Receive StaffReport Consider FireworkS Committee recommendations FINANCIAL STATEMENT: Committee recommendations result in an additional cost of $7,600. DESCRIPTION: In recent years the City of Dublin has experienced an increase in the use of illegal fireworks as well as Safe and Sane fireworks in many of the City's parks, schools and private business parking lots. Many residents from neighboring cities come into Dublin, purchase fireworks and then go to the parks and local business parking lots to ignite the fireworks. This increase has resulted in complaints from business owners and residents due to the noise, garbage, and the use of illegal fireworks. During the July 4th, 2001 holiday Dublin Police Services and Alameda County Fire experienced a marked increase in the calls for service related to the use of fireworks in the City of Dublin, specifically regarding illegal fireworks and aerials being ignited. Dublin POlice received twenty-two (22) calls for service on July 4, 2001 between 5:00 p.m. and 1:00 a.m. The vast majority of those calls concerned the use of illegal fireworks and associated noise-related issues. The 22 calls for service are not reflective of the total number of individual calls for service received because the dispatch center "bundled" calls that were received from a particular geographic area and dispatched them as a single call. The increase in calls, discarded refuse, damaged property and safety issues, prompted the City Council to develop a Committee to address and make recommendations regarding the use of fireworks in Dublin. The Committee has met several times since the City Council meeting of September 18, 2001 to develop a plan to address fireworks related activities. The Committee has focused its efforts on developing recommendations to ensure all Dublin residents and visitors can enjoy a safe July 4th celebration. In order to achieve this objective, the three following areas have been identified and are presented for City Council consideration: Recommendation #1: Designated Areas In order to address citizen concerns about discarded refuse and illegal fireworks use, the Committee recommends that designated areas be offered for public use on July 4t~. The COmmittee has recommended specific parks where it will be legal to ignite Safe and Sane fireworks on July 4, 2002, from 10:00 a.m. until 10:00 p.m. The three parks identified and recommended by the Committee are the Dublin Sports Grounds, Emerald Glen Park and the Shannon Park. Notices would be provided at all fireworks booths stating that only these three parks would be open and available to ignite Safe and Sane fireworks, and that the laws relating to illegal fireworks would l~e strictly enforced. Proper waste disposal containers will be provided and police officers will be assigned to all three parks. Dublin MuniCipal Code (DMC) Section 5.100.110 (M), reads as follows: Unless expressly authorized by the Director, no person, while in any park shall fire, possess or discharge any firecracker, torpedo or similar fireworks (including Safe and Sane fireworks) in the City of Dublin Grounds or recreation areas. The committee recommends that the City Manager, acting as director, authorize the designation of three parks in the City of Dublin for the use of Safe and Sane Fireworks. Designated parks are: Shannon Park, Emerald Glen Park, and the Dublin Sports Grounds between the hours of 10:00 a.m. and 10:00 p.m on July 4th only. Recommendation #2: Penalty Modification The use of illegal fireworks has become an increasing problem throughout the City of Dublin. The Committee agreed that the main way to reduce the use of illegal fireworks is through a "zero tolerance" campaign. This can be accomplished through advertising, signage, and increased police enforcement of Dublin Municipal Code Section 5.24.020, which reads as follows: No person shall possess sell, deliver deal in, use, explode or fire, or cause to be used exploded or fired, any form of fireworks designated as "dangerous fireworks" by Section 12505 of the California Health and Safety Code. The proposed penalty for violation of two DMC sections (5.100.110 and 5.24.020) would need to be amended. The existing DMC Section 5.24.150 regarding violations reads: Penalty of persons violating this chapter shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by a fine not to exceed five hundred dollars ($500) or by imprisonment in the county jail for a period not exceeding thirty (30) days, or both such fine and imprisonment. Proposed change: The amendment would allow the violation to be made an infraction with a fine of $271 for the first offense. This amount would be consistent with establishing a reasonable deterrent to the illegal use of fireworks. Persons convicted of subsequent offenses of either Dublin Municipal Code, within a twelve (12) month peri'od, would receive