EXECUTIVE SUMMARY:
The 2016 Annual Street Overlay Program is included in the Capital Improvement Program
adopted by the City Council. This year's project will provide an asphalt concrete overlay of
Tassajara Road from the 1 -580 off -ramp to North Dublin Ranch Drive. The project includes the
installation of an asphalt rubber overlay, repair of failed segments of the roadway, installation of
new traffic signal detection loops and pavement markings, and modifications to comply with
Americans With Disabilities Act.
FINANCIAL IMPACT:
The estimated total cost of the improvement project is approximately $2.33 million, which
requires an additional budget appropriation of $90,000 from the Noise Mitigation Fund and
$181,000 from the Gas Tax Fund, for a total appropriation of $271,000 to the 2016 Annual
Street Overlay Program (CIP No. ST5016).
The amount of the lowest responsive bid was $1,822,890.65. A 10% construction contingency
in the amount of $182,000.00 is requested for unforeseen construction issues, bringing the total
construction contract cost to $2,004,890.65.
RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution Approving the Plans and
Specifications, Waiving a Minor Bid Irregularity, and Awarding a Contract for Project No.
ST5016 to O'Grady Paving, Inc. for the Tassajara Road Overlay Project; and approve the
Budget Change.

DESCRIPTION:
The Tassajara Road Overlay Project includes the design and construction of a rubberized
asphalt overlay of Tassajara Road from the 1 -580 off -ramp to North Dublin Ranch Road. This
segment of roadway is a heavily used arterial road and is starting to show signs of asphalt
rutting and failure. Tassajara Road is an ideal candidate for an overlay, before the road
deteriorates further and becomes more costly to repair. An asphalt rubber overlay provides a
quieter driving surface, is more flexible, and will increase the durability of the roadway. The
construction was planned by staff to be performed during summer 2016 while the culvert at the
north end of Tassajara Road is being replaced and the road is closed to traffic coming from and
going into Contra Costa County. The reduction of pass- through traffic results in less traffic for
the overlay contractor to contend with, and shorter construction - related delays to Dublin
residents.
The plans and specifications for the Tassajara Road Overlay Project were completed and the
project was advertised for bids in the beginning of May 2016. The project improvements will
include but are not limited to: asphalt overlay, repairs to failing pavement, pavement markings;
traffic signal loop detectors, and curb ramp upgrades to comply with Americans with Disabilities
Act (ADA). This project is exempt under Section 15301 (Existing Facilities) of the CEQA
Guidelines.
Due to daytime traffic congestion and the Caltrans permit requirements for the work near 1 -580,
the project will include night work. The limits of night work will be from 1 -580 to approximately
400 feet north of the Dublin Boulevard intersection, as shown on the Location Map
(Attachment 1). The night work activities will include asphalt paving, grinding, installation of
traffic loop detectors, and adjusting utilities to grade. The remainder of the work will be
performed during the day.
A total of three sealed bids were received on June 2, 2016, ranging from $1,822,890.65 to
$2,031,179.00 (bid summary provided as Attachment 2). The low bid of $1,822,890.65 was
submitted by O'Grady Paving Inc. This bid contained an arithmetic error between an item unit
cost for traffic loop detectors and the extension of that unit cost, which subsequently adjusted
the total base bid price by $4,450. However, the Public Contract Code requirements and the
City's bid documents define this as a "minor bid irregularity," and authorize the City to waive this
irregularity and proceed with the award of the contract.
Staff has reviewed the bid results, checked references and necessary licenses, and
recommends that the City Council adopt the Resolution (Attachment 3) awarding the contract to
O'Grady Paving Inc. as the lowest responsive bidder. To facilitate the approval of contract
change orders and to avoid construction delay, it is requested that the City Manager be
authorized to approve change orders up to the contingency amount of $182,000.00 The
Resolution will authorize this change as it relates to this Project.
Staff expects the project to begin in July and anticipates completion of the majority of the
improvements by mid - September 2016.
Project Budget:
The total estimated cost for the improvement project is approximately $2.33 million. The
approved budget for the 2016 Annual Street Overlay Program is $665,233. In order to complete
this project, which is larger than past annual overlay projects, and to take advantage of lower
traffic volumes due to the road closure to the north, staff recommends using the budget from the

2016 Annual Slurry Seal Program (ST5116) and the remaining available budget from both the
2015 Annual Slurry Seal Program (ST5115) and the 2015 Annual Street Overlay (ST5015) to
fund this year's overlay. Staff also recommends shifting $86,000 of CalRecycle grant funding
from the Dougherty Road Improvements project (ST0911) to the annual overlay because the
grant funds must be expended by April 1, 2017, which likely would not happen on Dougherty
Road based on the project schedule.
In addition to using available budgets from the other pavement maintenance projects and the
CalRecycle grant, Staff recommends a budget appropriation of $90,000 from the Noise
Mitigation Fund and $181,000 from the Gas Tax Fund for a total appropriation of $271,000 to
the 2016 Annual Street Overlay Program (CIP No. ST5016). A summary of the proposed project
adjustments on the Budget Change Form (Attachment 4) is shown as follows:

NOTICING REQUIREMENTS /PUBLIC OUTREACH:
As required by the specification, the Contractor will notify all affected residents and businesses
one week as well as 24 hours in advance of the overlay improvements.

RESOLUTION NO. XX- 16
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING THE PLANS AND SPECIFICATIONS, WAIVING A MINOR BID IRREGULARITY,
AND AWARDING A CONTRACT FOR PROJECT NO. ST5016 TO O'GRADY PAVING, INC.
FOR THE TASSAJARA ROAD OVERLAY PROJECT.
WHEREAS, Staff completed plans and specifications for the Tassajara Road Overlay Project,
Project No. ST5016 ( "Project "). The Project includes an asphalt overlay, repairs to failing pavement,
pavement markings; traffic signal loop detectors, and requirements to comply with Americans with
Disabilities Act (ADA).
WHEREAS, the City of Dublin did, on June 2, 2016, publicly open, examine, and declare all
sealed bids for doing the work described in the approved Plans, Specifications, and Modifications for
Project No.ST5016, Tassajara Road Overlay Project, which Plans, Specifications, and Modifications are
hereby expressly referred to for a description of said work and for all particulars relative to the
proceedings under the request for bids; and
WHEREAS, O'Grady Paving, Inc.'s bid contained a minor bid irregularity in that there was a
mathematic error decreasing the proposed contract price by $4,450.00 (Four Thousand Four Hundred
and Fifty Dollars) and the Public Contract Code and the City's bid documents authorize the City to
waive any minor irregularity and proceed with the award of the contract; and
WHEREAS, said bids were submitted to the Public Works Director, who has recommended that
the bid hereinafter is the lowest and best bid for doing said work; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby
approves the plans and specifications for the Project.
BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby waive the
minor bid irregularity since the mathematical error only decreased the lowest responsible bid by Four
Thousand Four Hundred and Fifty Dollars ($4,450.00).
BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby award the
Contract for Project No. ST5016, Tassajara Road Improvements, to the lowest responsible bidder
therefore, to wit, O'Grady Paving, Inc., at a bid of One Million, Eight Hundred and Twenty Two
Thousand, Eight Hundred and Ninety Dollars and sixty -five Cents ($1,822,890.65), the particulars of
which bid are on file in the Office of the Public Works Director.
BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby authorize
the City Manager or his designee to approve the project Contract Change Orders based on the
appropriated funds designated for Project No. ST5016 up to the contingency amount of $182,000.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute the Agreement.
