Soto, City Clerk EXECUTIVE SUMMARY: The City Council will consider the approval of the minutes of the Regular City Council meeting of January 15, 2013. FINANCIAL IMPACT: None. RECOMMENDATION: Approve the minutes of the Regular City Council meeting of January 15, 2013. Draft Minutes of the January 15, 2013 Regular City Council Meeting ITEM NO. 4.1 Page 1 of 1 MINUTES OF THE CITY COUNCIL OF THE CITY OF DUBLIN REGULAR MEETING – JANUARY 15, 2013 7:05 p.m. Mayor Sbranti stated the meeting could not be officially called to order because there was not a quorum present. Cm. Hart would be absent as he was recovering from surgery. Cm. Haubert was expected to arrive at approximately 7:30 p.m. The official meeting would be called to order with Cm. Haubert’s arrival. A presentation was made by the Livermore Valley Winegrowers Association regarding a year in review. Cm. Haubert arrived at 7:14 p.m. A regular meeting of the Dublin City Council was held on Tuesday, January 15, 2013, in the City Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:25 p.m., by Mayor Sbranti. ROLL CALL PRESENT: Councilmembers Biddle, Haubert, and Mayor Sbranti ABSENT: Cm. Hart PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the City Council, Staff and those present. ORAL COMMUNICATIONS Presentation from the Livermore Valley Winegrowers Association 7:05 p.m. 3.1 This item was heard before the start of the official meeting due to the lack of a quorum, the City Council received the report. DUBLIN CITY COUNCIL MINUTES 1 VOLUME 32 REGULAR MEETING JANUARY 15, 2013 Mayor's Recommendation for Appointment to Heritage and Cultural Arts Commission 7:26:00 PM 3.2 On motion of Mayor Sbranti, seconded by Vm. Biddle and by unanimous vote (Cm. Hart absent), the City Council confirmed the Mayor’s recommendation of appointment of Timea Iharosi to the Heritage and Cultural Arts Commission. Acceptance of Donation Grant from the Altamont Cruisers Car Club 7:28:41 PM On motion of Vm. Biddle, seconded by Cm. Haubert and by unanimous vote (Cm. Hart absent), the City Council accepted the $3,000 donation, approved the budget change and formally recognized the donor. Public Comments 7:36:06 PM 3.4 Stephanie Ericson, Dublin resident, provided public comment. Jan Cornish-Barcus, Livermore Amador Valley Transit Agency (LAVTA) representative, provided public comment regarding changes in LAVTA bus routes in Dublin. Bruce Fielder, Dublin resident, provided public comment. CONSENT CALENDAR 7:42:45 PM Items 4.1 through 4.7 Cm. Haubert pulled Item 4.3 for further discussion. On motion of Vm. Biddle, seconded by Cm. Haubert and by unanimous vote (Cm. Hart absent), the City Council took the following actions: Approved 4.1 Minutes of December 18, 2012 Regular City Council meeting; DUBLIN CITY COUNCIL MINUTES 2 VOLUME 32 REGULAR MEETING JANUARY 15, 2013 Adopted 4.2 RESOLUTION NO. 1 - 13 AUTHORIZING TEMPORARY STREET CLOSURES FOR THE 2013 ST. PATRICK’S DAY PARADE AND SHAMROCK 5K FUN RUN AND WALK Adopted 4.4 RESOLUTION NO. 3 - 13 AUTHORIZING THE CITY MANAGER TO PURCHASE FURNITURE FROM ONE WORKPLACE PURSUANT TO THE U.S. COMMUNITIES GOVERNMENT PURCHASING AGREEMENT Adopted 4.5 ORDINANCE NO. 1 - 13 APPROVING A PLANNED DEVELOPMENT REZONE WITH RELATED STAGE 1 AND STAGE 2 DEVELOPMENT PLAN FOR THE MOLLER RANCH PROJECT (APNS 985-0001-001-01 and 985-0001-001-02) PLPA-2011-00003 ORDINANCE NO. 2 - 13 APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF DUBLIN AND BRADDOCK & LOGAN SERIVICES, INC. FOR MOLLER RANCH (APNS 985-0001-001-01 and 985-0001-001-02) PLPA-2011-00003 Received 4.6 the Check Issuance Report and Electronic Funds Transfersreport. Approved 4.7 Change Order #3 and authorized the City Manager to approve change orders up to a cumulative of $102,594 which were the remaining funds appropriated for improvements, as long as no individual change order exceeds $25,000. The City Council pulled Item 4. 3, Parks and Community Services Marketing Plan – Consultant Services Agreement for further discussion. DUBLIN CITY COUNCIL MINUTES 3 VOLUME 32 REGULAR MEETING JANUARY 15, 2013 On motion of Vm. Biddle, seconded by Cm. Haubert and by unanimous vote (Cm. Hart absent), the City Council adopted RESOLUTION NO. 2 - 13 APPROVING AN AGREEMENT WITH BW RESEARCH PARTNERSHIP FOR DEVELOPMENT OF A PARKS AND COMMUNITY SERVICES DEPARTMENT MARKETING AND PROMOTIONS PLAN WRITTEN COMMUNICATIONS – None. PUBLIC HEARINGS Introduction of Ordinance Amending Dublin Municipal Code Chapter 5.100 (Parks and Recreation Areas and Facilities) 7:49:57 PM 6.1 Mayor Sbranti opened the public hearing. Bruce Fiedler, Dublin resident, provided public comment on this item. Mayor Sbranti closed the public hearing. On motion of Vm. Biddle, seconded by Cm. Haubert and by unanimous vote (Cm. Hart absent), the City Council waived the reading and introduced an Ordinance amending Chapter 5.100 of the Dublin Municipal Code relating to the regulation of Parks and Recreation Areas and Facilities. UNFINISHED BUSINESS - None NEW BUSINESS Review of City Policies Prohibiting City Councilmembers from Engaging in Political Activities during City Council Meetings, at the Civic Center and While Representing the City in an Official Capacity 7:55:17 PM 8.1 DUBLIN CITY COUNCIL MINUTES 4 VOLUME 32 REGULAR MEETING JANUARY 15, 2013 By consensus, the City Council directed Staff to return with rules that included defining the meaning of political activity in the same manner as federal law defines political activity; and prohibiting political activity at the Civic Center, except for candidate forums and not including the parking lot in the definition of the Civic Center. OTHER BUSINESS 8:18:48 PM Brief information only reports were provided by the City Council and/or Staff, including Committee Reports and meetings attended at City expense (AB1234). ADJOURNMENT 10.1 There being no further business to come before the City Council, the meeting was adjourned at 8:24:36 PM in memory of Staff Sgt. Sean Diamond and our fallen troops.