a fine of $450 fine and/or be charged with a misdemeanor through the California Health and Safety Code. Upon conviction, such violations may be punished by a fine not to exceed five hundred dollars ($500) or by imprisonment in the county jail for a period not exceeding thirty (30) days, or by both such fine and imprisonment. The proposed change of the DMC, making the violation an infraction would allow officers to respond to the illegal fireworks calls and issue citations. In addition to the police officers assigned to the parks five additional officers would be mobile in unmarked vehicles and bicycles to observe and respond to areas where illegal fireworks are being used. Fire Services will have one additional truck mobile during the evening to respond as necessary throughout the city. Recommendation #3: Education Campaign A safety and educational campaign to include public service announcements educating citizens on the dangers and safety risks of illegal fireworks, a newspaper campaign, handout literature and signage would start June 1, 2002, with fliers distributed and videos made available to all Dublin Schools prior to the conclusion of the school year. Revell Communications working for American Promotional Events has agreed to continue to distribute the current safety and educational program produced by the Office of the California State Fire Marshall to the Dublin Unified School District. In addition, they will provide $7,500 to be used for local advertising on radio and television; as well as make logistical arrangements for these events. The Committee proposed that a joint news conference, between city ~officials, the non-profit organizations, and fireworks promoters, be held announcing that Dublin will be enforcing' laws regarding illegal fireworks, the parks utilized for "Safe and Sane" fireworks, and the "zero tolerance" ad campaign. See attached copies of educational literature, Public Service Announcements and a letter from Revell Communications. The Committee recommended the placement of 36" x 36" signs, consistent with California Department of Transportation road signs, at all of the 9 main roadway entrances to the City of Dublin. The signs would clearly indicate that Dublin has a zero tolerance for illegal fireworks and individuals found in possession of such would be cited/and or arrested, and fined up to $5,000. A copy of the proposed signage is attached. MCE has researched the placement and found that the 36" x 36" size would work in all necessary medians, and is not a violation of the City of Dublin sign ordinance. If the City Council desires to implement the Committee recommendations the following resources would be required: Police Services: Eight sworn staff members in addition to the regular complement of personnel, will be utilized as follows: one officer assigned to each of the three designated parks and the five remaining officers to remain mobile to respond to problem areas and calls for service related to fireworks issues. Cost: $3,500.00 Dispatch Services: Due to an increased volume of calls for services and officer initiated citizen contacts, an additional channel for Dublin Police personnel staffed by a designated dispatcher will be needed to monitor extra personnel on July 4, 2002 from 1900-0300 hours. Cost: $350.00 Public Works: Three additional staff members assigned to identified parks for clean-up and costs of rental sweeper equipment. Cost of the "Zero Tolerance" signs to be placed at the entrances to the City of Dublin compliance with the State Department of Transportation. Cost: '$2,360.00 Fire Services: One additional fire truck and three additional firefighters will remain mobile during the July 4th holiday. Cost: $1,950.00 Total anticipated cost, excluding educational component: Total Cost: $7,660.00 The Committee was unable to reach consensus concerning responsibility for the additional costs associated with implementation of these recommendations. The fireworks promoter reported that gross sales amounted to $754,139.76 of which the non-profit organizations received 44% or $331,821. The fireworks promoters suggested that the City sales tax revenue offset the additional costs to the City of Dublin. RECOMMENDATION: Staff recommends that the City Council receive the report and consider the Committee recommendations. SUBJECT: Enhanced Public Education and Illegal Fireworks "Zero Tolerance'' Program Dear Mayor Lockhart: Revell Communications is the public relations/public affairs representative for American Promotional Events, Inc. (APE), the state's leading wholesale distributor of State Fire Marshal-approved fireworks (Red Devil, Freedom and TNT brand names). In addition, we assist American Promotional Events, Inc. with its community liaison activities as well as with the development and implementation of both local and statewide fireworks safety and