(Braddock and Logan) and Acceptance of Parkland Dedication

EXECUTIVE SUMMARY:
Tract 7855, Neighborhood "C-3" of the Positano development in Fallon Village (owned by
Braddock and Logan) created 23 single family parcels.and 11 parcels for future resubdivision
and development. Braddock and Logan is filing Final Map 8051 to resubdivide Parcels A, B, C,
D, and E of Tract 7855. This action will create an additional 23 individual lots, with a single
family home on each lot.
FINANCIAL IMPACT:
Braddock and Logan Group II, L.P., has previously provided Performance and Labor &
Materials Bonds, to guarantee construction of the street, grading, utility improvements and
landscaping within Tract 7855, and will pay the cost of construction inspection. These
improvements are under construction and the bonds remain in place. Therefore, additional
security will not be required as part of this Final Map Once the improvements are accepted,
the City will incur maintenance costs for City-maintained improvements within Tract 7855. The
Homeowners' Association will be responsible for maintaining the project landscape features
within the public right-of-way.
Parkland dedication requirements are proposed to be satisfied with a combination of
Community Park Land fees totaling $233,910 and Neighborhood Park Land credits.
RECOMMENDATION:
Staff recommends that the City Council: 1) Adopt the Resolution Approving the Final Map for ,
Tract 8 1, Neigh orhood "C-3", Positano/Fallon Village; and 2) Adopt the Resolution accepting
Parkla Dedicat' n Fee and Credits for Parkland edDedication Requirements for Tract 8051.

DESCRIPTION:
Tract 7855 was the subdivision map for the Neighborhood "C-3" portion of the Positano
Development within Fallon Village. The Final Map for Tract 7855 dedicated the rights-of-way
for Amantea Way, Avellina Drive, Brandini Drive, Cipriani Way, Encanto Way, Castello Court,
La Strada Drive, Lattari Street, Moorjani Street, Ravello Way, and Valentano Drive. The Final
Map, in addition to creating 23 individual lots, also created 11 parcels for future resubdivision.
Subsequently, Parcels F, G, H and I were resubdivided under Tract 8050.
Braddock and Logan is filing Final Map 8051 to resubdivide Parcels A, B, C, D, and E to create
an additional 23 individual lots. Single family homes will be constructed on each lot.

The remaining two parcels of Tract 7855 (Parcels J and K) will be resubdivided at a future date.
The Final Map for Tract 8051 has been reviewed and found to be in conformance with the
Tentative Map and Conditions of Approval adopted by Planning Commission Resolution No.
05-61 on November 22, 2005. Braddock and Logan previously executed an improvement
agreement for the adjoining street improvements when Tract 7855 was filed, and guaranteed
the improvements through bonds; consequently, there is no need for Braddock and Logan
to execute an improvement agreement or provide bonds with the Final Map for Tract 8051. The
resolution approving the final map for Tract 8051 is attached (Attachment 2).
Parkland Dedication Repuirements
Pursuant to Dublin Municipal Code Chapter 9.28, a subdivider is required to dedicate park land
or pay a fee in lieu of dedicating such land as a condition of final map approval. Staff has
prepared a Resolution which outlines the requirements and how Braddock & Logan Group II, LP
will achieve compliance (Attachment 3).
Braddock & Logan holds Neighborhood Park Land credits, which will fully offset its
Neighborhood Park Land dedication requirements. The following table shows how Braddock &
Logan, LLC., will satisfy the Park Land dedication requirements for Tract 8051:

The calculation of the acreage required and/or in-lieu fees is determined in accordance with City
of Dublin Municipal Code Chapter 9.28.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Public noticing occurred as part of the Tentative Map process. Approval of the Final Map is
affirmation of the Final Map's concurrence with the approved Tentative Map. Copies of this
report have been provided to Braddock & Logan.

ACCEPTING PARKLAND DEDICATION CREDITS AND FEES
FOR PARKLAND DEDICATION REQUIREMENTS FOR TRACT 8051
WHEREAS, pursuant to City of Dublin Municipal Code Chapter 9.28, each subdivider of
land for residential uses shall, as a Condition of Approval of a Final Subdivision Map, dedicate or
reserve lands, pay fees in lieu thereof, or a combination of both, for park and/or recreational
purposes; and
WHEREAS, the Developer, Braddock and Logan Group II, L.P., a California Limited
Partnership by Braddock and Logan Services, Inc., a California Corporation, its General Partner,
is filing a Final Map for Tract 8051 for development of 23 residential dwelling units constructed on
23 lots; and
WHEREAS, the parkland requirements for the project, based on requirements of the
Municipal Code and the designated land use for Tract 8051 are: 1) Dedication of 0.2576 acres of
Community Parkland or payment of $233,910 in Community Parkland In-Lieu Fees, and
2) Dedication of 0.1104 acres Neighborhood Parkland or payment of $124,982 in Neighborhood
Parkland In-Lieu Fees; and
WHEREAS, Developer will satisfy the Community Parkland Dedication requirement
through the payment of in-lieu Park Dedication Fees in the amount of $233,910 to fully satisfy the
Community Park Land obligation for Tract 8051; and
WHEREAS, Braddock and Logan Group II, L.P. has deposited with the City of Dublin
$233,910 which is the full amount required to satisfy the obligation for Community Park Land In-
Lieu Fees for Tract 8051; and
WHEREAS, Developer will satisfy the Neighborhood Parkland Dedication requirement
through the use of Neighborhood Park Land credits for 0.1104 acres of, which the Developer
desires to have applied to fully satisfy the Neighborhood Park Land obligation for Tract 8051.
NOW, THEREFORE, BE IT RESOLVED that the aforesaid the payment of $233,910
Community Parkland in lieu fees and the application of 0.1104 acres of Neighborhood Park Land
credits are hereby accepted as pertormance of said subdivider's obligation under Subdivision
Requirements in Chapter 9.28 of the Dublin Municipal Code.
