FINANCIAL IMPACT: This Amendment will extend the Agreement with MCE Corporation by two years to June 30, 2012. Funds will be budgeted in the Fiscal Years 2010-2011 and 2011-2012 Operating Budgets to cover MCE's operational costs. RECOMMENDATION: Adopt the Resolution approving the Amendment to the Agreement with MCE Corporation for Public Works Maintenance Services. Subm By Assistant City Manager Reviewed By City Manager Page 1 of 2 ITEM NO. ~• 3 DESCRIPTION: On June 23, 2009, the City Council approved aone-year Agreement with MCE Corporation for Public Works Maintenance Services (Attachment 1). This Agreement provides for the following categories of work: • Bike Path Maintenance • Building Management and Maintenance ~ • Curb, Gutter, and Sidewalk (emergency or temporary repair) • Drainage Maintenance • Guardrail Repair • Park Maintenance • Sign Installation, Repair & Maintenance • Spill Cleanup • Storm Patrol/Cleanup • Street Landscaping Maintenance • Street Repair (emergency or temporary repair) • Street Tree Maintenance • Striping and Marking (emergency replacement) • Weed Abatement The current Agreement ends June 30, 2010. Due to the recent resignation of the Public Works Director and the current economic climate, it is proposed to extend the current agreement by two years to June 30, 2012 to allow the new Public Works Director an opportunity to review the MCE's current operations and to prepare the necessary review of contract services. The two- year contract extension will also allow MCE appropriate time to establish maintenance of new facilities and parks in the upcoming year such as Heritage Park and Fallon Sports Park. The City has contracted with MCE Corporation for various maintenance services since 1984. MCE has provided exceptional service to the City throughout the years. In addition to the above list of services, MCE has provided support services for City events such as St. Patrick's Day Festival and responded to emergencies such as the gas spill near Dublin High School. MCE also recently donated 300 hours to support City infrastructure projects. MCE Corporation worked diligently during the FY 2009-2010 budget process to reduce their contract by 10% during these difficult economic times and MCE is working with Staff to find new ways to possibly further reduce their contract costs for Fiscal Year 2010-2011 while minimizing any loss in the City's infrastructure condition and service levels. Staff is recommending that the City Council adopt the proposed resolution (Attachment 2) extending the MCE contract through June 30, 2012. It is proposed to extend the current agreement by one year to June 30, 2010. MCE Corporation worked diligently during this budget process to reduce services by 10% during these difficult economic times. MCE Corporation's innovation in finding ways to reduce services for Fiscal Yeaz 2009-2010 without losing ground on infrastructure condition was commendable. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution approving the Amendment to the Agreement with MCE Corporation for Public Works Maintenance Services. Page 2 of 2 3 .- ~ RESOLUTION NO. - 09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AMENDMENT TO AGREEMENT WITH MCE CORPORATION FOR PUBLIC WORKS MAINTENANCE SERVICES WHEREAS, on October 3, 2006, the City Council approved an Agreement with MCE Corporation for Public Works Maintenance Services; and WHEREAS, the term of said Agreement expires on June 30, 2009; and WHEREAS, CITY and MCE Corporation desire to extend the term of said Agreement by one year to expire on June 30, 2010; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the Amendment to the Agreement with MCE Corporation, attached hereto as "Exhibit A," with an effective date of July 1, 2009. BE IT FURTHER RESOLVED that the Mayor is authorized to execute the amendment. EXTENSION OF CONTRACT. The City of Dublin extends the Agreement Between City of Dublin and MCE Corporation, Inc., for a period of one year, commencing on July 1, 2009, and ending on June 30, 2010. Section 2. TERMS OF CONTRACT. The existing Agreement remains in effect except as specifically modified herein.