education programs that it coordinates and/or underwrites in conjunction with local and state fire departments. It has been my distinct honor and pleasure over the last several months to serve on a Dublin Fireworks Safety Task Force with representatives of the Dublin non-profit organizations who sell state-approved fireworks, and representatives of Dublin's police, fire, public works, and parks and recreation departments. As you can see from the enclosed summary of the "California Fireworks Safety & Education Program" produced by The Office of the California State Fire Marshal, in 1990 our client initiated the discussions and ultimately designed, implemented and has underwritten a statewide fireworks safety and education program here in California for the last eleven years. Currently, in media expenditures as well as in-kind resources, our client underwrites this program to the nme of over $750,000 every year. This safety and education program includes a massive school program that is coordinated and delivered through our office, between January and July of every year, to over 1,700 schools in over 250 school districts throughout California. For a number of years, this program has enjoyed the participation and involvement of the Dublin Unified School District. That being said, the level and sophistication of the program that has currently been available through this school district could be improved and enhanced with the participation of representatives of the Dublin police and fire departments. In addition, our client has provided the underwriting for the airing of the State Fire Marshal's television PSA's on illegal fireworks and our client's PSA on the responsible use of state-approved fireworks on the AT&T Broadband Cable System in the City of Dublin as well as those cable systems that serve the other 227 communities here in California that permit the sale and use of state-approved fireworks each year. Each and every year, our client has purchased between 56 to 70, :30-second spots (depending on availability) that along with the "auto fill" provided by AT&T Media Services result in a significant airing of these public safety messages on the cable channels of Dublin's cable system over a 7-day period leading up to the 4th of July (spots aired on A&E, CNN, ESPN, TNT, Nickelodeon and USA cable channels). The purpose of this letter is to convey to you both this office's commitmem and, more importantly, the commitment of our client, American Promotional Events, to the City of Dublin, to assist it with the design, coordination, implementation and funding of an enhanced public education program, particularly emphasizing the City's new "Zero Tolerance" approach to illegal fireworks. This program would entail mounting an aggressive public education campaign prior to and during the 4th of July, emphasizing the proper, responsible use of state-approved fireworks and informing the public of Dublin's "Zero Tolerance" enforcement program for the use and pOssession of illegal firework~s. This effort will be accomplished via staged media events, informational flyers in utility bills, additional :30-second PSA spots (we would produce a spot tailored to Dublin) and distribution of materials to each customer at the fireworks booths operated by the Dublin non-profit organizations. Furthermore, we will work with City police and fire departments to enhance the school informational campaign that already exists with Dublin Unified School District. In addition to our client's current expenditures and in-kind services (as discussed above), I am authorized to represent on behalf of both our client, American Promotional Events, and the other fireworks wholesaler who operates in the City of Dublin (Phantom Fireworks) that they are prepared to provide an additional $7,500 in underwriting and services for this public education effort. Both this office and our client look forward to working with you and others fxom the City of Dublin to make sure that his 4th of July is the safest in history. However, prior to 1991 most of these efforts had not been distinguished by a great deal of cooperation and coordination between the fireworks industry, the non-profit organizations and charities who sell state-approved fireworks, and all the various levels of the fire protection and prevention communities. On November 7,1990, American West Marketing and Freedom Firewor ~ks, both now known as American Promotional Events, Inc., appeared before the State Board of Fire Services~ and proposed an aggressive, coordinated effort between the fire service, the fireworks industry and the non-profit organizations. Pursuant to a unanimous resolution by the Board, the proposal was referred to as the SFM's Public Education Advisory Committee {PEAC} to study the issue and report back. After.discussing the scope, direction and limits of a statewide safety and education effort with numerous fire protection and prevention officers throughout the State, PEAC suggested that the program be limited to the following four goals: I. The proper and responsible use'of state-approved fireworks; 2. How to identify legal fireworks; 3. The hazards of illegal fireworks; and 4. The use or possession of illegal fireworks is illegal and may result in a criminal citation or arrest, including a felony. PEAC fm'ther recommended that delivery of this program be limited to those 200 communities that currently permit the sale and use of state-approved fireworks. At the February- 6, 1991 quarterly meeting, the Board adopted PEAC's recommendation unanimously. 