SUBJECT: Acceptance of Tract Improvements for Tract 7282 — Sonata; and Approval of
Regulatory Traffic Control Devices (Lennar Homes of California, Inc.)

EXECUTIVE SUMMARY:
Lennar Homes of California has constructed the public and private improvements for Tract
7282, in accordance with their Tract Improvement Agreement. It is now appropriate for the City
Council to accept these improvements and approve the regulatory traffic control devices.
FINANCIAL IMPACT:
Lennar Homes of California has provided a Warranty Bond (Bond No. SU5024135-M) in the
amount of $80,250.00, issued by Arch Insurance Company to guarantee the in-tract
improvements associated with Tract 7282 for one year. Upon acceptance of the improvements,
the City will incur annualized maintenance costs estimated to be $31,160 for street lighting,
street sweeping, slurry seal (every five years) and asphalt concrete pavement overlay (every 20
years).
RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution Accepting the Tract
Improvements and Approving Regulatory Traffic Control Devices Installed with Tract 7282,
Sonata.

DESCRIPTION:
Lennar Homes of California, Inc. entered into a Tract Improvement Agreement with the City of
Dublin on November 6, 2007, for the construction of street and other tract improvements
associated with Tract 7282, also known as the Sonata subdivision. These improvements
included construction of streets internal to Tract 7282, including Brodie Way, Edgecomb Court,
Trescott Court, Houlton Court, Houlton Street, Colchester Lane, Colchester Court, Shelton
Street, and Thomclike Lane; construction of improvements on Brannigan Street from Kohnen

Way to Gleason Drive; installation of traffic signal at the intersection of Brannigan Street and
Gleason Drive; installation of common area landscaping; and construction of the Gleason Drive
median landscaping improvements. Lennar Homes of California provided Faithful Performance
Bonds and Labor & Materials Bonds to guarantee construction of these public and private
improvements.
The improvements on Brannigan Street and traffic signal at the intersection of Brannigan Street
and Gleason Drive were previously accepted by City Council on November 6, 2007 with City
Council Resolution No. 195-07. The common area landscaping was previously accepted by
City Council on November 16, 2010 by City Council Resolution No. 161-10. The Gleason Drive
median landscaping improvements were also previously accepted by City Council on April 7,
2009 by City Council Resolution No. 34-09.
The remainder of tract improvements is now complete and the developer is requesting that the
bonds for this work be released.

Lennar Homes of California has provided a Warranty Bond for the Tract 7282 Improvements in
the amount of $80,250.00 (Bond No. SU5024135-M) issued by Arch Insurance Company). The
warranty bond amount is equal to twenty five percent (25%) of the full cost to construct the
improvements.
The following regulatory traffic control devices will be accepted and approved as part of this
project and added to the City of Dublin Traffic Code:
• "No Parking" signs at:
o north side Kohnen Way between Brannigan Street and Grafton Street
• both sides of Houlton Court
• both sides of Colchester Court
• both sides of Edgecomb Court
• "No Stopping" signs at both sides of Kohnen Way between Brannigan Street and
Grafton Street
• "STOP" signs and markings installed at the following locations:
o Brodie Way at intersection of Brannigan Street
• Brodie Way at intersection of Houlton Street/ Houlton Court
• Trescott Court at intersection of Brodie Way
• Edgecomb Court at intersection of Houlton Street
• Shelton Street at intersection of Colchester Lane
• Shelton Street at intersection of Kohnen Way
• Thorndike Lane at intersection of Colchester Court/ Colchester Lane
• Thorndike Lane at intersection of Kohnen Way
• Kohnen Way at intersection of Grafton Street
• Both sides of Kohnen Way between Shelton Street and Thorndike Lane

