Award of Contract #12-13 / 12-14 for the Public Safety Complex and
Maintenance Yard Facilities Project

EXECUTIVE SUMMARY:
Staff is seeking City Council authorization to award Contract #12-13 / 12-14 for the Public Safety
Complex and Maintenance Yard Facilities. This project combines the improvements on two
sites; the City of Dublin / Alameda County Fire Joint Use Public Safety Complex at 6363 Clark
Ave and the Maintenance Yard Improvements at 5777 Scarlett Ct.
FINANCIAL IMPACT:
The 2012-2017 Capital Improvement Program (CIP), includes the Public Safety Complex
(Project number 930016) and the Maintenance Yard Improvements (Project number 930010)
which includes a total combined anticipated project expenditure for fiscal years 12/13 and 13/14
of $14,466,057 as reported to Council in the Fiscal Year 13/14 budget update. The following is
the cost for improvements:
Engineer’s Estimate (both projects) $10,000,000
Low Base Bid $10,077,375
Add Alternates:
Carpet Overstock $156,000
Energy Efficient Window Film $43,000
Recommended Low Bid $10,276,375
10% Contingency $1,027,638
Total Construction Cost $11,304,012
RECOMMENDATION:
Staff recommends that the City Council adopt Resolution Awarding Contract #12-13 / 12-14 for
the Public Safety Complex and Maintenance Yard Facilities to Midstate Construction.
(“Midstate”).

DESCRIPTION:
On April 16, 2013 the City Council authorized Staff to bid the construction of the Public Safety
Complex and the Maintenance Yard Facility, both of which are joint-use projects between the
City and Alameda County Fire Joint. The proposed improvements include:
Dublin Corporation Yard - Construction of a new metal clad building with training and
muster space, workshops and storage areas for the City’s maintenance operations, and
to consolidate City files now stored in leased space.
Alameda County Maintenance Yard – Repurpose existing metal building at the
Maintenance Yard and site for use as a Fire apparatus maintenance facility.
Alameda County Administrative Services - Construction of fourteen thousand square feet
of office space for Alameda County Fire Administrative Services at the Public Safety
Complex.
Add Alternates - Overstock carpet for the Public Safety Complex Fire Administration
Offices and the remainder of Dublin Civic Center, as well as energy efficient window film
for the office space areas.
On June 7, 2013 the City received seven bids for the project as follows:
1. Midstate Construction $10,077,375
2. Diede $10,130,000
3. Pacific Mountain $10,759,615
4. Aztec $11,551,000
5. Roebbelen $11,667,033
6. Amarosa $11,747,000
7. Vila Construction $11,922,783
Staff and the City Attorney reviewed the low bid from Midstate and found them to be the lowest
responsible and responsive bidder. Midstate has been in business for 78 years and nothing
negative came up during the background and license checks.
The bid for the project included an eleven page qualification questionnaire which required
answers related to licensing, labor violations, insurance, debarment, false claims, and bond
defaults. In addition the bid package required the contractor to sign affidavits showing that they
have sufficient worker’s compensation insurance and that they have never been debarred from
public work. The general conditions of the contract complies with the State’s public contract
code and enforces labor code requirements related to prevailing wage, proper monitoring, use
of apprentices, and payment of subcontractors and penalties for non-compliance. Staff has
reviewed Midstate’s bid proposal and find them to be in accordance with the requirements.

Attachment 1 is a Resolution awarding City of Dublin Alameda County Fire Joint Use Projects,
Contract #12-13 / 12-14, to Midstate Construction in the amount of $10,276,375.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Advertisement of project was listed as a public notice in the Tri-Valley Herald; in addition plans
and specifications were submitted to plan rooms throughout the Bay Area. A copy of the Staff
Report was sent to Midstate Construction.

PUBLIC SAFETY COMPLEX AND MAINTENANCE YARD FACILITIES PROJECT
TO MIDSTATE CONSTRUCTION
WHEREAS,
the 2012-2017 Capital Improvement Program Budget includes the Public Safety
Complex Project 12-13 (CIP # 930016) and The Maintenance Yard Improvement Project 12-14 (CIP#
930010); and
WHEREAS,
the City of Dublin did, on June 7, 2013, publicly open, examine and declare all
sealed bids for doing the work described in the approved Plans and Specifications for Contract No.
12-13/12-14, which Plans and Specifications are hereby expressly referred to for a description of said
work and for all particulars relative to the proceedings under the request for bids; and
WHEREAS,
said bids were submitted to the City Engineer, who has reviewed the bids to
determine the lowest bid which was responsive to the requirements of the bid documents; and
WHEREAS,
the apparent lowest bid for the Project was the bid of Midstate Construction, in the
amount of ten million two hundred seventy six thousand three hundred seventy five ($10,276,375);
and
WHEREAS,
Midstate is able to perform said project.
NOW, THEREFORE, BE IT RESOLVED
the City Council of the City of Dublin, does hereby
award Contract No. 12-13/12-14 to the lowest responsible bidder therefor, to wit, Midstate, at a bid of
$10,276,375 the particulars of which bid are on file in the office of the City Engineer.
