RECOMMENDATION: Approve the minutes of the Regular City Council meeting of November 19, 2013. CONFERENCE WITH LEGAL COUNSEL--EXISTING LITIGATION (Paragraph (1) of subdivision (d) of Section 54956.9) Name of case: City of Dublin v. Croak Properties, LP, Alameda County Superior Court Case No. RG 13693063 II. CONFERENCE WITH LABOR NEGOTIATORS Agency designated representatives: Councilmember Hart and Councilmember Haubert Unrepresented employee: City Manager A regular meeting of the Dublin City Council was held on Tuesday, November 19, 2013, in the City Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:17 p.m., by Mayor Sbranti. ROLL CALL PRESENT: Councilmembers Biddle, Gupta, Hart, Haubert and Mayor Sbranti ABSENT: None PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the City Council, Staff and those present. REPORT ON CLOSED SESSION ACTION Mayor Sbranti stated there was no reportable action during Closed Session. By consensus, the City Council agreed to hear Item 3.5 directly after Item 3.1. DUBLIN CITY COUNCIL MINUTES 1 VOLUME 32 REGULAR MEETING NOVEMBER 19, 2013 ORAL COMMUNICATIONS Presentation by Congressman Eric Swalwell 7:18 p.m. 3.1 The City Council received an update on federal government policies and actions from Congressman Swalwell, via Skype. Recognition of Inside Dublin 2013 Participants 7:47 p.m. 3.2 The City Council recognized the Inside Dublin 2013 participants. 2013 Business Anniversary Awards 8:01 p.m. 3.3 The City Council recognized those businesses that have been in Dublin 20, 25, 30, 35, 40, 45 and 50 years. Proclamation Declaring “Cover Dublin Day” in Support of Covered California 8:0 7p.m. 3.4 The City Council proclaimed November 20, 2013 as “Cover Dublin Day.” Introduction of the Northstar Destination Strategies Team 7:42 p.m. 3.5 The City Council received the report from Northstar Destination Strategies Team. CONSENT CALENDAR 8:09 p.m. Items 4.1 through 4.5 The City Council pulled Items 4.2 and 4.5 for further discussion. On motion of Cm. Gupta, seconded by Vm. Biddle and by unanimous vote, the City Council took the following actions: Approved 4.1 Minutes of the November 5, 2013 Regular City Council Meeting; Adopted 4.3 RESOLUTION NO. 193 - 13 APPROVING A CONSULTING SERVICES AGREEMENT WITH PACIFIC MUNICIPAL CONSULTANTS (DBA PMC) FOR HOUSING SERVICES Received 4.4 a listing of payments issued from October 1, 2013 – October 31, 2013. Mayor Sbranti pulled Item 4.2, Approval of Final Map and Tract Improvement Agreement, Approval of Agreement for Long-Term Encroachment for Landscape Features, and Acceptance of Park Land Dedication In-Lieu Credits for Tract 7667, Esprit at Dublin Station (Western Pacific Housing, Inc.), for further discussion. On motion of Mayor Sbranti, seconded by Cm. Hart and by unanimous vote, the City Council adopted RESOLUTION NO. 190-13 ACCEPTING PARK LAND DEDICATION IN-LIEU CREDITS FOR PARK LAND DEDICATION REQUIREMENTS FOR TRACT 7667, ESPRIT AT DUBLIN STATION DUBLIN CITY COUNCIL MINUTES 3 VOLUME 32 REGULAR MEETING NOVEMBER 19, 2013 RESOLUTION NO. 192 - 13 APPROVING FINAL MAP AND TRACT IMPROVEMENT AGREEMENT FOR TRACT 7667, ESPRIT AT DUBLIN STATION RESOLUTION NO. 191 - 13 APPROVING AGREEMENT FOR LONG TERM ENCROACHMENT FOR LANDSCAPE FEATURES WITH TRACT 7667, ESPRIT AT DUBLIN STATION Cm. Hart pulled Item 4.5, Dublin Crossing: Zoning Ordinance Amendments and Development Agreement, for further discussion. On motion of Cm. Hart, seconded by Vm. Biddle and by unanimous vote, the City Council adopted ORDINANCE NO. 7 - 13 APPROVING ZONING ORDINANCE AMENDMENTS TO CREATE A NEW CHAPTER: 8.31 (DUBLIN CROSSING ZONING DISTRICT), REZONE PROPERTY WITHIN THE DUBLIN CROSSING SPECIFIC PLAN PROJECT AREA TO THE DUBLIN CROSSING ZONING DISTRICT, AMEND THE ZONING MAP TO IDENTIFY THE LOCATION OF THE NEW ZONING DISTRICT, AMEND ZONING ORDINANCE CHAPTER 8.12 (ZONING DISTRICTS AND PERMITTED USES), AND AMEND CHAPTER 8.104 (SITE DEVELOPMENT REVIEW) PA 08-049 and ORDINANCE NO. 8 - 13 APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF DUBLIN AND DUBLIN CROSSING VENTURE LLC RELATING TO THE DUBLIN CROSSING PROJECT PA 08-049 WRITTEN COMMUNICATIONS – None. DUBLIN CITY COUNCIL MINUTES 4 VOLUME 32 REGULAR MEETING NOVEMBER 19, 2013 PUBLIC HEARINGS Updates to the City’s Construction and Fire Codes in Accordance with Requirements of State Law 8:20 p.m. 6.1 Mayor Sbranti opened the public hearing. No comments were made by any members of the public. Mayor Sbranti closed the public hearing. On motion of Cm. Hart, seconded by Cm. Haubert and by unanimous vote, the City Council adopted RESOLUTION NO. 194-13 APPROVING FINDINGS REGARDING THE NEED FOR AMENDMENTS TO PROVISIONS IN THE CALIFORNIA BUILDING STANDARDS CODE AS ADOPTED BY THE STATE OF CALIFORNIA, IN THE CALIFORNIA CODE OF REGULATIONS, TITLE 24, TO BE ADOPTED BY REFERENCE IN THE DUBLIN MUNICIPAL CODE and, waived the reading and adopted ORDINANCE NO. 9-13 REPEALING CHAPTERS 5.08 (FIRE CODE), 7.32 (BUILDING CODE), 7.34 (RESIDENTIAL CODE), 7.36 (ELECTRICAL CODE), 7.40 (PLUMBING CODE), CHAPTER 7.44 (MECHANICAL CODE), AND 7.94 (GREEN BUILDING CODE) OF THE DUBLIN MUNICIPAL CODE; AND ADDING CHAPTERS 5.08 (FIRE CODE), 7.32 (BUILDING CODE), 7.34 (RESIDENTIAL CODE), 7.36 (ELECTRICAL CODE), 7.40 (PLUMBING CODE), CHAPTER 7.44 (MECHANICAL CODE), AND 7.94 (GREEN BUILDING CODE) OF THE DUBLIN MUNICIPAL CODE IN ORDER TO ADOPT BY REFERENCE AND AMEND PROVISIONS OF THE 2013 EDITION OF THE CALIFORNIA BUILDING STANDARDS CODE, TITLE 24, CALIFORNIA CODE OF REGULATIONS UNFINISHED BUSINESS Downtown Dublin Bikeway Connectivity Study Presentation 8:59 p.m. 7.1 Dave Campbell, Advocacy Director with East Bay Bicycle Coalition, provided public comment on this item. Kevin Dielissen, Dublin resident, provided public comment on this item. DUBLIN CITY COUNCIL MINUTES 5 VOLUME 32 REGULAR MEETING NOVEMBER 19, 2013 Kristi Marleau, Dublin resident, provided public comment on this item. Chris Fleckner, East Bay Bicycle Coalition Board member, provided public comment on this time. Swesh Puli, Dublin resident, provided public comment on this item. Donna Dielissen, Dublin resident, provided public comment on this item. By consensus, the City Council selected Alternative 4 for inclusion in the update of the Bikeways and Pedestrian Master Plan. Positano Hills Park – Site Modifications 11:03 p.m. 7.2 On motion of Cm. Hart, seconded by Vm. Biddle, the City Council approved the preferred option for Positano Hills Park Site modifications as shown in the Staff Report. NEW BUSINESS – None. OTHER BUSINESS 11:11 p.m. 9. Brief information only reports were provided by City Council and Staff, including committee reports and reports by City Council related meetings attended at City expense (AB1234). By consensus, the City Council asked Staff to return with a possible conditional use process for signage along 580 and 680. ADJOURNMENT 10.1 There being no further business to come before the City Council, the meeting was adjourned at 11:21 p.m. in memory of Staff Sgt. Sean Diamond and our fallen troops.
