases will be covered by separate agreements. The MOU establishes an Executive Committee, composed of one member from the lead agency for each of the three Smart Corridors considered' for the Interim Center-to-Center Program and System, Caltrans and MTC. The Executive Committee responsibilities include resolving institutional issues, policy differences, or other disagreements that cannot be resolved by the TAC, and approving expansion of the Program and System to include other Parties. The MOU establishes a Technical Advisory Committee (TAC), composed of staff members from each of the Parties, and responsible for the System's implementation, operation, and maintenance. City of Dublin Staff would participate on the TAC. All Parties agree to provide the following: Ensure compliance with the objectives, requirements, and standards of their agencies; exchange real-time transportation data and video; participate in the pursuit of funding for future phases as well as on-going operations and maintenance; and for those portions of the system within their boundaries, provide system operations, management, and maintenance. The Policy for the Exchange of Real-Time Traffic Data and Real-Time Video enables, but does not require, the exchange of information with another Party, and explicitly prohibits storing (recording) video received from another Party as part of this Program, unless provided for in a separate agreement. The Parties are committed to respecting and protecting the privacy of all members of the public.' No information about, or that is traceable to, any individual person will be collected, exchanged, stored, or manipulated. All activities will be implemented in a manner consistent with Federal and California laws governing an individual's right to privacy. As indicated in the MOU, the City of Pleasanton will serve as the lead agency for the 1-580 Smart Corridor system on the Executive Committee for the Interim Center-to-Center Program. Based on recent discussions with MTC, it was agreed.that City Staff reserves the right to attend Executive Committee meetings, as deemed necessary, to ensure that policies adopted by the committee are consistent with recommendations made by the TAC group. Furthermore, the City of Dublin reserves lthe right to withdraw its membership from the Interim Center-torCenter Program at any time, should the direction pursued by this organization become inconsistent with the City's goals and objectives. Staff recommends that the City Council adopt the resolution approving the proposed Memorandum of Understanding for the San Francisco Bay Area Interim Center-to-Center Program, and authOrize the City Manager to execute the Memorandum of Understanding.
