SUBJEC Request to initiate a General Plan Amendment Study to modify the General Plan
Land Use Designation of the westernmost and easternmost portions of the
vacated right-of-way of Scarlett Court.

EXECUTIVE SUMMARY:
The City Council will consider whether to authorize Staff to initiate a General Plan Amendment
Study to provide a land use designation for the westernmost and easternmost portions of
Scarlett Court which were recently vacated by the City Council.
FINANCIAL IMPACT:
The costs associated with the preparation of the General Plan Amendment include Staff time to
prepare the proposed amendment.
RECOMMENDATION:
Staff recommends that the City Council: 1) Receive Staff presentation; 2) Receive comments
from the public; and 3) Adopt Resolution approving the initiation of a General Plan Amendment
Study for the westernmost and easternmost portions of Scarlett Court.

DESCRIPTION:
Background
On October 6, 2009, the City Council adopted Resolution 138-09 and 143-09 directing the
Planning Commission to report to the City Council on whether or not the proposed vacation of
the westernmost and easternmost portions of Scarlett Court and their eventual sale was
consistent with the General Plan. On October 13, 2009, the Planning Commission adopted
Resolution 09-036 which declared that the proposed vacation and eventual sale was consistent
with the General Plan.
On November 17, 2009, the City Council adopted Resolution 165-09 vacating the westernmost
portion of Scarlett Court and 166-09 vacating the easternmost portion of Scarlett Court. The
portions of Scarlett Court that were vacated by the City Council are shown in blue on the map
below.

Staff is requesting that the City Council initiate a General Plan amendment study to determine
an appropriate land use designation for the abandoned right-of-way.
ANALYSIS:
The General Plan does not include land use designations for roadways. Therefore the portions
of Scarlett Court that have been vacated need to be designated in the General Plan to allow for
the use of the area in the future. Staff recommends studying the Business Park/Industrial and
Outdoor Storage Land Use Designation which is the same General Plan land use designation
as the surrounding properties. The City Council could also direct Staff to study an alternative
land use designation or a combination of designations.

Similarly, these properties do not currently have a zoning designation associated with them. The
current zoning for the adjacent properties is Light Industrial (M-1). Therefore, Staff proposes to
study an appropriate zoning designation for both parcels.
A resolution has been prepared for the City Council's consideration. Staff recommends that the
City Council adopt a Resolution approving the initiation of a General Plan Amendment Study for
the westernmost and easternmost portions of Scarlett Court (Attachment 1).
CONCLUSION:
Should the City Council authorize Staff to begin a General Plan Amendment Study, Staff will
begin reviewing the proposed General Plan land use designation of Business Park/Industrial
and Outdoor Storage and an appropriate zoning designation for both areas. Once the study is
complete, Staff would then bring the General Plan Amendment and Zoning action to the
Planning Commission for their recommendation to City Council. The City Council would then
take action on the General Plan Amendment and Zoning of the property. It is anticipated that
the report could be completed by Spring 2010.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Public noticing is not required to review a request to initiate a General Plan Amendment Study.
Although not required, the City mailed notices to all property owners and tenants within the
Scarlett Court Specific Plan Area and within 300 feet of the Specific Plan Area. A notice was
also published in the Valley Times and posted in the designated posting places.

RESOLUTION NO. XX - 09
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING THE INITIATION OF A GENERAL PLAN AMENDMENT STUDY FOR THE
WESTERNMOST AND EASTERNMOST PORTIONS OF SCARLETT COURT
WHEREAS, the City of Dublin has initiated a request to study a new land use
designation in the General Plan for the westernmost and easternmost portions of Scarlett
Court; and
WHEREAS, the subject properties do not currently have a land use designation in the
General Plan because they were a roadway; and
WHEREAS, on November 17, 2009, the City Council adopted a Resolution 165-09
vacating the westernmost portion of the Scarlett Court right-of-way and Resolution 166-09
vacating the easternmost portion of the Scarlett Court right-of-way; and
WHEREAS, Staff recommends that the City Council authorize Staff to study a General
Plan land use designation of Business Park/Industrial and Outdoor Storage for the subject
properties; and
WHEREAS, the initiation request has been reviewed in accordance with the provisions of
the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt
under Section 15306, Class 6 of the State CEQA Guidelines; and
WHEREAS, a Staff Report was submitted outlining the issues surrounding the request;
and
WHEREAS, the City Council did hear and consider all such reports, recommendations,
and testimony hereinabove set forth, and supports the initiation of a General Plan
Amendment study.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does
hereby approve the initiation of a General Plan Amendment Study for the westernmost and
easternmost portions of the Scarlett Court right-of-way.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Dublin on this
15th day of December 2009 by the following vote:
