Approve the proposed agreement and authorize the City Manager to execute the proposed agreement. 2. Approve proposed budget transfer of $10,829 FINANCIAL STATEMENT: No funds are included in. the FY 2002-03 Budget for this program. A budget' transfer of $10,829 from the unappropriated reserves will be required. DESCRIPTION: In May 2002, the City of Pleasanton debuted a new website, www. PleasantonJobs.com, with the goal of connecting Pleasanton businesses to Pleasanton residents wanting to work locally while also reducing traffic congestion on regional highways. The website, which was created by Opperman Empire Communications, LLC of Dublin at a cost of $33,684 allows Pleasanton employers to post jobs available at no cost, and job seekers are able to post resumes and complete relevant job searches (see Attachment 1). To date, nearly 150 Pleasanton-based businesses and over 650 registered job seekers have taken advantage of the program. The site averages nearly 3,200 hits per day and averages over 50 jobs listings. Following the successful debut of the website, ihe Economic Development Directors from the cities of Dublin, Livermore, Pleasanton, and San Ramon met to discuss the potential to expand the website to make it available to all Th-Valley businesses. The City of Pleasanton has received a bid from Opperman Empire Communications to expand the site and the new site would receive a new domain name more reflective of the Th-Valley (www. ThValleyJobs.com). The site would be linked to each community's website (The City of Dublin would link through the City's Employment Opportunities page as well as through the Economic Development pages) and Staff would actively market the service to local businesses and to local residents looking for jobs closer to home. As mentioned previously, the City of Pleasanton has already expended $33,684 to create the existing site. The City of Pleasanton also incurred additional costs on this project such as a dedicated server ($4,000) and marketing ($6,396). Staff has estimated that the addition of the three cities (Dublin, Livermore, and COPIES TO: ITEM NO. 2~ H/cc-forms/agdastmt.doc f ,~ San Ramon) to the site would cost approximately $6,000 and marketing the site through radio and print ads and mailers to all businesses and residents would be $24,000 which would increase the total site costs to $ 67,684. The City of Pleasanton has suggested, and the Staff from the other Tri-Valley cities has agreed, that the costs of creating and maintaining the site should be shared based on each community's percentage of businesses and residences. The proposed agreement requests that the City of Dublin contribute $10,829 for FY 2002-03 to help offset the costs involved in creating, updating, and marketing the job site. It is estimated that the additional site changes and marketing will be completed by year's end. If approved, Staff will return during the FY 2003-04 budget for additional annual site maintenance funding. Staff feels that this website would support the City of Dublin's on-going economic development efforts and would benefit both Dublin residents and businesses. RECOMMENDATION: It is recommended that the City Council review and approve the proposed agreement and authorize the City Manager to execute the agreement, and approve a budget change form authorizing an appropriation of $ 10,829 from unappropriated reserves to pay for the Tri- Valley jobs website. G:\ChrisXJobs2002-03~FORM-agenda statementtri-valleyj obs.doc AGREEMENT REGARDING TrivalleyJobs.com THIS AGREEMENT is made this day of ,2002 among the Cities of Dublin, Livermore, Pleasanton and San Ramon (collectively referred to as the "Cities"). RECITALS A, The City of Pleasanton developed the website "PleasantonJobs.com" to connect Pleasanton employers with people wanting t° work close to home in order to improve the quality of life for Pleasanton residents; to help Pleasanton businesses recruit fi-om the quality workforce that attracted them to the area; and to alleViate traffic. B. The PleansantonJobs.com website was created by a consultant to the City of PIeasanton using Microsoft SQL databases and the PHI) scripting language and is hosted on a server purchased by the City of Pleasanton. C. The neighboring cities of Dublin, Livermore and San Ramon have expressed a desire to partner with the City of Pleasanton to expand the concept of PleasantonJobs.com to include employers in those cities. D. The Cities desire to expand the PleasantonJobs.com website to include employers in the cities of Dublin, Livermore and San Ramon, as well as the City of Pleasanton; to rename the website "TrivalleyJobs. com"; and to share the costs of the expansion and