Smith, Parks and Facilities Development Manager EXECUTIVE SUMMARY: The City Council is being asked to reject the bid submitted for the Fallon Sports Park Phase II Preschool Relocation project due to the significant difference between the contractor's bid and the Engineer's Estimate. FINANCIAL IMPACT: Engineer's Estimate: $262,000 Bid Proposal: $461,000 Amount over Engineer's Estimate $199,000 RECOMMENDATION: Staff recommends the City Council adopt the Resolution rejecting the bid submitted by Suarez and Munoz Construction, Inc. for Contract #14 -07. � r Submitted By l Reviewed By Parks and Community Ser ices Director Assistant City Manager DESCRIPTION: On April 15, 2014, the City Council authorized Staff to solicit bids for Fallon Sports Park Phase II — Preschool Relocation. The work is being completed in preparation for the construction of the Emerald Glen Recreation and Aquatic Complex and was scheduled for this summer so as to minimize its impact on preschool programs. After a three -week bid period, the project received only one bid from Suarez and Munoz Construction, Inc., which was significantly higher than the Engineer's Estimate as shown above in the Financial Impact section. Page 1 of 2 ITEM NO. 4.10 The most significant differences in the contractor's bid and the Engineer's Estimate was in relation to the dismantling, transportation and reinstallation of the modular building and playground equipment, as well as the project mobilization costs. It is likely that the market conditions, the small size of the project and high demand at this time of year for companies that install modular buildings on school sites contributed to the cost overrun. If the City Council agrees with Staff's recommendation to reject the bid, Staff will, during the summer period, evaluate modifications to the scope in order to reduce the cost of the project, in addition to having, potentially, a more favorable bidding climate later in the year. Staff would then rebid the project in the fall. This would allow the City to schedule the move around the Winter Break holiday and will likely have a short term impact on pre - school programs into mid - January; specifically on the location of classes. Staff is currently considering alternatives to minimize the disruptions to the pre - school program. NOTICING REQUIREMENTS /PUBLIC OUTREACH: Notice of Inviting Bids were submitted to ten (10) plan rooms, posted in Tri- Valley Times twice, posted on the City of Dublin's website and individually emailed to ten (10) general contractors. XX - 14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * ** REJECTING BID SUBMITTED BY SAUREZ AND MUNOZ CONSTRUCTION, INC. FOR CONTRACT NO. 14 -07 FALLON SPORTS PARK PHASE II — PRESCHOOL RELOCATION WHEREAS, the City of Dublin did, on May 21, 2014, publicly open, examine and declare all sealed bids for doing the work described in the approved Plans and Specifications for Contract No. 14 -07, which Plans and Specifications are hereby expressly referred to for a description of said work and for all particulars relative to the proceedings under the request for bids; and and WHEREAS, said bid exceeds the Engineer's Estimate and the funds budgeted for this project; WHEREAS, the City Manager has recommended that the bid be rejected; NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby reject the bid received from Saurez and Munoz Construction, Inc.
