FINANCIAL STATEMENT: There is no financial impact to the City. KMEP determined that the leak was the firm's responsibility and directed that all billings for the incident be directed to and paid by KMEP. DESCRIPTION: KMEP owns and operates a petroleum products pipeline in a portion of the former Southern Pacific Railroad right-of-way which traverses Dublin trom nOlih to south. This line conveys gasoline, aviation fuel, and diesel fuel from Concord to San Jose. In June 2006, detection of a gasoline odor in the storm drain system for the Amador Lakes Apartments on Stagecoach Road led to the discovery of a leak in the pipeline. The leak has since been repaired by KMEP. The following report is presented as a synopsis of the incident, a summary of the current status of the site cleanup, a brief discussion of the ongoing procedures used by KMEP in order to prevent and detect leaks in their pipeline system, and a summary of further action needed. Incident Summary Throughout the entire incident, the Dublin Public Works Department and Alameda County Fire District Staffhave worked together to assess the problem, remove the source of the contamination, and work with COpy TO: Ron McClain, Kinder-Morgan - Page 1 of3 ITEM NO. Over a period of several days, the gasoline odor that had been emitting from the storm drain in the Amador Lakes Apartments area was traced through the storm drain system to the outfall of the pipe. Necessary environmental measures to protect the water quality were taken and were in place at all times during the incident. In addition, the City and East Bay Regional Park District closed the Iron Horse Trail between Amador Valley Boulevard and the Contra Costa County Line on Tuesday, June 20, 2006, and it was reopened on July 14, 2006. The public was notified of the temporary closing of the trail through po stings on the trail and on the City of Dublin website. The City took additional measures during and after this incident in the form of communication with the residents and the completion of an after-action analysis. The City developed an information bulletin for the residents on both sides of the pipeline (Attachment 2) that was hand delivered by City Staff on Friday, June 23, 2006. There was an after-action analysis of the incident completed by the City of Dublin Public Works Department and Alameda County Fire Department, and it was determined that the incident warranted a continued presence in the field by both Departments in order to balance both the technical and life-safety demands of responding to an incident of this nature. Through investigation and cooperation with Zone 7, Dublin San Ramon Services District (DSRSD), the Regional Water Quality Control Board, Fish and Game, and KMEP, the leak in the fuel pipeline was found and repaired. The storm drain and water lines affected have been lined and replaced respectively. Remediation of the contaminated soil will occur as part of the clean up. Current Status of Site Cleanup KMEP is completing the draft remediation plan, and anticipates submitting a draft copy to the City of Dublin for review prior to submittal of the plan to the San Francisco Bay Regional Water Quality Control Board. Public Works intends to retain an environmental consultant to assist in review of the plan, and will request that KMEP modify the plan if necessary to address any comments by the City and the consultant. The City will also coordinate its review of the plan with the Regional Board, as well as Zone 7 and DSRSD. KMEP has agreed to reimburse the City for costs to date associated with the leak, and the City will request that KMEP also pay for the cost of the consultant. At this time, locating the source of the intrusion is not necessary as the storm drain lining will prevent further intrusion, and the remediation work will remove remaining gasoline in the soil. The remediation work will likely extend over a number of months and could include the removal of contaminated soil, aeration of the contaminated soil, or vacuuming the gasoline out of the soil. Public Works will continue to work with KMEP during the remediation to ensure that construction issues, such as dust control, noise, traffic control, trail access and erosion control, are adequately addressed. Pipeline Leak Prevention and Detection Measures KMEP has provided a letter (Attachment 1) outlining the company's standard ongoing operating practices to prevent and detect leaks within its pipeline system. Further Action Staff will continue coordination with KMEP. Efforts will include reviewing and commenting on the remediation plan, and coordination with other agencies such as Zone 7, DSRSD and the Regional Board. Upon approval of the remediation plan by the Regional Board, Staff will monitor KMEP's remediation Page 2 of3 activities through a sitework/grading pennit issued by the City. Upon completion of the remediation work, Staff will work with the Regional Board to confinn that the scope of work outlined in the remediation plan has been successfully completed. Let me assure you that Kinder Morgan takes pipeline safety very seriously. From our perspective, pipeline safety includes safety for the public living along our rigl1ts-of~way (ROW), contractors, our own employees and for the environment. First, a status update on the affected area. · Replacement of the Dublin San Ramon Services District (DSRSD) water rine segment is in progress and expected to be completed and in service by August 18. · Installation of a fiberglass liner in the east-west segment of the City of Dublin's storm drain was completed in mid-July, · Installation of a fiberglass liner in the north-south segment of the City of Dublin's storm drain is in progress and expected to be completed by August 14 . · All soil bins and temporary tanks were removed from the site in mid-July. · While the cause of the release is still under investigation, Exponent Failure Analysis, Inc. metallurgical labs has advised KM that the release was the result of metal fatigue resulting from external damage - a draft report from Exponent is expected late next week. o Estimated release volume is approximately 650 gallons. · Approximately 80 gallons were recovered during initial remediation and more during soil remediation. · Site investigation report for submittal to the Regional Water Quality Control Board and to the City of Dublin is being prepared and expected to be finallzed by August 18. This report will Contain recommendations regarding what further investigative or remedial actions may be warranted. I hope this summary demonstrates Kinder Morgan's effort and desire to address all issues related to any release from our pipeline systems. Recent letters to the Contra Costa Times have greatly mischaracterized this recent event While we do not generally respond to letters to editors, we appreciate this opportunity to communicate the facts to the City of Dublin. First, we responded to an odor report. Upon our arrival, there was no evidence of an active leak and indeed there was no odor. After numerous efforts working closely with the city and other responders, no release could be identified. Subsequent to that, an odor returned and some product was noted exiting the storm drain. immediately, Kinder Morgan responded again. This t1me, we excavated approximately 300 feet of our line and found nothing but dry soil along the line. In the further interest of safety, we took an extra step of evacuating the product from the 500 Dallas Suite 1000 Houston, TX 77002 713-369-9000 7 ATTACBHENT I. Mark Lander August 10. 2006 Page Two Hne and refining it with nitrogen. We introduced a tracer gas of helium into the pipeline so we could use extremely sensitive sniffing equipment to search for helium above ground. This yielded a detection of helium about 30 feet beyond where we had excavated previously. Subsequent excavations discovered a very small dent with what appears to be crack and a small leak. This seclion was immediately cut out and sent to a lab for third party evaluation. California Fish and Game and the California State Fire Marshall supported this decision and will receive copies of the final reports from the metallurgical lab. The normal process for the third party metallurgical analysis is to apply pressure to the cut-out pipe to establish a leak rate prior to destructive testing and failure cause analysis. In this case, preliminary indications are the defect was so small that a factor for leakage could not be determined. Again, this is in stark contrast with one letter that states the local water way is befouled and hundreds of lives endangered. In fact, the leak was extremely small and Kinder Morgan's response was very aggressive. Let me outline some steps that Kinder Morgan takes that are preventative and in line with defending our rights-of-way. · We have markers showing the line locations with 800 numbers for anyone to report actiVity or concerns, such as the odor that was reported in this case. · We monitor our ROWs with full time qualified line riders. Often, they monitor the lines weekly. In addition to routine monitoring, we use computerized one call notification distribution systems to line riders. . We perform aerial line patrols. These patrols are scheduled weekly even though the law requires bi-weekly. Pilots watch for unreported construction activities and encroachments or signs of distressed or dying vegetation. Each item is fully investigated by ground crews. . We participate In public awareness programs. Brochures outlining the locations of our pipelines are mailed to residents within 1/8 mile of either side of our pipelines. (A copy of the brochure is attached for your reference.) Additionally, we meet with local fire departments and first responders. We comply with API's Recommended Practice RP- 1162 on public awareness programs. . We require that qualified personnel be present anytime excavation is performed within 10 feet of our pipeline. . We participate with Cal OSHA to strengthen one call laws, especially for those who fail to file one calls and for those who strike a line and subsequently do not report it We are members in the Common Ground Alliance, an industry organization seeking to improve and set standards for one call systems. FinaHy. the Pipeline Safety Act of 2002 included provisions that require companies to perform specific integrity-related activities on all pipeline segments. The Integrity Management Rules arB very comprehensive and may be found in CFR Title 49 S 195.452 - Pipeline integrity management in high consequence areas. These rules are available at http://ecfr.opoaccess.Gov!. The Association of Oil Pipelines and Kinder Morgan's experiences demonstrate a steady decline in incident rates subsequent to these measures within an industry that is already very safe. Constant attention to the requirements of this rule is necessary to assure compliance that all threats are mitigated and preventive measures are initiated. Kinder Morgan is in compliance with this comprehensive law. Line markers can be found where the pipeline intersects a street, highway, or railroad. However, they cannot be relied upon to indicate the exact position of the pipeline. The pipeline may not follow a straight course between markers, which provide no information on the depth or number of pipelines in the vicinity. Don't try to guess the pipeline's location or route by the marker's placement. Call your state "One Call Center" listed on the front of this brochure. The following are some guidelines to keep in mind: Secure the area around the leak to a safe distance. This could include evacuation of people from homes, businesses, schools and other locations, the erecting of barricades, controlling access to the emergency site, and similar precautions. If the pipeline leak is not burning, take steps to prevent ignition. This could include prohibiting smoking, rerouting traffic, and shutting off the electricity and residential gas supply. Ifthe pipeline leak is burning, take steps to prevent secondary fires, but DO NOT attempt to extinguish a pipeline fire unless asked to do so by pipeline company personnel. Contact the pipeline company as quickly as possible. Pipeline marker signs show the pipeline company's name and emergency telephone number. They will also be testing the soil in the corridor to determine the amount of soil remediation that will be required. · During this process, the Fire Department and its Hazardous Materials Team has monitored the activity in the corridor and have assured me that this leak did not present a fire hazard to adjacent residents. · We have requested East Bay Regional Park District to close access to the Iron Horse Trail between Amador Valley Boulevard and the north City Limit line to avoid conflicts between trail users and the construction equipment. · Once the remediation work has been completed, the trail will be reopened. rfyou have any questions, you may contact the City of Dublin Public Works Department at (925) 833-6630. ~~~ l:bchard Ambrose -":ity Manager ATTAUIDIENT k
