EXECUTIVE SUMMARY:
The Village Parkway Stormwater Treatment Project (CIP No. 969009) includes installation of
two structural treatment units and one vegetated treatment swale to treat storm runoff
originating from Village Parkway. The treatment measures will remove trash, sediment, oil, and
other pollutants from storm runoff and assist the City in meeting requirements of the new
Municipal Regional Permit for Stormwater issued by the San Francisco Bay Regional Water
Quality Control Board.
FINANCIAL IMPACT:
The total project cost identified for the Village Parkway Stormwater Treatment Project (CIP No.
969009) in the adopted Capital Improvement Program is $567,800. This project is funded by a
State Grant. In addition to the project cost the State has provided $80,000 maintained in a
separate fund to off-set future maintenance costs. The project budget includes $473,077 for
construction of the improvements including contingencies. The remaining appropriations are for
project design, inspection, administration and related costs. As of June 30, 2010 $36,678 had
been expended on design and project administration. Based on the low bid, including a 10%
construction contingency, the project will be under budget.

DESCRIPTION:
On June 22, 2010, the City Council approved the Five-Year Capital Improvement Program (CIP)
for Fiscal Years 2010-2015, which included the Village Parkway Stormwater Treatment Project
(CIP No. 969009). Staff has included a map showing the location(s) of the proposed work
(Attachment 1).
A total of four (4) bids were received on August 31, 2010. Bid results are as follows:

The apparent low bid of $231,460 was submitted by MDF Pipelines. Following the bid opening,
it was learned that the apparent low bidder had failed to bid the project on the required
specifications, instead identifying a proposed alternate treatment product in place of the units
specified in the bid document, and had based his bid on the lower cost of providing these units.
Following review, the City Attorney has determined that the bid is non-responsive because it
does not conform to the scope of work outlined in the bid documents and, furthermore,
acceptance of a bid based on a non-conforming scope of work provides a competitive
advantage not available to the other bidders. The second low bid was in the amount of
$294,112.50, submitted by Gradetech, Inc., and has been found to be responsive. Staff has
checked references and necessary licenses, and recommends that the City Council adopt the
Resolution (Attachment 2) awarding Contract No. 10-08, Village Parkway Stormwater
Treatment Improvements to Gradetech, Inc. as the lowest responsive bidder.
Staff expects the project to begin early October and anticipates completion of the majority of the
improvements by early-December, 2010.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
1) The City will mail notices to residents and businesses affected by the upcoming
stormwater improvements following award of the construction contract.
2) As required by the specification, the Contractor will notify all affected residents and
businesses one week in advance of the stormwater improvements.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

AWARDING CONTRACT NO. 10-08,
VILLAGE PARKWAY STORMWATER TREATMENT IMPROVEMENTS TO GRADETECH,
INC.
WHEREAS, the City of Dublin did, on August 31, 2010, publicly open, examine, and
declare all sealed bids for doing the work described in the approved Plans, Specifications, and
Modifications for Contract No. 10-08, Village Parkway Stormwater Treatment Improvements,
which Plans, Specifications, and Modifications are hereby expressly referred to for a description
of said work and for all particulars relative to the proceedings under the request for bids; and
WHEREAS, said bids were submitted to the Public Works Director, who has
recommended that the bid hereinafter is the lowest and best responsive bid for doing said work;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does
hereby award Contract No. 10-08, Village Parkway Stormwater Treatment Improvements, to the
lowest responsible bidder therefore, to wit, Gradetech, Inc., at a bid of Two Hundred and Ninety
Four Thousand, One Hundred and Twelve Dollars, and 50 Cents ($294,112.50), the particulars
of which bid are on file in the Office of the Public Works Director.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute the
Agreement.
PASSED, APPROVED AND ADOPTED this 21 st day of September, 2010, by the