1997 marks the seventh year of this highly successful, cooperative program. From its initial public service announcements (PSA's) featuring former President Ronald Reagan; to its PSA's featuring television personality Ron Masak; to its Illegal Fireworks Amnesty Program; to its "Dangerous Games" video; and, most recently, its "4th of July Fireworks Safety Web Site," this program has received wide acclaim from school districts, the media, the fire service, City Councils, Boards of Supervisors and the Governor for the successful impact it has had on 4th of July safety. ~An advisory board to the California State Fire Marshal that meets quarterly and provides a state level forum for addressing fire protection/ p.revention issues of statewide concern. Its membership is composed of representatives of local and county government, fire service, labor and management organizations, California Department of Forestry, Office of Emergency Services and the insurance industry. The Office of the State Fire Marshal (SFM) was established in state government to foster, develop and promote ways and means of protecting life and property against fire, panic and explosion. California law grants the SFM primary, and in most instances exclusive, responsibility and jurisdiction for administering the laws governing fireworks as well as directs the SFM to adopt and enforce regulations governing the use, sale, storage and transportation of these fireworks in California. In 1997, the SFM will be offering the following safety and education materials on illegal fireworks: Printed Material Illegal Fireworks Brochure "Dangerous Games - THE PREVENTOR Talks to You about the Dangers of lllegal Fireworks" This illegal fireworks brochure outlines the dangers and safety risks posed by the use of illegal fireworks. It also provides some sound advice to parents about how they should talk to their children about illegal fireworks and the emotional, criminal and financial consequences that they and their children might have to face if they fail to take the time or make the effort. The back panel of this brochure has illustrations and descriptions of the more commonly found dangerous, illegal firework items. This portion of the brochure was designed so that it could be used by police and fire departments as well as teachers and parents to help them identify illegal fireworks. This brochure can be used by teachers as a classroom teaching aid when showing the award-winning, short subject video, "Dangerous Games." In 1996, over one million brochures were distributed to students at over 1,000 schools in 220 school districts throughout California. Illegal Fireworks Poster "THE PREVENTOR Says - 'Stay Away from Illegal Fireworks'" This full-size 18"x 24" poster featuring the PREVENTOR provides a compelling warning about illegal fireworks. Video Material Television PSA "Illegal Fireworks" featuring THE PREVENTOR In an effort to more directly target children and preteen audiences with a captivating message designed to educate them on the dangers and safety risks posed by illegal fireworks, the SFM designed a 30-second PSA which urges kids to do their part to protect their community by not using dangerous, illegal fireworks. Standing in front of a fully-engulfed home which was set afire by bottle rockets, THE PREVENTOR declares, "Every year hundreds of people see their dreams go up in smoke as a result of illegal bottle rockets." Then, while holding a handful of the dangerous, illegal items in front of his ~Darth Vadar-like" helmet, he drives home the point that when these items shoot in the air you do not know where they will land, "Maybe on someone's roof." As he turns and points to the fire he states, ~That's what happened here." This 30-second PSA is distributed to 45 network-affiliated and independent television stations throughout California. In addition, American Promotional Events, Inc. purchases additional "paid" spots on over 26 cable systems throughout California for a 7 to 14 day period surrounding the 4th of July. Safety and Education Video on Illegal Fireworks "Dangerous Games" This 7-minute, short subiect, safety video featuring THE PREVENTOR was developed and