To satisfy this requirement, the developer of the Jordan Ranch project petitioned the GHAD Board to annex the Jordan Ranch subdivision into the existing Fallon Village GHAD. The territory to be annexed pursuant to the Petition for Annexation is currently owned by the developer. The boundaries of the territory to be annexed and the boundaries of the Jordan Ranch subdivision are the same. Public Resources Code section 26581 states that a proposed annexation is subject to approval of the legislative body that approved the formation of the original GHAD. Since the City Council approved the formation of the Fallon Village GHAD, approval of the City Council is now necessary for the proposed annexation of Jordan Ranch to the Fallon Village GHAD. FINANCIAL IMPACT: There is no immediate fiscal impact. Once the territory is annexed to the Fallon Village GHAD and a funding mechanism has been approved by the Board of Directors and affected property owners, the costs associated with the operation of the Fallon Village GHAD will be offset by assessments paid by property owners within the District. The proposed assessments are supported by a detailed Engineer's Report prepared by a registered professional engineer certified by the State of California, and will be considered at a subsequent date by the Fallon Village GHAD Board of Directors in accordance with Proposition 218. The members of the City Council serve as the Board of Directors of the District. On April 5, 2011, the Fallon Village GHAD Board of Directors adopted a Resolution 1-11 accepting the Petition for Annexation to annex the Jordan Ranch property to the Fallon Village GHAD. The petition was executed by the owner of 100 percent of the property proposed to be annexed to the Fallon Village GHAD. The Board of Directors adopted a resolution setting a public hearing and noticing by mail the owner of real property to be annexed to the Fallon Village GHAD at least finrenty (20) days before the May 3, 2011, hearing date. On May 3, 2011, if the GHAD Board of Directors approves the annexation of the Jordan Ranch prior to the City Council meeting, the City Council will be asked to consider approval of the annexation pursuant to Public Resources Code section 26581. NOTICING REQUIREMENTS/PUBLIC OUTREACH: A copy of the Staff Report was provided to Mission Valley Properties, owner of the Jordan Ranch Development. ATTACHMENTS: 1) Resolution Approving the Annexation of the Jordan Ranch Development (Tract 8024) into the Fallon Village Geologic Hazard Abatement District Staff Report Jordan Ranch GHAD Annexation Council Approval-redline Page 2 of 2 l~ DUBLIN CITY COUNCIL RESOLUTION NO. -11 RESOLUTION OF THE DUBLIN CITY COUNCIL *************************~******************* APPROVING THE ANNEXATION OF THE JORDAN RANCH DEVELOPMENT (TRACT 8024) INTO FALLON VILLAGE GEOLOGIC HAZARD ABATEMENT DISTRICT WHEREAS, on December 4, 2007, the City Council of the City of Dublin adopted Resolution No. 216-07 approving and ordering the formation of the Fallon Village Geologic Hazard Abatement District ("Fallon Village GHAD") and appointed itself to serve as the Board of Directors of the District; and WHEREAS, pursuant to the provisions of Division 17 of the Public Resources Code, a Petition of Annexation ("Petition") was filed with the GHAD Clerk, dated March 30, 2011, for the annexation of the Jordan Ranch development (Tract 8024) to the Fallon Village Geologic Hazard Abatement District ("GHAD" or "District"); and WHEREAS, on April 5, 2011, the GHAD Board of Directors adopted Resolution No. 1-11 accepting the Petition and setting a hearing on the filed Petition on May 3, 2011, at 7:00 pm; and WHEREAS, on May 3, 2011, the GHAD Board held a public hearing on the proposed annexation. At the time set for the hearing, the GHAD Board considered any written objection by any owner of real property within the proposed GHAD to its formation in accordance with the provision of Public Resources Code sections 26564 through 26566; and WHEREAS, at the hearing, the GHAD Board considered any objections of owners of real property within the proposed GHAD to the annexation thereof; and WHEREAS, on May 3, 2011, the GHAD Board closed the hearing and, by Resolution, approved the annexation of the Jordan Ranch Development (Tract 8024) to the Fallon Village GHAD, and approved and adopted the Jordan Ranch Development Annexation Plan of Control; and WHEREAS, the annexation into the Fallon Village GHAD is exempt from the provisions of the California Environmental Quality Act pursuant to Public Resources Code sections 21080(b)(4) and 26559; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that: Section 1. Pursuant to Public Resources Code section 26581, the Council hereby approves the annexation of the Jordan Ranch Development (Tract 8024) into the Fallon Village GHAD. Section 2.
