EXECUTIVE SUMMARY:
On March 15, 2011, the City Council authorized Staff to solicit bids for Contract No. 11-02,
Fiscal Year 2010-2011 Annual Sidewalk Safety Repair Program and~ Curb Ramp Installation.
The scope of improvements will cover two separate Capital Improvement Projects: 1) the
Annual Sidewalk Safety Repair Program (CIP No. 949102) and 2) The Americans with
Disabilities Act (ADA) Transition Plan (CIP No. 939102). Included in these projects are
improvements adjacent to Dublin High School and Frederiksen Elementary School. The
projects adjacent to the schools have been developed in partnership with the School District.
The City received a total of six bids for the work and the City Council will consider awarding the
bid to the lowest bidder.
FINANCIAL IMPACT:
The total budgeted for the two projects is $243,440 (Annual Sidewalk Repair equals $193,790
and Americans with Disabilities Act (ADA) Transition Plan $49,650). The project budgets
include $44,890 allocated for design, inspection, and project coordination. The remaining
$198,550 was budgeted for improvements. The funding sources include the General Fund and
Measure B Bike and Pedestrian Funds. Included in the General Fund appropriation is a
$35,000 contribution from the Dublin Unified School District for the reconstruction of sidewalks
next to Dublin High School and $30,000 from a Risk Management Grant is being allocated to
the ADA Project.
The total costs submitted by the low bidder result in budgetary savings for the Sidewalk Repair~
Project, and the ADA Project requires additional funding. It is proposed to transfer the
necessary funds from the Sidewalk Project to the ADA project. Even after the transfer of funds
the Annual Sidewalk project will have sufficient funding to identify additional repair locations that
present a safety hazard based on the funding and unit prices.
The total amount of the lowest responsible base bid presented by Weber Tractor Service is
$150,137.32: Including a 10% contingency would increase the total maximum contract to
$165,151.05. Staff is also seeking approval for the City Manager to approve change orders for
additional work using the unit prices from the low bid provided the total appropriated for
improvement costs is not exceeded. ~

Staff recommends that the City Council:
1. Adopt the Resolution awarding Contract No. 11-02, Fiscal Year 2010-2011 Annual
Sidewalk Safety Repair Program and Curb Ramp Installation to Weber Tractor Service.
2. Authorize the City Manager to approve a potential Change Order in an amount not to
exceed $33,399.02 ($10,047.68 General Fund for general sidewalk repairs and
$23,351.34 Measure B Funds for Dublin High School frontage improvements) for the
installation of additional sidewalk replacement locations based on unit prices in the
contract awarded and subject fo restrictions on grant funding.
3. Approve budget change which will transfer in the amount of $15,824 appropriated for
improve nts in the Annual Sidewalk Repair Project (No. 949102) to the Americans with
Disabili s Act (ADA) ransition Plan Project (No. 939102).

DESCRIPTION:
Staff solicited bids based on a scope of work that will encompass two separate Capital Projects.
Annual Sidewalk Safety Project Description
The Annual Sidewalk Safety Repair Program (remove and replace) repairs sidewalk offsets of
3/4-inch or more that may pose a tripping hazard. The remove and replace process is used in
locations where the offset is more significant or where tree roots are causing the offset. This
procedure requires the removal of the existing sidewalk and, in the case of root problems,
removal of the tree roots, and then replacement of the concrete sidewalk.
- While maintenance of sidewalks and other frontage improvements is legally the responsibility of
the adjacent private property owner, the City Council has adopted a City-funded sidewalk repair
program on a year-by-year basis since 1983. The City~Council extended funding for the City
repair project for an additional year in the Fiscal Year 2010-11 budget.
On October 5, 2010 the City Council approved a cooperative agreement with Dublin Unified
School District to incorporate sidewalk improvements along the frontage of Dublin High School
as part of the annual Sidewalk Repair Project. The School District provided $35,000 in funding
which was allocated as $12,600 for Design, $6,700 for inspection and project management and
$15,700 for improvements. The City Council appropriated additional $70,000 from Measure B
Bike / Pedestrian funds to fully fund the additional improvements.