operation of the TrivalleyJobs.com website. NOW, THEREFORE, in consideration of the mutual promises contained in this Agreement, the parties agree as follows: 1. Management of the TrivalleyJobs.com Website. The Cities will meet on a regular basis t° address issues regarding the TrivalleyJobs.com website. EaCh city will be responsible for responding to inquiries from employers Within its jurisdiction. The City of Pleasanton will continue to manage, the technical infrastructure of the website through its Economic Development Manager, according to the Operating Parameters set forth below, and with technical consulting assistance as necessary. The City of Pleasanton Economic Development Manager will also coordinate the financial participation of the Cities as set forth in Section 3 below. 2. Operating Parameters. a. Employers. Employers in the Cities may use the TrivalleyJobs.com website, at no cost, to advertise jobs that are physically located in the Cities. Each city shall provide employers within its jurisdiction an employer access code to register and use the website. An employer posting a job listing may have a link to its own website. Employers are automatically notified that a job listing is nearing the end of its 30-day term on the website, which may be extended in 30-day increments. Employers are not able to "shop" resumes on the website. ~.f - ATTACHMENT 1 Agreement Regarding TrivalleyJobs. Com ~ Page 2 of 5 b. Job Seekers. Job seekers may use the TriValleyJobs.com website, at no cost, in several ways including searching for jobs using certain criteria, registering an email address for automatic notification of available jobs in certain categories and sending their resumes to employers who have listed an interest in their skills. c. Links to Related Websites. The TriValleyJobs.c°m website Will provide links to websites for the Cities, chambers of commerce, transportation providers and other sites deemed relevant to the Cities. d. Trademark Application. The City of Pleasanton has filed a trademark application for the PleasantonJobs.com website's slogan of"Work closer. Go farther." The cities of Dublin, Livermore and San Ramon shall only use this slogan in referring to the TrivalleyJobs.com website. 3. Costs. a. Description of Costs. The start-up costs for the TrivalleyJobs.com website are: Site Development $33,684 Dedicated Server 4,000 .. Expand Site 6,000 Kick-off Marketing 24,.000 Total $67,684 The ongoing costs for the TrivalleyJobs.com are anticipated to be server and website maintenance and promotion/marketing of the website. For any computer-related expenditure exceeding $4,000 (e.g. replacement of the server), the Pleasanton Economic Development Manager will endeavor to seek approval of the Cities prior to incurring the cost. b. Allocation of Costs. Payment of Costs. The cities of Dublin, Livermore and San Ramon shall reimburse the City of Pleasanton for the costs incurred with the TrivalleyJobs.com website. Within thirty (30) days of execution of this Agreement, reimbursement of the start-up costs in Section 3.a above shall be made as follows: Dublin (16%) $10,829 San Ramon (21%) 14,214 Livermore (31%) 20,982 Reimbursement for ongoing costs shall be upon invoice by the City of Pleasanton with payment due within thirty (30) days. 4. Term. This Agreement shall begin upon execution by all Cities. Any city may withdraw from the Agreement upon thirty (30) days written notice to the other cities, but shall remain liable for any costs incurred up to the date that the withdrawal is effective. Upon withdrawal, employers in that jurisdiction shall be notified that the TrivalleyJobs.com website will no longer be available within that jurisdiction and that any current job posting will not be renewed at the end of its 30-day posting period. The Agreement will terminate upon withdrawal of all Cities or if there is only one city remaining as a party to the Agreement. 5. Modification. This Agreement shall only be modified in a writing signed by the authorized representatives of the Cities. A modification may include the admission of another city to the Agreement only upon a unanimous vote of the authorized representatives of all Cities. 6. Waiver. The failure of any party to this Agreement t° enforce any term or condition of this Agreement shall not be deemed a waiver of such term or condition. 7. Notices. Any notice which either party may or is required to give shall be given by hand delivery, by facsimile with confirmation of transmission or by mailing, postage prepaid, to the addresses shown below, or to such other places designated by the parties from time to time as follows: Dublin: City of Dublin 100 Civic Plaza, P.O.
