FINANCIAL IMPACT: The adopted General Fund budget for Capital Project 950002 is $46,505, which includes $760 for project administration and $45,745 for improvements and installation. A portion of the project cost ($25,000) is being funded from a safety grant distributed by the City's liability insurance program (Association of Bay Area Governments Pooled Liability Assurance Network - ABAG PLAN). J o~ DESCRIPTION: Included in the approved 2008-2013 Capital Improvement Program is a project to replace one play structure at Emerald Glen Park in Fiscal Year 2009/2010. The play structure designed for 2-5 year olds is located near the water play feature at Emerald Glen Park. The current metal equipment has corrosion and presents an on-going maintenance and safety issue. The project will remove the existing equipment and install a similar structure that color matches the adjacent play equipment. Local government agencies can participate in an agreement with the U.S. Communities Government Purchasing Alliance. U.S. Communities is a partner with the League of California Cities and serves agencies nationwide. As the installation is a public project subject to the Public Contract Code, the City's Purchasing Ordinance (Chapter 2.36) does not apply. By piggybacking on the U.S. Communities bid, the City is able to comply with the public bidding requirements of the California Public Contract Code. In purchasing through this program the City realizes a 6% savings in the catalog list price for equipment. Cooperative purchases such as this program is a more efficient method to make purchases, as opposed to each agency separately bidding the project. The replacement project is being funded from the General Fund and $25,000 of the project cost will be offset from a safety grant disbursed by the City's liability insurance provider (ABAG PLAN). Although the U.S. Communities bid included installation, for various reasons, Landscape Structures and Staff believe that it is more appropriate for the City to contract directly with Landscape Structures certified installer, Ross Recreation Equipment. As this work is incidental to the publicly bid purchase of the playground equipment, the Public Contract Code does not require public bidding. As shown in the Financial Impact the cost for installation will be no more than $12,868. NOTICING REQUIREMENTS/PUBLIC OUTREACH: None ATTACHMENTS: 1. PURSUANT TO THE U.S. COMMUNITIES GOVERNMENT PURCHASING AGREEMENT, AND TO CONTRACT WITH ROSS RECREATION EQUIPMENT INC. FOR THE REMOVAL AND INSTALLATION OF PLAY EQUIPMENT WHEREAS, the City of Dublin requires the replacement of play equipment at Emerald Glen Park; and WHEREAS, Landscape Structures Inc. has a valid pricing agreement publicly bid and administered by US Communities Government Purchasing Alliance; and WHEREAS, the City's Purchasing Ordinance (Chapter 2.36 of the Dublin Municipal Code) does not apply to public projects that are subject to the Public Contract Code; WHEREAS, the Public Contract Code allows public agencies to rely upon a competitive bid process administered by another public agency; and WHEREAS, the US Communities agreement meets the requirement for public bids; and WHEREAS, the estimated cost of the play equipment pursuant to the US Communities contract is $31,147.03; and WHEREAS, the installation of the playground equipment is incidental to the City's purchase of the playground equipment through the publicly bid play equipment purchase, and therefore the Public Contract Code does not require public bidding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that 1. The City Manager is authorized to procure play equipment for Emerald Glen Park, under a purchasing agreement publicly bid by US Communities Government Purchasing Alliance at a purchase cost of $31,147.03. 2. The City Manager is authorized to contract with Ross Recreation Equipment Inc., an authorized installer for Landscape Structures Equipment, for the removal of existing equipment and installation of new playground equipment at a cost not to exceed $12,868.