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING THE TRACT IMPROVEMENTS AND APPROVING
REGULATORY TRAFFIC CONTROL DEVICES INSTALLED WITH TRACT 7282, SONATA
WHEREAS, Lennar Homes of California, Inc., a California Corporation, the developer of
Tract 7282, previously entered into a Tract Improvement Agreement dated November 6, 2007,
Resolution No. 195-07, with the City of Dublin, to complete in-tract improvements for Tract
7282, common landscaping areas, public improvements along Brannigan Street between
Kohnen Way and Gleason Drive, median landscaping improvements at Gleason Drive, and
traffic signal at the intersection of Gleason Drive and Brannigan Street, in accordance with
plans on file with the City Engineer; and
WHEREAS, the public improvements along Brannigan Street between Kohnen Way and
Gleason Drive, and the traffic signal at the intersection of Brannigan Street and Gleason Drive
were previously accepted on November 6, 2007 by City Council Resolution No. 195-07; and
WHEREAS, the Gleason Drive median landscaping improvements to be constructed with
Tract 7282 were previously accepted on April 7, 2009 by City Council Resolution No. 34-09;
and
WHEREAS, the common landscaping improvements to be constructed with Tract 7282
were previously accepted on November 16, 2010 by City Council Resolution No. 161-10; and
WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor
and Materials Bond, each in the amount of $321,000.00 to guarantee the installation of In-Tract
Improvements for Tract 7282; and
WHEREAS, the in-tract improvements for Tract 7282 are now complete in accordance
with said plans, and any approved modifications thereto, to the satisfaction of the City
Engineer; and
WHEREAS, the Faithful Performance Bonds and Labor and Materials Bonds can be
released, in accordance with the authority contained in Section 66499.7 of the Government
Code of the State of California, "Manner of Release of the Security," and replaced with a
Warranty Bond to guarantee the completed work for a one-year period; and
WHEREAS, Lennar Homes of California, Inc. has provided a Warranty Bond in the
amount of $80,250.00, issued by Arch Insurance Company (Bond No. SU5024135-M) to
guarantee the Tract 7282 improvements for a one-year period; and
WHEREAS, certain traffic regulatory devices have been installed at Kohnen Way, Brodie
Way, Edgecomb Court, Trescott Court, Houlton Street, Houlton Court, Colchester Lane,
Colchester Court, Shelton Street, and Thorndike Lane;

NOW, THEREFORE, BE IT RESOLVED that:
1. The in-tract improvements for Tract 7282 are hereby approved and accepted
subject to a one-year guarantee period.
2. The submitted Warranty Bond issued by Arch Insurance Company in the amount
of $80,250.00 (Bond No. SU5024135-M) for the in-tract improvements for Tract
7282, be accepted as security for the aforesaid one-year warranty period, said
period to commence on this date and terminate on the 21St day of April, 2016.
3. The original Faithful Performance Bond issued by Arch Insurance Company
(Bond No. SU5024135) in the amount of $321,000.00 for the In-Tract
Improvements for Tract 7282 be released.
4. The original Labor and Materials Bond issued by Arch Insurance Company (Bond
No. SU5024135) in the amount of $321,000.00 for the In-Tract Improvements for
Tract 7282 be released in accordance with the requirements of Section 66499.7
of the Government Code of the State of California.
5. The regulatory traffic control devices installed by the developer within the City's
right-of-way are hereby included in the City of Dublin Traffic Code, and said
regulatory devices to include the following:
• "No Parking" signs at:
o north side Kohnen Way between Brannigan Street and Grafton
Street
• both sides of Houlton Court
• both sides of Colchester Court
• both sides of Edgecomb Court
• "No Stopping" signs at both sides of Kohnen Way between Brannigan
Street and Grafton Street
• "STOP" signs and markings installed at the following locations:
o Brodie Way at intersection of Brannigan Street
• Brodie Way at intersection of Houlton Street/ Houlton Court
• Trescott Court at intersection of Brodie Way
• Edgecomb Court at intersection of Houlton Street
• Shelton Street at intersection of Colchester Lane