produced in conjunction with the Greater Sacramento Area Fireworks Safety Task Force, a safety coalition composed of representatives of local government, the fire service, non-profit organizations, the media and the state-approved fireworks industry. In 1996, VHS copies of the video were distributed to over 1,000 schools in 220 school districts throughout California as well as being broadcast on numerous local originations, public access and local government cable channels in over 200 communities for a 2-week period surrounding the 4th of July. Consistent with the request made by the fire service and PEAC, the Office of the State Fire Marshal (SFM) has produced or assisted with the production of several printed and video items which encourage state-approved fireworks consumers to be responsible and safe in their use and enjoyment of these products. In 1997, the SFM will be offering the following safety and education materials on state-approved fireworks: Printed Material Safety Brochure "Celebrate Safely" (Bilingual: English~Spanish) This bilingual safety brochure featuring THE PREVENTOR is designed to promote consumer awareness and responsible use and enjoyment of these products approved and tested by the State Fire Marshal. Distribution of this brochure is limited to the almost 200 communities throughout California that permit the sale and use of state- approved fireworks every 4th of July. The brochure urges that these products be used as they were intended... safely.., as part of a healthy.., family-oriented 4th of July celebration. In 1996, over one million brochures were distributed to students at over 1,000 schools in 220 school districts throughout California. Trading Card "The PREVENTOR - Put Safety First on the 4th" This full-color, safety trading card features a.commanding picture of THE PREVENTOR on the front. It serves as a nice pocket-size reminder of all the safety tips that should be followed when celebrating safely and responsibly with state-approved fireworks. Safety tips, the SFM seal and other key information are printed on the back side of the trading card. This card is available for school and community distribution. Video Material Television PSA "State-Approved Fireworks" featuring 1~. Maureen Reagan This 30-second PSA encourages proper, safe and responsible use of state-approved fireworks. American Promotional Events purchases ~paid" spots on cable systems in "open" communities for 7 to 14 days surrounding the 4th of July. Thousands of these spots are broadcast by over 26 cable systems throughout California reaching over 200 cities, over 1.9 million homes with a potential of over 5 million viewers. This PSA will be broadcast on CNN, MTV, VI-I-I, ESPN, TNT, Nickelodeon, the Discovery Channel, LISA, Headline News and Lifetime. Safety and Education Video "Celebrate Safely" This short 8-minute safety video suggests some common sense precautions and safety measures parents and their children should follow when using state-approved fireworks. In addition to its distribution to over 1,000 schools in over 200 school districts, this video is run on public access, local origination and local government channels on over 26 cable systems throughout California for a 2 week period leading up to the 4th of July. "California 4th of July Fireworks Safety" ... http://www, fireworks-safe~.com In 1996, the SFM and American Promotional Events took the 4th of July Fireworks Safety and Education Program into cyberspace with a World Wide Web site entitled, "California 4th of July Fireworks Safety." This Web site presented a new and effective vehicle to reach out and educate people about the dangers and safety risks posed by the use of illegal fireworks as well as to promote consumer awarefiess and responsible use of state-approved fireworks. By definition, Web sites are often one-sided and sanitized, extolling the purveyor's virtues and mentioning none of its shortcomings. However, this Web site is the exception. In addition to all of the information a visitor to the Web site would expect m this Web site is packed full of data, statistics, laws and regulations and injury and fire statistics--on both illegal and state- approved fireworks. Young browsers are treated to "THE PREVENTOR's 4~ of July Safety Guide for Kids" with tons of information, video clips, and streaming audio. In 1997, all sorts of interactive programs, contests, quizzes and games will be added. This year the Web site will feature an improved "4th of July Safety Teacher's Guide." While this and many of the 1997 components are still under construction, the Teacher's Guide promises to be an easy-to-follow, step-by-step curriculum complete wi/h background information, overview, teaching aids, suggested reinforcement activities and a lesson plan. Users can download the safety videds that the SFM is distributing in VHS cassette form.
