Call to Order and Pledge of Allegiance A regular meeting of the Dublin City Council was held on Tuesday, November 19, 2019, in the City Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:13 p.m. by Mayor Haubert. Oral Communications 3.1. Recognition of 2019 Inside Dublin Participants The City Council recognized the participants of the Inside Dublin program. 3.2. Proclamation Designating November 2019 as "Sikh American Awareness and Appreciation Month" The City Council presented the proclamation recognizing Sikh American Awareness and Appreciation Month. Proclamation in Recognition of Small Business Saturday (November 30, 2019) and Report on Holiday Decorating Contests The City Council presented the proclamation recognizing Small Business Saturday. Inge Houston, President/CEO Dublin Chamber of Commerce, provided public comment on this item. 3.4. Presentation from State Senator Steve Glazer and Assembly Member Rebecca Bauer-Kahan George Escutia, District Director for Sen. Steve Glazier, provided a legislative update. Assemblymember Rebecca Bauer-Kahan provided a legislative update. 3.5. Presentation on Dublin San Ramon Services District “State of the District” Maddie Misheloff, President of the Board of Dublin San Ramon Services District (DSRSD), presented an update on DSRSD. 3.6. Report on Public Safety Efforts This Holiday Season Dublin Police Chief Garrett Holmes provided information on the City’s public safety efforts this holiday season. 3.7. Public Comment Shawn Costello, Dublin resident, provided public comment. 4. Consent Calendar Items 4.5, Conduit Occupancy Agreement with Verizon for Use of City Conduit and Facilities in Gleason Drive, and 4.6, Valuation of Services and Agreement with Alameda County for Law Enforcement Services, were pulled for further discussion. Adopted RESOLUTION NO. 116-19 APPROVING AN AMENDMENT TO THE AGREEMENT WITH MARK THOMAS & COMPANY, INC., FOR THE IRON HORSE TRAIL BRIDGE AT DUBLIN BOULEVARD PROJECT RESOLUTION NO. 117-19 APPROVING AN AMENDMENT TO THE AGREEMENT WITH WESTERN PACIFIC SIGNAL, LLC 4.3. Adopted RESOLUTION NO. 118-19 AMENDING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF DUBLIN AND THE LIVERMORE AMADOR VALLEY TRANSIT AUTHORITY FOR THE SHARED AUTONOMOUS VEHICLE TESTING PROJECT. 4.4. Waived the reading and adopted ORDINANCE NO. 14-19 APPROVING AMENDMENTS TO DUBLIN ZONING ORDINANCE CHAPTER 8.52 (DENSITY BONUS REGULATIONS) DUBLIN CITY COUNCIL MINUTES 4 REGULAR MEETING NOVEMBER 19, 2019 Item 4.5 Conduit Occupancy Agreement with Verizon for Use of City Conduit and Facilities in Gleason Drive, on motion of Cm. Kumagai, seconded by Vm. Hernandez and by unanimous vote (Cm. Josey recusing herself), the City Council adopted RESOLUTION NO. 119-19 APPROVING A CONDUIT OCCUPANCY AGREEMENT WITH MCIMETRO ACCESS TRANSMISSION SERVICES CORP. Item 4.6 Valuation of Services and Agreement with Alameda County for Law Enforcement Services, on motion of Cm. Josey, seconded by Vm. Hernandez and by unanimous vote, the City Council adopted RESOLUTION NO. 120-19 APPROVING THE AGREEMENT BETWEEN THE COUNTY OF ALAMEDA AND THE CITY OF DUBLIN FOR LAW ENFORCEMENT SERVICES WITHIN THE CITY OF DUBLIN 5. Written Communication – None. 6. Public Hearing 6.1 Updates to the City of Dublin's Construction and Fire Codes in Accordance with Requirements of State Law Mayor Haubert opened the public hearing. There were no public comments made at this time. The Mayor closed the public hearing. On motion of Cm. Josey, seconded by Cm. Kumagai and by unanimous vote, the City Council adopted RESOLUTION NO. 122-19 APPROVING THE FINDING OF NECESSITY FOR AMENDMENTS TO THE 2019 CALIFORNIA BUILDING STANDARDS CODE DUBLIN CITY COUNCIL MINUTES 5 REGULAR MEETING NOVEMBER 19, 2019 Waived the second reading and adopted ORDINANCE NO. 15-19 REPEALING AND REPLACING CHAPTERS 5.08 (FIRE CODE), 7.28 (BUILDING REGULATION ADMINISTRATION CODE), 7.32 (BUILDING CODE), 7.34 (RESIDENTIAL CODE), 7.36 (ELECTRICAL CODE), 7.40 (PLUMBING CODE), 7.44 (MECHANICAL CODE), AND 7.94 (GREEN BUILDING CODE), OF THE DUBLIN MUNICIPAL CODE, IN ORDER TO ADOPT BY REFERENCE AND AMEND PROVISIONS OF THE 2019 EDITION OF THE CALIFORNIA BUILDING STANDARDS CODE, TITLE 24, CALIFORNIA CODE OF REGULATIONS AND REPEALING CHAPTER 7.48 (HOUSING CODE) AND ADOPTING CHAPTER 7.48 (BUILDING MAINTENANCE CODE), OF THE DUBLIN MUNICIPAL CODE, IN ORDER TO ADOPT BY REFERENCE AND AMEND PROVISIONS OF THE 2018 INTERNATIONAL PROPERTY MAINTENANCE CODE 7. By consensus, the City Council agreed to continue the item to the next City Council meeting of December 3, 2019, with a focus on open space within City boundary limits or contiguous to City boundary limits. There will be public comment allowed at that meeting. 8.2 Flavored Tobacco Prohibitions Shirley Lewandowski, Dublin resident, provided public comment. By consensus, the City Council directed Staff to return with an ordinance banning, within the City of Dublin, the sale of all flavored tobacco products, and also all electronic smoking devices. Also, bring back a report that catalogues all ideas of anti-tobacco type policies that the City can enact, and educational opportunities.