Americans with Disabilities Act (ADA) Transition Plan Project Description
This project provides for a phased implementation of the recommended improvements listed in
the City's ADA Transition Plan 2006-2007 update. Improvements in the current year adopted
Capital Improvement Program were originally focused on pedestrian curb ramps.
.On September 21, 2010 the.City Council amended the scope of the project to make use of an
ABAG PLAN risk management grant. The proposed improvements were identified in
cooperation with the Dublin Unified School District to address deficiencies at the Frederiksen
Elementary School entrance (Tamarack Drive / Burton Drive). This included the upgrade of
curb ramps, relocation of drainage inlet outside of crosswalk, and replace non-compliant
driveway. The grant funds allocated to this project were $30,000.
Bids Received
A total of 6 bids were received for this project (Attachment 1). The low bid of $150,137.32 was
submitted by Weber Tractor Service. Staff has reviewed the bid results, checked references,
necessary licenses, and recommends that the City Council adopt the Resolution awarding
Contract No. 11-02; Fiscal Year 2010-2011 Annual Sidewalk Safety Repair Program and Curb
Ramp lnstallation to Weber Tractor as the lowest responsive bidder (Attachment 2).
Funding For Improvements To Be Constructed
As previously noted this agreement will fund improvements identified in two separate Capital
Projects. In addition within these projects there are sub-projects associated with the two school
projects discussed above.
A summary of the funding available for the improvements proposed to be constructed by Weber
Tractor Service has been prepared (see Attachment 3"Improvement Budget and Low Bid
Comparison"). The budgeted funds avaifable for improvements in the ADA Project are $47,850
and the cost of the improvements (including a 10% contingency) totals $63,673.94. There is
available funding budgeted in the Sidewalk Project which Staff has recommended be
transferred to the ADA Project (see Budget Change - Attachment 4).
In the Sidewalk project the.re are additional funds remaining for improvements. Staff will identify
the sites and locations for the curb ramps and sidewalk repairs, and will then confirm the cost
with the contractor based on the low bid prices. This will provide flexibility to add additional
locations or adjust the areas replaced based on additional review in the field. The funds
available include $10,047.68 in General Fund appropriations which can be used city wide and
$23,351.34 in Measure B Bike / Pedestrian funds which were specifically appropriated for use
adjacenf to the Dublin High School frontage. Included in the recommendation is a request to
authorize the City Manager to approve a Change Order in an amount not to exceed $33,399.02
to cover any authorized additional work.
Staff expects the project will begin in May 9, 2011 and should be completed by June 30, 2011.
This project will repair approximately 150 sidewalk locations that are unsafe or may pose a
tripping hazard.

WHEREAS, the City of Dublin did on April 4, 2011, publicly open, examine, and declare all
sealed bids for doing the work described in the approved Plans, Specifications, and Modifications for
Contract No. ll-02, 2010-2011 Annual Sidewalk Safety Repair Program and Curb Ramp Installation,
authorized by the City Council on March 15, 2011, which Plans, Specifications, and Modifications are
hereby expressly referred to far a description of said work and for all particulars relative to the
proceedings under the reques"t for bids; and
WHEREAS, said bids were submitted to the Public Warks Director, who has reviewed the bids to
determine the lowest bid which was responsive to the requirements of the bid documents;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the ~City of Dublin does
hereby award Contract No. 11-02, 2010-2011 Annual Sidewalk Safety Repair Program and Curb Ramp
Installation, to the lowest responsible bidder therefor, to wit, Weber Tractor Service, at a bid of One
Hundred-Fifty Thousand, One Hundred, Thirty Seven Dollars, and Thirty Two Cents ($150,137.32), the
particulars of which bid are on file in the offiee of the Public Works Director.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute the Agreement.

es~ablished at $40,000 prior to soliciting proposals in December 2010. The total cost based on the
recommended vendor is $55,000 requiring an additional appropriation. The General Fund has a reserve
designated for Innovations and New Opportunities; which would be reduced to reflect this appropriation.
