Foss, City Manager " SUBJECT: Acceptance of Tract Improvements for Tract 8093 — Brannigan Street; and Approval of Regulatory Traffic Control Devices and Traffic Signal Modifications at Brannigan Street and Gleason Drive (Lennar Homes of California, Inc.) Prepared by Jayson Imai, Senior Civil Engineer EXECUTIVE SUMMARY: Lennar Homes of California has constructed the public and private improvements for Tract 8093 in accordance with their Tract Improvement Agreement. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: Lennar Homes of California has provided a Warranty Bond (Bond No. 387888M) in the amount of $216,000.00, issued by Platte River Insurance Company, to guarantee the private improvements associated with Tract 8093 for one year; and a Warranty Bond (Bond No. CMS0270318-M) in the amount of $36,000.00, issued by RLI Insurance Company, to guarantee the public improvements associated with Tract 8093 for one year. Upon acceptance of the improvements, the City will incur nominal annualized maintenance costs estimated to be $620 for street sweeping, slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years) due to the small area of public improvement since all in-tract streets are private. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Accepting the Tract Improvements, Approving the Traffic Signal Modifications, and Approving Regulatory Traffic Control Devices Installed with Tract 8093, Brannigan Subdivision. ubmitte` By Reviewed By Public Works Director Assistant City Manager Page 1 of 2 ITEM NO. 4.3 DESCRIPTION: Lennar Homes of California, Inc. entered into a Tract Improvement Agreement with the City of Dublin on February 19, 2013, for the construction of street and other tract improvements associated with Tract 8093, also known as the Brannigan Subdivision. These improvements included construction of streets internal to Tract 8093, including Brodie Way and Osborne Circle; widening of Brannigan Street from Brodie Way to Gleason Drive; and traffic signal modificaiions at the intersection of Gleason Drive and Brannigan Street. Lennar Homes of California provided Faithful Performance Bonds and Labor & Materials Bonds to guarantee construction of these public and private improvements. The tract improvements are now complete and the developer is requesting that the bonds for this work be released. The warranty bond amounts are equal to twenty five percent (25%) of the full cost to construct the improvements. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: • Traffic signal modifications at the intersection of Gleason Drive and Brannigan Street NOTICING REQUIREMENTS/PUBLIC OUTREACH: A copy of this staff report has been sent to Lennar Homes of California. Resolution Accepting the Tract Improvements, Approving the Traffic Signal Modifications, and Approving Regulatory Traffic Control Devices Installed with Tract 8093, Brannigan Subdivision Page 2 of 2 Ls NVOINNYBo a as vavrvssvl Y — — vt w s= wu0 DD 4 W Q I I III - w 0 I I III II F p Z I _ I I W I I - I I I� I I I I I 5 I O F-1 I I F III C4 I L1 �, no IIII�III U I1 w p F IIII I I I cv �I � I All IZ s m AVA/ TJQO'dH BRODIB WAY I I i awl I ens �wRr�xz � oixa I I II I II II a I I / oz � I I I I I __________________----------------- --- --- gARIQ NOSYqZJ RESOLUTION NO. - 15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING THE TRACT IMPROVEMENTS, APPROVING THE TRAFFIC SIGNAL MODIFICATIONS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES INSTALLED WITH TRACT 8093, BRANNIGAN SUBDIVISION WHEREAS, Lennar Homes of California, Inc., a California Corporation, the developer of Tract 8093, previously entered into a Tract Improvement Agreement dated February 19, 2013, Resolution No. 15-13, with the City of Dublin, to complete tract improvements associated with Tract 8093, including public improvements along Brannigan Street and traffic signal modifications at the intersection of Gleason Drive and Brannigan Street, in accordance with plans on file with the City Engineer; and WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor and Materials Bond, each in the amount of $864,000.00 to guarantee the installation of Tract 8093 private improvements; and WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor and Materials Bond, each in the amount of $144,000.00 to guarantee the installation of Tract 8093 public improvements; and WHEREAS, the public and private improvements are now complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer, and WHEREAS, the traffic signal modifications at the intersection of Gleason Drive and Brannigan Street are complete in accordance with said plans and any approved modifications thereto to the satisfaction of the City Engineer; and WHEREAS, the Faithful Performance Bonds and Labor and Materials Bonds can be released, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, "Manner of Release of the Security," and replaced with a Maintenance Bond to guarantee the completed work for a one-year period; and WHEREAS, Lennar Homes of California, Inc. has provided a Warranty Bond in the amount of $216,000.00, issued by Platte River Insurance Company (Bond No. 387888M) to guarantee the Tract 8093 private improvements for a one-year period; and WHEREAS, Lennar Homes of California, Inc has provided a Warranty Bond in the amount of $36,000.00, issued by RLI Insurance Company (Bond No. CMS0270318-M) to guarantee the Tract 8093 public improvements for a one-year period; and WHEREAS, the traffic signal modifications at the intersection of Gleason Drive and Brannigan Street is a regulatory traffic control device; 1 NOW, THEREFORE, BE IT RESOLVED that: 1. The private improvements for Tract 8093 are hereby approved and accepted subject to a one-year guarantee period. 2. The submitted Warranty Bond issued by Platte River Insurance Company in the amount of $216,000.00 (Bond No. 387888M) for the private improvements for Tract 8093, be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 21St day of April, 2016. 3. The original Faithful Performance Bond issued by Developers Surety and Indemnity Company (Bond No. 387888S) in the amount of $864,000.00 for the Tract 8093 private improvements be released. 4. The original Labor and Materials Bond issued by Developers Surety and Indemnity Company (Bond No. 387888S) in the amount of $864,000.00 for the Tract 8093 private improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 5. The public improvements for Tract 8093 are hereby approved subject to a one- year guarantee period. 6. The submitted Warranty Bond issued by RLI Insurance Company in the amount of $36,000.00 (Bond No. CMS0270318-M) for the public improvements for Tract 8093, be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 21St day of April, 2016. 7. The original Faithful Performance Bond issued by RLI Insurance Company (Bond No. CMS0270318) in the amount of $144,000.00 for the Tract 8093 public improvements be released. 8. The original Labor and Materials Bond issued by RLI Insurance Company (Bond No. CMS0270318) in the amount of $144,000.00 for the Tract 8093 public improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 9. The regulatory traffic control devices installed by the developer within the City's right-of-way are hereby included in the City of Dublin Traffic Code, and said regulatory devices to include the following: • Traffic signal modifications at the intersection of Gleason Drive and Brannigan Street PASSED, APPROVED AND ADOPTED this 21st day of April, 2015, by the following vote: AYES- 2 NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk 3
